SUBMITTED BY: HUGHES, JAMES 0500 (AR11121729) DID UNLAWFULLY AND WILLFULLY ENTER OR REMAIN ON A PROPERTY AFTER WARNING, TO WIT: HOMOSASSA REGIONAL PLAZA, THE PROPERTY OF THE VICTIM, WITHOUT BEING AUTHORIZED, LICENSED, OR INVITED TO DO SO BY THE OWNER, LESSEE, OR THEIR AGENT, IN VIOLATION OF FLORIDA STATE STATUTE 810.09(2)(B). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: METAL PIPE WITH MARIJUANA RESIDUE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). ON 071411 AT APPROXIMATELY 1105 HOURS I WAS DISPATCHED TO 3792 S SUNCOAST BOULEVARD IN HOMOSASSA IN REFERENCE TO ASSISTING DEPUTY S SMITH WITH A SUBJECT WHO WAS CURRENTLY TRESPASSING ON THE PROPERTY. UPON ARRIVAL, I MADE CONTACT WITH DEPUTY S SMITH AND DEPUTY PAYNE WHO ADVISED THAT THEY HAD KNOWLEDGE THAT THE DEFENDANT, MR ROBERT SMITH, HAD BEEN TRESPASSED FROM THAT LOCATION ON 070611 AT APPROXIMATELY 1108 HOURS BY DEPUTY COX, SEE INCIDENT NUMBER I11138270. THE DEFENDANT'S INFORMATION WAS RUN THROUGH TELETYPE WHO VERIFIED THAT HE WAS IN FACT TRESPASSED FROM THAT LOCATION. AT THAT TIME DEPUTY S SMITH ASKED THE DEFENDANT IF HE KNEW HE HAD BEEN TRESPASSED FROM THAT LOCATION, TO WHICH HE ADVISED THAT HE DID. DEPUTY PAYNE HAD OBSERVED A BLACK BAG THAT THE DEFENDANT WAS CURRENTLY CARRYING WITH HIM. WHEN DEPUTY PAYNE ASKED IF IT WAS HIS BAG, THE DEFENDANT ADVISED THAT IT WAS. DEPUTY PAYNE ASKED PERMISSION TO LOOK IN THE BAG, TO WHICH THE DEFENDANT ADVISED TO GO AHEAD. UPON DEPUTY PAYNE LOOKING INSIDE THE BAG, HE HAD OBSERVED A METAL PIPE WITH MARIJUANA RESIDUE WHICH IS COMMONLY USED FOR INHALING MARIJUANA. ALSO LOCATED IN THE BAG WAS A COPENHAGEN SNUFF CONTAINER CONTAINING A SMALL PLASTIC BAGGIE WITH A SMALL AMOUNT OF MARIJUANA LOCATED INSIDE IT. THE DEFENDANT WAS ASKED IF THE PROPERTY INSIDE THE BAG WAS HIS, TO WHICH HE ADVISED THAT IT WAS. THE DEFENDANT WAS THEN ADVISED THAT HE WAS BEING PLACED UNDER ARREST FOR TRESPASS AFTER WARNING, POSSESSION OF CANNABIS LESS THAN 20 GRAMS AND POSSESSION OF PARAPHERNALIA, HANDCUFFED, BEHIND HIS BACK, (DOUBLE LOCKED), SECURED IN THE REAR OF MY PATROL VEHICLE. DEPUTY PAYNE COLLECTED THE EVIDENCE AND WILL BE TURNING IT INTO THE EVIDENCE DEPARTMENT. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING.
