Probable cause affidavit: | SUBMITTED BY: CALLAHAN, CRAIG 0643 (AR08106345) DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). ON 112008 AT APPROXIMATELY 0026 HOURS, MYSELF AND DEPUTY BERGEN WERE TRAVELING NORTHBOUND ON US HIGHWAY 19 IN OUR MARKED PATROL VEHICLE. WHILE DRIVING PAST THE DEFENDANT, MR ROBERT HALL'S, VEHICLE WE BOTH OBSERVED THE DRIVER'S SIDE FRONT WINDSHIELD TO BE CRACKED IN DIRECT VIEW OF the DRIVER WHICH WOULD OBSTRUCT THE DRIVER'S VIEW. UPON OBSERVING THE WINDSHIELD I INITIATED MY OVERHEAD EMERGENCY EQUIPMENT AND CONDUCTED A TRAFFIC STOP ON THE DEFENDANT'S VEHICLE. UPON MAKING CONTACT WITH THE DEFENDANT I REQUESTED HIS DRIVER'S LICENSE, WHICH HE WAS ABLE TO PROVIDE. I OBSERVED A RIFLE LYING BETWEEN THE CENTER CONSOLE AND THE PASSENGER SEAT OF THE VEHICLE. THIS DEPUTY TOOK THE RIFLE INTO CUSTODY FOR OFFICER SAFETY. UPON RETURNING TO MY VEHICLE, THE DEFENDANT'S INFORMATION WAS RUN THROUGH FCIC/NCIC WHICH RETURNED NEGATIVE RESULTS FOR ANY WANTS OR WARRANTS. UPON MAKING CONTACT WITH THE DEFENDANT HE WAS ADVISED HE WAS RECEIVING A VERBAL WARNING FOR THE CRACKED WINDSHIELD. AT THAT TIME HIS DRIVER'S LICENSE WAS RETURNED TO HIM AND HE WAS ADVISED THE TRAFFIC STOP WAS NOW CONCLUDED. DUE TO THE FACT THAT A WEAPON WAS ALREADY FOUND IN THE VEHICLE THE DEFENDANT WAS ASKED IF THERE WAS ANY ADDITIONAL WEAPONS OR CONTRABAND INSIDE HIS VEHICLE, TO which HE STATED, NO. I ASKED THE DEFENDANT IF HE MINDED IF MYSELF AND DEPUTY BERGEN LOOKED INSIDE HIS VEHICLE, TO WHICH HE STATED WE COULD. AT THAT TIME THE DEFENDANT STEPPED OUTSIDE THE VEHICLE WITH THIS DEPUTY AS DEPUTY BERGEN CONDUCTED AN INTERIOR SEARCH OF THE VEHICLE. A SHORT TIME LATER DEPUTY BERGEN ADVISED ME HE HAD LOCATED A CLEAR PLASTIC BAGGIE CONTAINING A GREEN LEAFY SUBSTANCE, KNOWN TO HIM THROUGH HIS TRAINING AND EXPERIENCE AS MARIJUANA, IN THE CENTER CONSOLE OF THE VEHICLE, HIDDEN UNDERNEATH THE CUP HOLDERS. AT THAT TIME THE DEFENDANT WAS ARRESTED AND HANDCUFFED BEHIND HIS BACK, DOUBLE LOCKED AND PLACED IN THE PATROL VEHICLE.. AT THAT TIME I READ THE DEFENDANT MIRANDA FROM A PREPRINTED CARD. THE DEFENDANT WAIVED HIS RIGHTS AND ADVISED HE WISHED TO SPEAK WITH ME. THE DEFENDANT ADVISED ME THAT THE MARIJUANA FOUND IN THE VEHICLE WAS HIS AND WAS FOR HIS OWN PERSONAL USE. THE DEFENDANT ADVISED HE DOES NOT SMOKE MARIJUANA OFTEN, HOWEVER, JUST PURCHASED THE MARIJUANA TONIGHT. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL AT THE DETENTION FACILITY, DUE TO THE DEFENDANT'S COOPERATION, THE DEFENDANT WAS RELEASED ON HIS OWN RECOGNIZANCE. THE MARIJUANA WAS LATER WEIGHED AT APPROXIMATELY 5 GRAMS AND WAS TURNED OVER TO EVIDENCE. DEFENDANT'S VEHICLE WAS TURNED OVER TO HIS FATHER PER DEFENDANT'S REQUEST. *NOT-EXEMPT* |
