SUBMITTED BY: DERA, MARK 0688 (AR13-8395) (CASE 13-168493) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: A BERRETTA AUTOMATIC 12 GUAGE SHOTGUN IN SOFT BROWN CASE, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: ACTUAL VALUE BEING $1,200.00, TAKEN FROM THE VICTIMâS RESIDENCE, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)C(1) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: A REMINGTON MODE 7600, 308 CALIBER RIFLE WITH SCOPE, OF THE VALUE OF ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: ACTUAL VALUE BEING $500.00, TAKEN FROM A 1992 TOYOTA TACOMA PICKUP TRUCK PARKED IN THE VICTIMâS DRIVEWAY, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)C(1) did unlawfully traffic in or endeavor to traffic in property that HE knew or should have known was stolen, to-wit: A BERRETTA AUTOMATIC SHOTGUN IN A SOFT BROWN CASE, WHICH HE WAS IN THE PROCESS OF SELLING AT THE TIME OF HIS ARREST WHICH WAS THE property of THE VICTIM, IN violation of Florida Statute 812.019(1); did unlawfully traffic in or endeavor to traffic in property that HE knew or should have known was stolen, to-wit: A REMINGTON MODEL 7600 308 CALIBER RIFLE WITH SCOPE WHICH HE SOLD TO MR CHANCEY FOR $250.00, THE property of THE VICTIM, IN violation of Florida Statute 812.019(1); On 09/20/2013, the CITRUS COUNTY SHERIFFâS OFFICE received a report of a residential burglary at 9370 North Calalia Drive, Crystal River (SEE case number 2013-00129183). Deputy Ward responded and was advised by the victim, Ms Amy Lupo that she left her residence at approxIMATELY 1230 hOURS, AND when she returned home at approxIMATELY 2133 hOUrs she discovered that someone broke into her residence. Ms Lupo stated that the garage door leading into the kitchen was open and the rear sliding glass door was broken. The victim then went into the bedroom and found that her dresser drawers were openED and items were thrown onto the floor. The victim checked the residence and advised Deputy Ward that many items were stolen including a Silver Stanley Cup Championship Ring with the victimâs name LUPO on THE SIDE. The victim advised that the value of this ring was $2,000.00. THE Victim furthered stated that she did not give anyone permission to remove the property. On 12/08/2013, the CITRUS COUNTY SHERIFFâS OFFICE received a report of a residential burglary and vehicle burglary at 9313 North Boxthorn Terrace, Crystal River (SEE CASE number 2013-00168493). Deputy Aguilera responded and made contact with the victim, Mr Clinton Parnell, who stated that between 12/05/2013 and 12/07/2013 someone entered his residence and his 1992 Toyota Tacoma pickup, and removed items. Mr Parnell further states that someone removed his car keys and a Remington .308 rifle with scope from his 1992 Toyota Tacoma pickup that was parked in the driveway, AS WELL AS a Beretta shotgun from inside his residence. Mr Parnell stated that he did not give anyone permission to remove these items. On 12/06/2013, the Defendant (Mr. ROBERT Tock) was arrested on unrelated charges (case number2013- 00167721). The defendant was found in possession of a silver Ring that fit the description of victim LUPOâS STOLEN ring, and also a Beretta Shotgun that fit the description of victim Parnellâs stolen shotgun. Both the ring and shotgun were positively identified by both victims. On 12/09/2013 myself and Detective Laughlin conducted an interview with the Defendant at the citrus county Detention Facility. The defendant was read his Miranda rights from an AGENCY pre-printed card. he stated that he understood and was willing to speak with us. The defendant admitted that he knew that the Silver Ring and Berretta shotgun were stolen, but denied any involvement in these burglaries. The defendant admitted that his only involvement was that he knew people and he was bringING these items down south to get rid of them. HE FURTHER STATED THAT HE WAS ON HIS WAY TO GET RID OF THE ITEMS AND THE STOLEN PICKUP TRUCK WHEN HE WAS ARRESTED. The defendant further stated that Chris Hollie stole the ring and that Zachery Linville and Wesley Foley stole the guns. I asked the Defendant in reference to the .308 Rifle, which he stated he did NOT have any knowledge about it. This interview was digitally recorded and downloaded onto the server. On 12/13/2013, Deputy Seffern arrested Wesley Foley on unrelated CHARGES, case number 2013-00170923. Mr. Foley was found in possession of a Remington .Model 7600, .308 caliber rifle with scope. This rifle was positively identified by victim Parnell. Mr. Foley advised that the rifle belonged to Mr. Jesse ChanCey. Contact was made with Mr. ChanCey who stated that he purchased the rifle from Robert Tock for $250.00. On 12/17/2013, I made contact with the Defendant at the citrus County detention Facility and asked him about the Remington .308 rifle that was stolen from victim Parnell. The defendant stated that he forgot about that rifle and now stated that he sold it to Mr. Jesse ChanCey for $250.00. He further stated that he knew it was stolen and that he got it from Zachery Linville in exchange for drugs. Defendant was advised he will be arrested for these ADDITIONAL charges and was returned to detention staff. Bond was set aT $14,000.00 FOR THE COMBINED ADDITIONAL CHARGES. CASE STATUS CLOSED BY ARREST. |
