submitted by: TAYLOR, MATTHEW 0400 (AR11119241) ROBBERY, MEANS OF TAKING OF MONEY OR OTHER PROPERTY WHICH MAY BE THE SUBJECT OF LARCENY FROM THE PERSON OR CUSTODY OF ANOTHER, WITH THE INTENT TO EITHER PERMANENTLY OR TEMPORARILY DEPRIVE THE PERSON OR THE OWNER OF THE MONEY OR OTHER PROPERTY, WHEN IN THE COURSE OF TAKING THERE IS A USE OF FORCE, VIOLENCE, ASSAULT, OR PUTTING IN FEAR, IN THE COURSE OF THE ROBBERY THE DEFENDANT DID NOT CARRY A FIREARM, DEADLY WEAPON, OR OTHER WEAPON, IN VIOLATION OF FLORIDA STATE STATUTE 812.13(2)(C). DID OPERATE A VEHICLE IN THE STATE OF FLORIDA AND, HAVING KNOWLEDGE THAT HE HAD BEEN DIRECTED TO STOP SUCH VEHICLE BY A DULY AUTHORIZED LAW ENFORCEMENT OFFICER, DID WILLFULLY REFUSE OR FAIL TO STOP SUCH VEHICLE IN COMPLIANCE WITH SUCH DIRECTIVE, IN VIOLATION OF FLORIDA STATE STATUTE 316.1935(1). ON 020811 AT APPROXIMATELY 1645 HOURS, THE DEFENDANT ENTERED THE BB&T BANK LOCATED AT 2709 EAST GULF TO LAKE HIGHWAY IN INVERNESS. THE DEFENDANT ENTERED THE NORTH DOOR OF THE BANK AND APPROACHED THE FIRST TELLER TO THE RIGHT. THE DEFENDANT INSTRUCTED THE TELLER TO PUT THE MONEY IN the BAG, TO WHICH SHE REPLIED "ARE YOU KIDDING". AT THAT TIME THE DEFENDANT STATED "PUT THE MONEY IN THE BAG" AND PRODUCED A GRAY PLASTIC BAG AND SHOVED IT TOWARD THE TELLER. HE INSTRUCTED HER TO NOT TOUCH ANY BUTTONS AND BECAME VERBALLY FORCEFUL TELLING HER TO HURRY. THE TELLER QUICKLY PUT MONEY IN THE DEFENDANT'S GRAY BAG AND HANDED BACK TO HIM and AT THAT TIME the DEFENDANT FLED OUT THE NORTH DOOR OF THE BUILDING AND ENTERED A WHITE FORD TRUCK AND FLED WESTBOUND ON HIGHWAY 44. PURSUANT TO A "BOLO" BEING ISSUED FOR THE VEHICLE AND THE DEFENDANT, DEPUTY FERGUSON AND CAPTAIN RICHIE OBSERVED THE DEFENDANT S VEHICLE TRAVELING WESTBOUND ON HIGHWAY 44 AND UPON TURNING AROUND AND ATTEMPTING TO STOP THE DEFENDANT'S VEHICLE, DEPUTY FERGUSON ACTIVATED HIS OVERHEAD LIGHTS and SIRENS. AT THAT TIME THE DEFENDANT FLED WESTBOUND ON HIGHWAY 44 AND NORTHBOUND ON LEONA. THERE IS A PORTION OF LEONA THAT IS SEPARATED BY A WOODED AREA, THE DEFENDANT ENTERED THAT AREA CONTINUING NORTH and DUE TO THE CONDITION OF THE TERRAIN, HIS VEHICLE BECAME DISABLED. AFTER DOING SO, THE DEFENDANT EXITED HIS VEHICLE AND FLED ON FOOT IN A NORTH WESTERLY DIRECTION. AT THAT time A PASSENGER OF THE VEHICLE EXITED THE VEHICLE AND WAS IMMEDIATELY TAKEN INTO CUSTODY BY DEPUTIES. AFTER A SHORT SEARCH OF the AREA UTILIZING K-9, THE DEFENDANT WAS CAPTURED and TAKEN INTO CUSTODY. THE DEFENDANT IMMEDIATELY STATED THAT THE PASSENGER OF THE VEHICLE WAS NOT INVOLVED, NOR DID HE KNOW THAT THIS WAS GOING TO HAPPEN. THE DEFENDANT THEN INVOKED HIS RIGHTS TO ARRESTING DEPUTIES. AT APPROXIMATELY 1730 HOURS, TWO WITNESSES AT THE BANK WERE DRIVEN TO THE SCENE, WHERE THEY BOTH POSITIVELY IDENTIFIED THE DEFENDANT AS the INDIVIDUAL WHO ROBBED THE BANK. THE DEFENDANT'S VEHICLE WAS SECURED AND IMPOUNDED IN ID AND EVIDENCE BAY. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. WHILE BEING PROCESSED AT THE DUTY OFFICE I INFORMED THE DEFENDANT THAT I KNEW HE HAD INVOKED HIS RIGHTS and THAT HE WAS BEING CHARGE WITH ROBBERY and FLEEING AND ELUDING. I COMMENTED TO THE DEFENDANT THAT IT LOOKED LIKE THE TRUCK RIDE HE TOOK WAS FUN, AT WHICH TIME THE DEFENDANT SMILED. THE DEFENDANT THEN STATED, "LISTEN, I didn't WANT TO TALK TO THOSE OTHER DEPUTIES, I WAS STILL HIGH". HE THEN STATED HE WANTED TO TALK TO ME BECAUSE HE WANTED TO GO BACK TO PRISON. I THEN RETRIEVED MY RECORDER AND WAS ACCOMPANIED BY DEPUTY FERGUSON AND BEGAN A RECORDED STATEMENT WITH THE DEFENDANT. DURING the STATEMENT THE DEFENDANT WAS ADVISED OF HIS MIRANDA RIGHTS, IN ADDITION HE STATED THAT HE REQUESTED TO TALK ABOUT THIS CASE WITH ME. THE DEFENDANT STATED THAT HE HAD BEEN ON A THREE DAY DRUG BINGE AND THAT HE WAS TIRED OF LIVING ON THE STREETS. HE STATED that HE WANTED TO GO TO FEDERAL PRISON BECAUSE IT WAS EASIER. THAT IS WHY HE PICKED A BANK THAT WAS FDIC INSURED. HE STATED THAT HE WENT TO FOUR BANKS AND THAT THE BB&T WAS THE ONLY ONE OPEN, ADDING THAT THE OTHER BANKS HAD POSTED MONDAY THROUGH THURSDAY 0900 TO 1600 HOURS. HE STATED THAT HE ENTERED THE BANK AND HANDED THE TELLER A GRAY LOWES BAG AND ASKED HER NICELY FOR THE MONEY. HE STATED that WHEN HE LEFT THE BANK HE DROVE WEST ON HIGHWAY 44 AND DEPUTIES BEGAN TO FOLLOW HIM. HE SAID HE TURNED and WENT DOWN A DIRT ROAD. WHEN I ASKED THE DEFENDANT THE PASSENGER'S INVOLVEMENT, HE STATED HE HAD NO KNOWLEDGE THAT HE WAS GOING TO DO THIS and THAT HE HAD DROPPED HIM OFF AT LOWES BEFORE HE WENT IN SEARCH OF A BANK. THE DEFENDANT WAS CHARGED WITH ROBBERY and FLEEING AND ELUDING. HIS BOND WAS SET AT $11,000.00 PER BOND SCHEDULE.
