| Probable cause affidavit: | SUBMITTED BY: REESE, KELLIE 0640 (AR08101881) did unlawfully enter or remain in a certain conveyance, to-wit: 1988 GMC BOX TRUCK, the property of PAYLESS FURNITURE STORE WITHOUT said person's consent, with the intent to commit an offense therein, to-wit: THEFT OF GASOLINE AND the said conveyance was not open to the public at the time, and the DEFENDANT, RICKY RICHARDS, WAS not licensed or invited to enter or remain in said conveyance, in violation of Florida Statute 810.02(4)(B) AND DID KNOWINGLY, WHILE HIS OPERATOR'S OR CHAUFFEUR'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, (HABITUAL) DRIVE UPON THE HIGHWAYS OF THIS STATE, IN VIOLATION OF FLORIDA STATE STATUTE 322.347 On 022508, at approxIMATELY 2308 hOUrs, Deputy Tackett observed a vehicle pulling out of Carlo's Tire Store (located at 6680 WEST. Gulf to Lake HIGHwAy Crystal River) a closed business. Deputy Tackett pulled into the business to investigate, stopping the vehicle in the parking lot. Deputy Tackett made contact with the driver ultimately identified AS THE DEFENDANT Ricky Richards. The defendant refused to explain why he was AT the closed business he also gave several fictitious names. As Deputy Tackett investigated further he found that a 1988 GMC box truck parked at the business AND had its gas cap removed. DEPUTY TACKETT DID DETECT A STRONG odor of gasoline THAT hung in the air. Deputy Tackett then discovered a gas can containing approximately ONE HALF GALLON of gasoline in it. in the defendant's trunk, lying next to the gas can was a siphon hose. Behind the GMC box truck were fresh tire tracks which matched that of the defendant's vehicle. IT WAS AT THAT TIME, Deputy Cridland responded to process the scene to include photographing the tire tracks, gas can, and siphon hose. At approximately 0000 hOUrs I arrived on scene, was briefed by Deputy Cridland, AND assumed primary of the call. The defendant was placed under arrest, handcuffed (double-locked) and secured in the rear of my patrol vehicle. A DEPARTMENT OF HIGHWAY SAFETY MOTOR VEHICLE (DHSMV) check revealed the defendant's driving PRIVILEGES had been suspended FOURTEEN TIMES including once on 120103, for Habitual Traffic ViolatIONS. THE Defendant was HANDCUFFED (DOUBLE LOCKED) BEHIND the BACK, PLACED INTO THE REAR OF MY PATROL VEHICLE, AND TRANSPORTED to THE CITRUS COUNTY DETENTION FACILITY where he was turned over for booking AND PROCESSING. THE DEFENDANT'S BOND WAS set at $4,000.00 per bond schedule. the DEFENDANT WAS issued UNIFORM TRAFFIC CITATION (UTC) NUMBER 9703-FIQ FOR DRIVING WHILE LICENSE IS SUSPENDED (DWLS) with a traffic court date of 031308, at 1300 HOURS. iT SHOULD BE NOTED, The defendant's vehicle was towed by rotation wrecker; All Prestige.
