Probable cause affidavit: SUBMITTED BY: FERGUSON, KYLE 1266 (AR15-17427)(15-155903) UNLAWFULLY ENDANGER THE SAFETY OF ANOTHER OR THEIR PROPERTY WHILE INTOXICATED OR DID WHILE INTOXICATED OR DRINKING AN ALCOHOLIC BEVERAGE IN A PUBLIC PLACE CAUSE A PUBLIC DISTURBANCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 856.011. ON 112915, AT APPROXIMATELY 0102 HOURS, I RESPONDED TO HIGH OCTANE SALOON, LOCATED AT 1590 SOUTH SUNCOAST BOULEVARD, IN REFERENCE TO A DISTURBANCE. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT, MR DOUGLAS DOTY, WHO WAS THE OWNER OF THE ESTABLISHMENT. THE COMPLAINANT ADVISED THAT HIS BOUNCERS HAD ASKED A GENTLEMAN TO LEAVE AND HE REFUSED TO DO SO, AT WHICH TIME THE DEFENDANT PUNCHED ONE OF THE BOUNCERS AND HE WAS SUBSEQUENTLY TAKEN TO THE GROUND. I THEN OBSERVED THE DEFENDANT, MR ROBERT WHALEN, TO BE LYING ON THE GROUND WITH THE BOUNCERS HOLDING HIM DOWN. OF THE BOUNCERS WANTED TO PURSUE CHARGES FOR THE BATTERY. I THEN ADVISED THE DEFENDANT TO STAND UP AND ASKED HIM WHAT HAPPENED, AT WHICH TIME THE DEFENDANT STATED HE WAS TOO INTOXICATED TO STAND UP SO HE SAT DOWN ON THE DIRT AND PROCEEDED TO FALL OVER. THE DEFENDANT ALSO STATED HE WAS ON PROBATION AND HE WAS NOT SUPPOSED TO BE IN A BAR, OR HAVE ANY ALCOHOL. THE DEFENDANT WAS ADVISED HE WAS BEING PLACED UNDER ARREST FOR DISORDERLY INTOXICATION, DUE TO THE FACT THAT HE SWUNG ON THE BOUNCERS AND CREATED A PUBLIC DISTURBANCE WHILE HE WAS INTOXICATED. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN THE REAR OF MY PATROL VEHICLE. THE COMPLAINANT ADVISED HE WOULD LIKE THE DEFENDANT TRESPASSED FROM THE ESTABLISHMENT. THE COMPLAINANT WAS PROVIDED WITH AN AGENCY CASE CARD BEARING MY NAME, IDENTIFICATION NUMBER, AND THIS CASE NUMBER. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS TURNED OVER TO THE DETENTION STAFF AND HIS BOND WAS SET AT $500.00, PER THE BOND SCHEDULE FOR THE DISORDERLY INTOXICATION. UPON RUNNING A CRIMINAL HISTORY INQUIRY OF THE DEFENDANT I WAS ADVISED THAT HE WAS CURRENTLY ON PROBATION AND THE CONDITIONS OF HIS PROBATION WERE NO BARS AND NO ALCOHOL. THE DEFENDANT'S PROBATION WAS THEN VIOLATED WHERE HE WAS HELD AT NO BOND, PER THE BOND SCHEDULE. THE DEFENDANT WAS TRESPASSED FROM THE ESTABLISHMENT AND WAS MADE AWARE OF THIS. NO FURTHER ACTION TAKEN BY THIS DEPUTY.
