Probable cause affidavit: |
SUBMITTED BY: CLARK, CORRY 0711 (AR11119495) DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(10)(A). ON 022311 AT APPROXIMATELY 1638 HOURS, I WAS DRIVING WESTBOUND ON ROOSEVELT BOULEVARD IN BEVERLY HILLS WHEN I OBSERVED A WHITE VEHICLE HEADED SOUTH ON ADAMS STREET. the VEHICLE WAS STOPPED IN the MIDDLE OF THE ROADWAY, AT WHICH TIME I OBSERVED THE REAR DRIVER SIDE BRAKE LIGHT TO BE INOPERABLE. I THEN GOT BEHIND THE VEHICLE AND THE VEHICLE CONTINUED SOUTH ON ADAMS STREET. UPON GETTING BEHIND THE VEHICLE, I OBSERVED THE REAR PASSENGER TAIL LIGHT TO BE EMITTING WHITE LIGHT, AT WHICH TIME I INITIATED A TRAFFIC STOP and THE VEHICLE THEN PULLED INTO the DRIVEWAY OF 83 SOUTH ADAMS STREET, WHICH IS A VACANT RESIDENCE. UPON APPROACHING THE VEHICLE, THE DEFENDANT WAS THE ONLY OCCUPANT INSIDE. UPON ASKING THE DEFENDANT FOR HIS DRIVER'S LICENSE, HE STATED that HE DOES NOT HAVE IT. he THEN EXPLAINED that HE DOES NOT HAVE A CURRENT VALID DRIVER'S LICENSE, HOWEVER DOES HAVE AN IDENTIFICATION CARD, WHICH HE PROVIDED ME WITH. AT THAT TIME I RETURNED TO MY PATROL VEHICLE AND RAN THE SUBJECT THROUGH D.A.V.I.D., WHERE IT CONFIRMED THAT THE DEFENDANT'S DRIVER'S LICENSE WAS SUSPENDED, CHARGEABLE UNDER FLORIDA STATE STATUTE 322.34(10)(A). I THEN RETURNED TO THE DEFENDANT'S VEHICLE, WHERE HE ADVISED THAT HE KNEW HIS LICENSE HAD BEEN SUSPENDED and that HE WAS NOT SUPPOSED TO BE DRIVING. AT THAT TIME I PLACED THE DEFENDANT IN HANDCUFFS BEHIND THE BACK (DOUBLE LOCKED) and PLACED HIM IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT'S DAUGHTER ARRIVED ON SCENE, WHERE THE DEFENDANT TURNED THE VEHICLE OVER TO HER. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY WHERE HIS BOND WAS SET AT $500.00 PER THE BOND SCHEDULE.
