SUBMITTED BY: HORTON, TIMOTHY 0614 (AR11120255) did, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(2). ON 041311 AT APPROXIMATELY 1021 HOURS I RESPONDED TO US 19 AT THE INTERSECTION OF COUNTY ROAD 490 TO BACK UP DEPUTY CHENOWETH WHO WAS ON A TRAFFIC STOP. ONCE I ARRIVED, DEPUTY CHENOWETH ADVISED THAT HE OBSERVED THE DEFENDANT, LATER IDENTIFIED AS MR RICHARD CHARLES WILSON JR, OPERATING A 2001 HONDA CIVIC FOUR DOOR, BLUE IN COLOR VEHICLE BEARING FLORIDA TAG, F182LJ. THIS VEHICLE WAS TRAVELING WESTBOUND ON WEST GROVER CLEVELAND BOULEVARD APPROACHING US 19 WHILE DEPUTY CHENOWETH WAS FOLLOWING BEHIND. I WAS ADVISED BY DEPUTY CHENOWETH THAT THE REASON FOR THE TRAFFIC STOP WAS THE VEHICLE HAD A BROKEN RIGHT TAIL LIGHT. AT THE TIME OF THE TRAFFIC STOP, DEPUTY CHENOWETH STATED THAT HE HAD A PREVIOUS ENCOUNTER WITH THE DEFENDANT A COUPLE OF DAYS PRIOR DURING A ROUTINE TRAFFIC STOP, AND FURTHER STATED THAT HE HAD KNOWLEDGE THAT THE DEFENDANT'S DRIVER'S LICENSE WAS SUSPENDED. A COMPUTER CHECK REVEALED THAT THE DEFENDANT'S DRIVER'S LICENSE HAD BEEN SUSPENDED ON FOUR OCCASIONS. THE FIRST WAS ON 121508, WHERE IT WAS SUSPENDED INDEFINITELY FOR FAILURE TO PAY TRAFFIC FINE, THE SECOND ON 101909, WHERE IT WAS SUSPENDED INDEFINITELY FOR FAILURE TO PAY TRAFFIC FINES, THE THIRD ON 022410, WHERE THE STATUS WAS CANCELLATION REFERENCE TO AN EXPIRED DRIVER'S LICENSE AND THE MOST CURRENT ON 010311, WHERE IT WAS SUSPENDED INDEFINITELY FOR FAILURE TO PAY COURT FINANCIAL OBLIGATIONS, CASE 2010CF000031. WHILE SPEAKING WITH THE DEFENDANT, HE STATED THAT HE HAD LOST HIS DRIVER'S LICENSE AND COULD ONLY PROVIDE AN IDENTIFICATION CARD. HE STATED THAT HE DID NOT BELIEVE THAT HIS DRIVER'S LICENSE WAS SUSPENDED, AND HAD BEEN PAYING FOR THE PREVIOUS TRAFFIC FINES. HE ALSO STATED THAT HE HAD TRAFFIC FINES OUTSTANDING, BUT COULD NOT BE SPECIFIC. AT THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED (KNOWINGLY) HANDCUFFED, (DOUBLE LOCKED) BEHIND HIS BACK, AND SECURED IN THE REAR OF MY PATROL VEHICLE. THE VEHICLE WAS LATER TURNED OVER TO THE DEFENDANT'S MOTHER, MS ROBIN WILSON. AT THAT TIME THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. WHILE AT THE DETENTION FACILITY, THE DEFENDANT WAS ISSUED A WRITTEN WARNING FOR FAULTY EQUIPMENT, WARNING 99029911. the DEFENDANT WAS ALSO ISSUED FLORIDA UNIFORM TRAFFIC CITATION,8257R0, FOR DRIVING WHILE LICENSE WAS SUSPENDED, WITH A MANDATORY COURT APPEARANCE ON 042811 AT 0100 HOURS AT THE CITRUS COUNTY COURTHOUSE. THE DEFENDANT WAS ALSO ISSUED FLORIDA UNIFORM TRAFFIC CITATION, 8258R0Z, FOR NO PROOF OF INSURANCE WITH A PAYABLE FINE WITHIN 30 DAYS OF $116.00. THE DEFENDANT'S BOND WAS SET AT $500.00 PER THE BOND SCHEDULE FOR DRIVING WHILE LICENSE WAS SUSPENDED.
