SUBMITTED By: AGUILERA, EMANUEL 1238 (AR14-12166) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 0.2 GRAMS OF METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 092814 AT APPROXIMATELY 1430 HOURS, I WAS TRAVELING EAST ON WEST GROVER CLEVELAND BOULEVARD WHEN I OBSERVED A WHITE FOUR DOOR VEHICLE TRAVELING IN MY DIRECTION (WESTBOUND) IN THE AREA OF SOUTH SPRING SONG TERRACE. I ESTIMATED THE VEHICLE TO BE TRAVELING APPROX 60 MILES PER HOUR (MPH) IN A 50 MPH ZONE. I ACTIVATED MY RADAR ANTENNA, RECEIVED A CLEAR AUDIO DOPPLER TONE, AND received A READING OF 62 MPH. I THEN EXECUTED A U-TURN, GOT BEHIND SAID VEHICLE BEARING TAG N739VH, AND CONDUCTED A TRAFFIC STOP IN THE AREA OF SOUTH CEDAR TERRACE AND WEST GROVER CLEVELAND BOULEVARD. I MADE CONTACT WITH THE DRIVER/DEFENDANT, LATER IDENTIFIED AS MR ROBERT BRUNO. I ASKED HIM THE SPEED LIMIT FOR THAT AREA, TO WHICH HE ADVISED HE THOUGH IT WAS EITHER 40 MPH OR 50 MPH. I ADVISED HIM THAT IT WAS A 50 MPH ZONE; HOWEVER, HE WAS DRIVING AT 62 MPH. HE ADVISED HE WAS SORRY, HE DID NOT THINK HE WAS GOING THAT FAST. I ASKED HIM FOR HIS LICENSE, REGISTRATION, AND PROOF OF INSURANCE. WHILE SPEAKING WITH THE DEFENDANT, I OBSERVED HIM TO BE VERY NERVOUS AND FIDGETY. AT SOME POINTS HE WAS STUTTERING HIS WORDS WHILE SPEAKING WITH ME. HE PROVIDED ME with HIS LICENSE, REGISTRATION, AND PROOF OF INSURANCE. I OBSERVED HIM TO HAVE TO TWO OTHER OCCUPANTS IN THE VEHICLE, ONE BEING IN THE FRONT PASSENGER'S SEAT AND ONE IN THE RIGHT REAR PASSENGER SEAT. I ASKED THEM IF THEY HAD ANY IDENTIFICATION ON THEM, TO WHICH THEY BOTH PROVIDED ME WITH THEIR FLORIDA IDENTIFICATION CARDS. I ASKED THE DEFENDANT IF HE HAD ANYTHING ILLEGAL IN THE VEHICLE TO WHICH HE ADVISED HE DID NOT. I ASKED HIM FOR AUTHORIZATION TO SEARCH HIS VEHICLE, TO WHICH HE GAVE ME CONSENT TO SEARCH HIS VEHICLE. I MADE CONTACT with THE DEFENDANT ONCE AGAIN AND ASKED HIM TO STEP OUT OF THE VEHICLE DUE TO HIM CONSENTING TO A SEARCH. THE DEFENDANT SAT AT THE REAR OF HIS VEHICLE, MR CHRISTOPHER CAMEJO SAT AT THE FRONT OF MY VEHICLE, AND MS CLAUDIA SCARBROUGH SAT AT THE FRONT OF THE DEFENDANT'S VEHICLE. DEPUTY MERRITT (0757) SHOWED UP ON SCENE AS A BACKUP DEPUTY. I SEARCHED the VEHICLE AND FOUND A POUCH IN THE SEAT DIRECTLY UNDER THE DEFENDANT'S LEG AREA. INSIDE THE POUCH I LOCATED A CLEAR PLASTIC BAGGIE WITH A CRYSTAL LIKE SUBSTANCE. THROUGH MY TRAINING AND EXPERIENCE I BELIEVED THE SUBSTANCE TO BE CRYSTAL METHAMPHETAMINE. THE SUBSTANCE WAS field TESTED AND YIELDED A POSITIVE TEST RESULT FOR METHAMPHETAMINE. I THEN READ THE DEFENDANT HIS MIRANDA RIGHTS VIA A PREPRINTED CARD. I ASKED HIM IF HE WISHED TO SPEAK WITH ME, AND HE STATED THAT HE DID. I ASKED HIM ABOUT the CRYSTAL METHAMPHETAMINE, TO WHICH HE ADVISED THAT IT WAS HIS. I THEN ASKED HIM HOW LONG HE HAD BEEN USING METHAMPHETAMINE, TO WHICH HE STATED FOR SEVERAL YEARS OFF AND ON AND THAT HE WAS TRYING TO STOP. I ASKED HIM HOW MUCH HE HAD PAID FOR THIS QUANTITY, TO WHICH HE ADVISED THAT A FRIEND HAD GIVEN IT TO HIM. I ADVISED HIM HE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF A CONTROLLED SUBSTANCE. HE WAS PLACED UNDER ARREST HANDCUFFED (DOUBLE LOCKED) AND PLACED IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY AND TURNED OVER TO STAFF. HIS BOND WAS SET AT $2,000.00 PER the BOND SCHEDULE. THE DEFENDANT WAS ISSUED A WRITTEN WARNING, NUMBER 387259B, FOR 62 MPH IN A 50 MPH ZONE. DEPUTY MERRITT REMAINED ON SCENE UNTIL THE DEFENDANT'S VEHICLE WAS TOWED TO ADAM'S TOWING. |
