SUBMITTED BY: ALEXANDER, DAWN 0561 (AR07100566) did, while HIS driver's license was canceled, suspended or revoked pursuant to Florida Statute 322.264 (habitual offender), drive a motor vehicle upon the highways of this state, in violation of Florida Statutes 322.34(5) and 322.264 AND DID UNLAWFULLY AND KNOWINGLY OPERATE A MOTORCYCLE WITHOUT HAVING A DRIVER'S LICENSE THAT AUTHORIZES SUCH OPERATION, SUBJECT TO THE APPROPRIATE RESTRICTIONS and ENDORSEMENTS AND DID UNLAWFULLY and KNOWINGLY ALTER THE ORIGINAL APPEARANCE OF ANY REGISTRATION LICENSE PLATE, MOBILE HOME STICKER, VALIDATION STICKER, OR VEHICLE REGISTRATION CERTIFICATE ISSUED FOR AND ASSIGNED TO ANY MOTOR VEHICLE OR MOBILE HOME, WHETHER BY MUTILATION, ALTERATION, DEFACEMENT, OR CHANGE OF COLOR OR IN ANY OTHER MANNER. ON 120107, WHILE TRAVELING SOUTHBOUND ON SOUTH PLEASANT GROVE ROAD, I OBSERVED A MOTORCYCLE TRAVELING AT A HIGH RATE OF SPEED. I VISUALLY ESTIMATED the MOTORCYCLE TO BE TRAVELING AT 70 MILES PER HOUR IN A POSTED 55 MILES PER HOUR ZONE. I THEN ACTIVATED MY RADAR, HEARD A CLEAR DOPPLER TONE and RECEIVED A DIGITAL READING OF 69 MILES PER HOUR. AS I BEGAN TO BRAKE TO TURN AROUND ON THE MOTORCYCLE THE DRIVER SPED UP TO PASS ANOTHER VEHICLE WHICH WAS ALSO TRAVELING NORTHBOUND. AT THAT TIME, I ACTIVATED MY OVERHEAD EMERGENCY LIGHTS AND CONDUCTED A TRAFFIC STOP ON THE MOTORCYCLE AT THE INTERSECTION OF SOUTH PLEASANT GROVE ROAD and EAST AMY LANE. THE DRIVER THEN GOT OFF OF THE MOTORCYCLE and TOOK HIS HELMET OFF. UPON MAKING CONTACT WITH THE DRIVER/DEFENDANT, MR ROBIN VALLE, I ASKED HIM FOR HIS DRIVER'S LICENSE AND REGISTRATION. THE DEFENDANT ADVISED THAT HE DID NOT HAVE A DRIVER'S LICENSE and THAT HE WAS A HABITUAL TRAFFIC OFFENDER. THE DEFENDANT ALSO ADVISED THAT HE RECENTLY GOT OUT OF PRISON IN SEPTEMBER FOR DRIVING ON A SUSPENDED LICENSE, DRIVING ON A SUSPENDED LICENSE FOR TWO DUI'S AND BEING A HABITUAL TRAFFIC OFFENDER. THE DEFENDANT FURTHER ADVISED THAT THE TAG ON the MOTORCYCLE WAS NOT VALID. HE STATED THAT HE HAD TAKEN A PERMANENT MARKER AND CHANGED THE TAG WHICH READ 2003 TO 2008. I THEN RETURNED TO MY PATROL VEHICLE AND VERIFIED THROUGH FCIC/NCIC AND DAVID (DRIVER AND VEHICLE IDENTIFICATION DATABASE) THAT THE DEFENDANT'S DRIVER'S LICENSE HAD BEEN REVOKED. the DEFENDANT'S DRIVER'S LICENSE HAS BEEN REVOKED FOR DUI, FLEEING OR ATTEMPTED TO ELUDE A POLICE OFFICER and HABITUAL TRAFFIC OFFENDER. THE DEFENDANT'S LICENSE HAS ALSO BEEN SUSPENDED AT LEAST SEVEN TIMES FOR FAILURE TO PAY TRAFFIC FINES OR FAILURE TO APPEAR IN COURT ON A SUMMONS. THERE WAS ALSO A NOTIFICATION WHICH ADVISED TO SEIZE THE MOTORCYCLE IF THE OWNER WAS THE DRIVER. IT WAS ALSO REVEALED THAT THE DEFENDANT DID NOT HAVE A REQUIRED MOTORCYCLE ENDORSEMENT ON HIS LICENSE. AT THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE-LOCKED ) BEHIND HIS BACK, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO the CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT'S MOTORCYCLE WAS REMOVED FROM THE SCENE BY ADVANCED TOWING. THE TOW TRUCK DRIVER WAS ADVISED THAT THERE WAS A HOLD ON THE VEHICLE DUE TO THE STATE WANTING THE MOTORCYCLE SEIZED. THE DEFENDANT'S TOTAL BOND WAS SET AT $10,650.00 PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION NUMBERS, 8877-FIQ, FOR KNOWINGLY DRIVING WHILE LICENSE REVOKED HABITUAL OFFENDER, 8878-FIQ, FOR NO MOTORCYCLE ENDORSEMENT AND 8879-FIQ, FOR UNLAWFUL ALTERATION OF TAG ALL WITH A MANDATORY COURT APPEARANCE OF 010408 AT 0900 HOURS. THE DEFENDANT WAS ALSO ISSUED WRITTEN WARNING NUMBERS, 208275B, FOR UNLAWFUL SPEED (69 MILES PER HOUR IN A 55 MILES PER HOUR ZONE) AND 208291B, FOR NO VALID REGISTRATION. *NOT-EXEMPT* |
