Probable cause affidavit: SUBMITTED BY: HOLLOWAY, WILLIAM, TODD 0463 (AR2012-1022) On 4-21-2012 Two Vehicle burglaries (Case number 2012-00074737) were reported at the apartments located at 6003 E Turner Camp rd. During the Burglaries victim 1 advised that she observed a white male enter her vehicle and various items. A second victim came forward and reported a his vehicle was entered and had ITEMS REMOVED. On 04 23-2012 A vehicle Burglary (case 2012 00075438) WAS reported at 5430 E. Tangelo lane . During the Burglary a Sony Cd player was reported missing. On 4-24-2012 A vehicle Burglary (case number 2012-00082276) WAS reported at 982 Hawk Crest Ln In Inverness. During the course of the burglary the victims vehicle was entered and various items were removed. On 4-25-2012 A vehicle BURGLARY (2012-00077123) was reported at 923 Russell Ave. During the Burglary a Garmin Nuvi Gps was stolen. A second Burglary was reported at 913 Russell ave where a second Garmin Gps was taken. A third vehicle Burglary was reported at 1104 Russell ave. where a Tom Tom Gps unit was taken. On 4-26-2012 A vehicle Burglary (2012-000777363) WAS reported at 4009 E. Allendale St where the victim advised her vehicle was entered and various items removed. During the course of the investigation it was learned that 5 other victims had their vehicles entered and items removed. On 4-28-2012 five vehicle burglaries (case 2012 00078787)and a vessel burglary was reported at 508 Franklin court. During the course of the burglaries each vehicle and the vessel was entered and various items were removed. ON 4-30-2012 a vehicle burglary (case 2012 00078787) was reported at 721 Moray Dr. The victim reported two Global Position Sensor and a Black Flash light stolen. On 05-04 2012 a vehicle Burglary (case 2012 00081439) Was reported at 222 S. Hunting Lodge Dr. where the victim reported that it occurred between 4-27-2012 and 05-01-2012. During the burglary the victim stated she had approximately $400.00 worth of items removed. On 4-23-2012 at approximately 0315 hrs. This Deputy who was off duty was driving west on E. Tangelo lane when I encountered a white female with dark hair dressed in dark clothing walking east on the roadway . I turned around and then I saw a second subject dressed in dark clothing carrying a dark colored backpack. I then turned around again in attempt to see who the subjects were but was unable to since they took flight. I did OBSERVE on the subjects that the female had dark hair AND THAT the male had dark hair and a scruffy lite beard. Later, on 4-23-2012 a VEHICLE BURGLARY was reported at 5430 E. Tangelo lane. Then during the course of approximately 8 days several more vehicle burglaries were reported in the Inverness area. On 4-20-2012 at approximately 0330 hours I observed the defendant walking in the southbound LANE ON U.S. 41 in the area of Andrew st. In the Inverness city limits. I turned around and the defendant crossed the street. I then pulled to where he was and he started to cross the street again. I exited my vehicle and identified myself and asked the defendant to step to the back of my vehicle. The defendant was wearing dark clothing and was carrying the same style dark backpack as the subject I had observed on the 23rd on Tangelo lAnE. I asked the defendant for his identification for which he stated he didn’t have one. name and I he answered nervously a name I couldn’t understand. I asked him to repeat it and I was having trouble understanding him. I asked what he had in the back pack and he stated his stuff. I asked for permission to look inside the back pack and he stated I could. Upon doing so I immediately observed a Global Position Sensor and a wallet. Later I located several more Global Positions sensors along with several phone chargers for miscellaneous electronic items. I asked if I could look in the wallet for which he stated I could Upon opening it I saw AN identification card. The defendant immediately stated it was fake. At that time I advised the subject that I was detaining him until I could PROVE his Identity. I placed the defendant in handcuffs. At this time Deputy Chris Holloway showed up on scene. I asked him to stand with the defendant as I went to retrieve my notebook. Deputy Chris Holloway started to run the subject listed on the Identification card on teletype when the subject all of sudden attempted to run away. The subject was stopped after he crossed the road and entered the brush line. The subject was returned to my vehicle. It was then learned that the subject had AN outstanding warrant for Violation of Probation. He was advised he was under arrest for the warrant. The defendant WAS THEN read his Miranda rights off AN agency Miranda Card. The defendant was asked about the Gps ‘s he had in his bag and he stated he bought them off a friend but didn’t want to say the friends name. I then had Deputy Chris Holloway transport the defendant to the county Jail where a Post Miranda Digitally recorded Interview was conducted. During the initial Interview the defendant kept stating he bought the gps units he had off a guy. I advised the defendant that I believed that he was the subject I observed walking on Tangelo on the April 23 2012. During the interview He kept saying he didn’t go into any cars. I then asked him if I could come back later and talk to him again. He stated he would talk to me. I then started to walk to the defendant back to the jail. I stated to the defendant “You know you are not really a real burglary. YOU’RE just AN opportunist. “ He asked me what I meant. I said you only went into cars that were unlocked. He replied “Damn Straight you didn’t see any pry marks on the cars I went into.” I later returned to the Jail where a second post Miranda Digital Recorded Interview was conducted. During the interview the defendant made statements that not only confessed to these burglaries but also IMPLICATED HIS Co-defendant Paula Flanagan. It should be noted that when the defendant was asked how many cars he entered he stated he didn’t know. He further advised the location of other stolen items which were later RECOVERED. It should be noted that several items recovered have yet to be reported and some of the ITEMS THE OWNERS WERE not aware there items were missing until contacted do to them not using them. I also located Several stolen items in two Inverness Pawn Shops. The defendant was held on a combined bond of $60,000 per schedule. It should also be noted that more charges are pending to include Grand Theft, Dealing in Stolen Property and False Information to a Pawn Broker and possible more Burglary to Conveyance charges.
