| Probable cause affidavit: | SUBMITTED BY: FERGUSON, KYLE 1266 (AR15-17715) (15-167136) DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 122215 AT APPROXIMATELY 2120 HOURS, I RESPONDED TO the INTERSECTION OF NORTH HOLIDAY DRIVE AND SHERWOOD TERRACE, IN REFERENCE TO BACKING UP DEPUTY BRUNK, WHO WAS ON A TRAFFIC STOP WITH A FOUR-WHEELER AT THAT LOCATION. UPON ARRIVAL, I MADE CONTACT WITH DEPUTY BRUNK WHO ADVISED HE HAD OBSERVED the FOUR-WHEELER TO BE DRIVING SOUTHBOUND ON THE NORTHBOUND SIDE OF HOLIDAY DRIVE, AT WHICH TIME HE CONDUCTED A TRAFFIC STOP. I THEN MADE CONTACT WITH THE DRIVER/DEFENDANT, MR RICHARD WAYNE NICHOLS, WHO ADVISED HE DID NOT HAVE HIS DRIVER'S LICENSE ON HIM. I ASKED the DEFENDANT IF HE HAD A VALID FLORIDA DRIVER'S LICENSE, TO WHICH HE STATED NO AND that IT HAD PREVIOUSLY BEEN SUSPENDED. UPON RUNNING THE DEFENDANT'S NAME VIA THE DRIVER AND VEHICLE INFORMATION DATABASE, I OBSERVED HIS DRIVER'S LICENSE WAS IN FACT SUSPENDED AND HE WAS ARRESTED FOR DRIVING WHILE LICENSE SUSPENDED (DWLS) ON 091314. AT THAT TIME, the DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN THE REAR OF MY PATROL VEHICLE. HE WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS TURNED OVER TO DETENTION STAFF. HIS BOND WAS SET AT $1,000.00 FOR DRIVING WHILE LICENSE SUSPENDED (KNOWINGLY). THE DEFENDANT WAS ISSUED WRITTEN WARNING, NUMBER 402351B, FOR DRIVING A FOUR-WHEELER ON the ROADWAY AND A CRIMINAL CITATION, NUMBER A1P2AIP, WITH A COURT DATE OF 010716 AT 1300 HOURS. BOTH COPIES OF THE WRITTEN WARNING AND the CITATION WERE LEFT IN the DEFENDANT'S PROPERTY. |
