SUBMITTED BY: LONG, BENJAMIN 1303\t\t(AR16-20783 DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF VICTIM, TO WIT: UNABLE TO PAY FOR TAXI FARE OF $109.94 PLUS ADDITIONAL FEE OF $3.91 FOR PACK OF 305 CIGARETTES FOR TOTAL LOSS OF $113.85, BY CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF OVER $100.00, BUT LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 812.014(2)(E). ON 083016, I WAS DISPATCHED TO 450 SE HIGHWAY 19 IN CRYSTAL RIVER, WHICH IS BANK OF AMERICA, IN REFERENCE TO THEFT OF SERVICES. WHEN I ARRIVED ON SCENE, I MADE CONTACT WITH THE COMPLAINANT, MR DAVID LONDON, IN THE PARKING LOT OF THE BANK. MR LONDON ADVISED ME THAT HE WORKS FOR AFFORDABLE CAR SERVICE AND TAXI AS A TAXI DRIVER. THE COMPLAINANT HAD PICKED UP THE DEFENDANT, MR RICK LAYNE DETAVERNIER, AT HIS ADDRESS OF 9639 NORTH MISTY JANELL TERRACE AT APPROXIMATELY 1100 HOURS. THE COMPLAINANT INFORMED ME THAT THEY HAD MADE MULTIPLE STOPS THROUGHOUT CITRUS COUNTY TO INCLUDE CRYSTAL RIVER SUBSTATION, AND DIFFERENT PAWN SHOPS IN THE AREA. HE INFORMED ME THAT THE DEFENDANT WAS NOT ABLE TO PAY $109.94 FOR HIS TAXI FARE AND AN ADDITIONAL FEE OF $3.91 FOR A PACK OF 305 CIGARETTES THAT THE COMPLAINANT HAD PURCHASED FOR THE DEFENDANT, FOR A TOTAL OF $113.85. DUE TO PREVIOUS ENCOUNTERS WITH THE DEFENDANT BY OTHER DEPUTIES, IT WAS DETERMINED THAT THE DEFENDANT KNEW BEFORE HIRING A TAXI DRIVER THAT HE WAS UNABLE TO PAY HIS TAXI FARE. THE DEFENDANT ATTEMPTED TO RETRIEVE MONEY FROM THE BANK OF AMERICA PRIOR TO MY ARRIVAL, WHICH HE WAS DECLINED DUE TO INSUFFICIENT FUNDS IN HIS ACCOUNT. AT THIS TIME, THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED), SEARCHED, AND PLACED IN THE REAR SEAT OF MY PATROL CAR. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. NUMEROUS PERSONAL ITEMS OF THE DEFENDANT WERE GATHERED FROM THE TAXI, WHICH INCLUDED A MOSSBERG 16 GAUGE SHOTGUN, BEARING NO SERIAL NUMBER. THAT SHOTGUN WAS LATER TURNED IN TO EVIDENCE. THE DEFENDANTâS OTHER PERSONAL PROPERTY WAS TURNED OVER TO JAIL STAFF. THE DEFENDANT WAS CHARGED WITH ONE COUNT PETIT THEFT WITH HIS BOND SET AT $500.00, PER THE BOND SCHEDULE. |
