Probable cause affidavit: | SUBMITTED BY: REESE, KELLIE 0640 (AR09107129) DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY KELLIE REESE, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: ESCORTING HIM OFF OF THE PROPERTY AT PARK MANAGEMENT'S REQUEST AND DURING SUCH TIME HE REFUSED TO PROVIDED THIS DEPUTY WITH HIS IDENTIFICATION OR HIS NAME WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. ON 011009, I WAS DISPATCHED TO ENCORE RV PARK LOCATED AT 11419 WEST FORT ISLAND TRAIL CRYSTAL RIVER, IN REFERENCE TO SEVERAL INTOXICATED SUBJECTS ARGUING WITH PARK MANAGEMENT. DEPUTY PINNER RESPONDED AS BACKUP. UPON OUR ARRIVAL, WE MADE CONTACT WITH PARK MANAGEMENT WHO ADVISED THAT SIX INTOXICATED MALE SUBJECTS STAYING AT LOTS 206 AND 168 WERE VIOLATING THE COUNTY BURN BAN WITH THEIR FIRE. PARK MANAGEMENT REPEATEDLY REQUESTED THEY COME IN COMPLIANCE WITH THEIR FIRE, HOWEVER, THEY REFUSED AND WERE ARGUMENTATIVE AND BELLIGERENT WITH PARK MANAGEMENT. PARK MANAGEMENT WAS NOW REQUESTING THE SUBJECTS BE REMOVED FROM THE PARK. DEPUTY PINNER AND I RESPONDED ALONG WITH PARK MANAGEMENT TO ADJOINING LOTS 206 AND 168 WHERE WE MADE CONTACT WITH SIX INTOXICATED MALE SUBJECTS. WE EXPLAINED TO THEM THEY NEEDED TO PACK UP THEIR CAMP SITE AND ARRANGE FOR A SOBER DRIVER TO COME AND PICK THEM UP. THE SUBJECTS THEN BECAME BELLIGERENT AND ARGUMENTATIVE WITH US. I WARNED THEM SEVERAL TIMES THAT IF THEY REFUSED TO COMPLY THEY WOULD BE ARRESTED. THE SUBJECTS THEN BEGAN TO PACK UP THEIR CAMP SITE. I ADVISED THEM I WOULD NEED THEIR IDENTIFICATION AS I INTENDED TO FILL OUT FIELD INTERVIEW REPORTS (FIR) ON THE SUBJECTS AND CHECK THEM FOR WANTS AND WARRANTS. I APPROACHED THE DEFENDANT AND ASKED HIM FOR HIS IDENTIFICATION. HE SAID "NO". I TOLD HIM IF HE DID NOT GIVE ME HIS IDENTIFICATION, HE WOULD BE ARRESTED AND AGAIN I ASKED HIM FOR HIS IDENTIFICATION. AT THAT TIME, HE STARTED POURING A DRINK ON THE FIRE AND SAID "I'M BUSY". I THEN SAID TO HIM, THEN WHAT IS YOUR NAME, TO WHICH THE DEFENDANT RESPONDED TO ME "MUD". AT THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST , HANDCUFFED (DOUBLE LOCKED), AND PLACED IN THE REAR OF MY PATROL VEHICLE. THE OTHER SUBJECTS PROVIDED THEIR IDENTIFICATION WITHOUT INCIDENT AND FIRS WERE COMPETED AND LATER TURNED IN TO RECORDS. THE SUBJECTS CALLED FOR A SOBER DRIVER TO COME AND PICK THEM UP AT THE MAIN ENTRANCE OF THE RV PARK. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS TURNED OVER FOR BOOKING WITH HIS BOND SET AT $150.00 PER THE BOND SCHEDULE. *NOT-EXEMPT* |
