SUBMITTED BY: CAREY, SAMUEL 0753 (AR12-357) \tDID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATUTE 322.34(2)(A). ON 031812 AT 1200 HOURS I WAS CONDUCTING TRAFFIC ENFORCEMENT IN THE AREA OF THE CITY OF CRYSTAL RIVER. AT THAT TIME I OBSERVED A MALE SUBJECT OPERATING A WHITE TRUCK BEARING FLORIDA TAG ARTTI3, WHICH WAS PULLING A BOAT AT THE STOP SIGN OF NE 3RD STREET AND 3RD AVENUE . I OBSERVED THE MALE SUBJECT WAS NOT WEARING A SEATBELT AND THE PASSENGER OF THE VEHICLE, A WHITE FEMALE, DID HAVE HER SEATBELT ON. AT THAT TIME I POSITIONED BY PATROL VEHICLE BEHIND SAID VEHICLE AND ACTIVATED MY EMERGENCY EQUIPMENT. THE VEHICLE THEN STOPPED JUST PAST THE INTERSECTION, WHERE THE DRIVER AND THE PASSENGER IMMEDIATELY EXITED THE VEHICLE AND BEGAN WALKING TOWARD ME. AT THAT TIME I ASKED THEM TO RE-ENTER THE VEHICLE AS I MADE MY APPROACH TOWARDS THEM. I THEN MADE CONTACT WITH THE MALE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR ROBERT CORBIN, AND THE FEMALE PASSENGER IDENTIFIED AS MS APRIL MONTROY. UPON ASKING THE DEFENDANTS FOR HIS DRIVERâS LICENSE, REGISTRATION AND PROOF OF INSURANCE, HE STATED THAT HE DID NOT HAVE A DRIVERâS LICENSE AND THE VEHICLE BELONGED TO HIS SISTER, WHO WAS THE PASSENGER, MS APRIL MONTROY. HE STATED THAT HE HAD ONLY BEEN DRIVING THE VEHICLE A SHORT DISTANCE. THE PASSENGER, MS MONTROY PROVIDED ME WITH THE VEHICLEâS INSURANCE AND REGISTRATION INFORMATION. THE DEFENDANT THEN GAVE ME HIS SOCIAL SECURITY NUMBER. UPON RUNNING THE DEFENDANT THROUGH THE âDAVIDâ PROGRAM, IT WAS DETERMINED THAT HE HAD A SUSPENDED/ REVOKED DRIVERâS LICENSE WITH NOTICE GIVEN BY COURT ORDER. AND THAT TIME I REQUESTED A BACKUP DEPUTY. I CONTACTED TELETYPE TO CONFIRM THE REVOKED DRIVERâS LICENSE WHERE THE TELETYPE OPERATOR ADVISED ME THAT THE DEFENDANT HAD A PAST CRIMINAL RECORD FOR THE MANUFACTURING OF METHAMPHETAMINES. MY BACKUP DEPUTY, CANINE DEPUTY COX, ARRIVED (0543) ARRIVED WITH HIS CANINE, PRIEST. AS I BEGAN WRITING THE CITATIONS FOR THE DEFENDANT, DEPUTY COX WALKED CANINE PRIEST AROUND THE VEHICLE AND DEPUTY COX THEN NOTIFIED ME THAT CANINE PRIEST ALERTED TO THE ODOR OF ILLEGAL SUBSTANCES ON THE PASSENGER SIDE OF THE VEHICLE. AT THAT TIME I REMOVED THE DRIVER FROM THE VEHICLE AND PLACED HIS HANDS BEHIND HIS BACK AT WHICH TIME HE WAS PLACED UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED/REVOKED KNOWINGLY. THE DEFENDANT WAS THEN SECURED IN THE REAR OF MY PATROL VEHICLE. UPON DEPUTY COX SEARCHING THE VEHICLE, HE LOCATED A BLACK BACKPACK IN THE OPEN BED OF THE TRUCK. INSIDE THE BACKPACK, DEPUTY COX DISCOVERED ONE BOTTLE OF HOUSEHOLD RED DEVIL LYE, ONE UNOPENED BOX OF SUDAFED WITH 20 CAPLETS AND TWO SMALL BOTTLES OF ACID. KNOWING FROM PREVIOUS EXPERIENCE THAT THESE ITEMS ARE USED IN THE MANUFACTURE OF METHAMPHETAMINE, DEPUTY COX CONTACTED DETECTIVE STEVE SMITH AND ADVISED HIM OF THE SITUATION. DETECTIVE SMITH ADVISED THAT HE WOULD BE EN ROUTE TO OUR LOCATION. UPON A FURTHER SEARCH OF THE VEHICLE AND THE BOAT, WE LOCATED TWO SPRAY CANS OF ETHER AND A BOTTLE OF CHARCOAL LIGHTER FLUID. A SHORT TIME LATER DETECTIVE SMITH ARRIVED ON SCENE AND MET WITH THE DEFENDANT. FOR THE DEFENDANTâS COMFORT, HIS HANDCUFFS WERE PLACED IN FRONT OF HIS PERSON. I OBSERVED DETECTIVE SMITH ADVISE THE DEFENDANT OF HIS MIRANDA WARNINGS. THE DEFENDANT ADVISED THAT HIS BROTHER BUYS HIM PACKAGES OF SUDAFED, BECAUSE THE DEFENDANT DOES NOT HAVE AN ID AND CANNOT BUY SUDAFED. THE DEFENDANT ALSO ADVISED THE BACKPACK WAS HIS AND THAT HIS SISTER HAD NO KNOWLEDGE OF THE ITEMS IN THE BACKPACK. AT THAT TIME THE DEFENDANT STATED THAT HE UNDERSTOOD HIS RIGHTS AND HE WISHED TO SPEAK WITH DETECTIVE SMITH. AFTER DETECTIVE SMITH COMPLETED HIS INVESTIGATION, I TRANSPORTED HIM TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL AT THE DETENTION FACILITY THE DEFENDANTâS BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. THE VEHICLE AND ALL OF THE DEFENDANTâS POSSESSIONS WERE TURNED OVER TO HIS SISTER, MS MONTROY, WHO HAD A VALID FLORIDA DRIVERâS LICENSE. THE DEFENDANT WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION 7506-GQF (5) FOR NOT WEARING A SEATBELT AND FLORIDA UNIFORM TRAFFIC CITATION 7505-GQF (4) FOR DRIVING WHILE LICENSE WAS SUSPENDED/REVOKED. DETECTIVE SMITH COLLECTED THE ITEMS USED IN THE MANUFACTURE OF METHAMPHETAMINES AND TRANSPORTED THEM THE CITRUS COUNTY LANDFILL FOR DESTRUCTION. |
