Probable cause affidavit: SUBMITTED BY: REID, JUSTIN 0706 (AR11119321) (0351) UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: PULLED OUT A CLUMP OF THE VICTIM'S HAIR, BIT THE TIP OF THE VICTIM 'S NOSE AND SCRATCHED THE VICTIM'S UPPER CHEST WHILE TRYING TO GRAB THE CHAIN SHE WAS WEARING, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 021111 AT APPROXIMATELY 2332 HOURS, I WAS DISPATCHED TO 10954 WEST TIDEWATER CIRCLE IN CRYSTAL RIVER IN REFERENCE TO A SIMPLE BATTERY THAT HAD ALREADY OCCURRED. UPON MY ARRIVAL, I MADE CONTACT WITH THE VICTIM, MS BRANDY BYRUM. SHE STATED SHE AND THE SUSPECT, MR RODGER STEWART, WERE HANGING OUT AT THE OAR HOUSE BAR IN CRYSTAL RIVER HAVING A FEW DRINKS WHEN SHE SAW HER EX-HUSBAND, MR STEVEN BAKER. SHE STATED AFTER SHE SAW HER EX-HUSBAND SHE AND THE SUSPECT LEFT THE BAR AND WENT BACK TO HER RESIDENCE OFF OF TIDEWATER CIRCLE. SHE SAID WHEN SHE AND THE SUSPECT GOT BACK TO HER RESIDENCE SHE TOLD THE SUSPECT SHE WANTED TO BE WITH HER EX-HUSBAND TONIGHT SO THE SUSPECT BECAME IRATE. SHE STATED HE STARTED THROWING THINGS INSIDE HER VEHICLE AND GOT OUT AND SLAMMED THE DOOR. SHE SAID HE THEN WALKED AROUND TO THE DRIVER'S SIDE OF THE VEHICLE WHERE SHE WAS SITTING AND STARTED BANGING ON THE WINDOW VERY HARD AND YELLING AT HER. SHE SAID SHE DID NOT WANT THE SUSPECT TO BREAK THE WINDOW SO SHE ROLLED IT DOWN. THE VICTIM SAID AFTER SHE ROLLED THE WINDOW DOWN THE SUSPECT IMMEDIATELY GRABBED HER BY THE HAIR AND RIPPED A HANDFUL OF HAIR OUT OF HER HEAD. SHE SAID HE THEN BIT HER ON THE NOSE LEAVING TEETH MARKS ON THE TIP OF HER NOSE CAUSING IT TO BLEED. SHE SAID HE THEN GRABBED THE SILVER IN COLOR CHAIN FROM AROUND HER NECK AND RIPPED IT OFF LEAVING A BIG BRUISE ON HER UPPER CHEST AND NECK AREA. THE VICTIM SAID SHE DID SWING AND HIT HIM BACK JUST TO TRY TO GET HIM AWAY FROM HER. SHE SAID SHE TOLD THE SUSPECT SHE WAS CALLING THE POLICE AND HE TOLD HER "TO GO AHEAD THEY CAN'T DO ANYTHING TO ME ANYWAYS." SHE SAID HE THEN GOT INTO HIS BLACK OLDER MODEL FORD BRONCO WITH AN UNKNOWN FLORIDA TAG AND DROVE AWAY. THE VICTIM SAID AFTER THE SUSPECT LEFT, SHE CALLED HER EX TO COME OVER TO HER RESIDENCE BECAUSE SHE WAS AFRAID TO BE HOME ALONE TONIGHT. DEPUTY MELHADO (0618) MADE CONTACT WITH THE VICTIM'S EX-HUSBAND, MR STEVEN BAKER, AND ADVISED ME THAT HE SAID HE SAW THE VICTIM AND THE SUSPECT KISSING AT THE OAR HOUSE BAR SO HE WALKED OVER AND ASKED THE VICTIM IF HE COULD HAVE A KISS TOO AND THAT THE VICTIM SAID YES. HE SAID IT WAS AT THAT POINT THAT THE VICTIM AND THE SUSPECT LEFT THE BAR AND HE STAYED BEHIND AT THE BAR. I MADE CONTACT WITH THE DEFENDANT, MR RODGER STEWART, VIA TELEPHONE. HE SAID HE DID GET INTO AN ALTERCATION WITH THE VICTIM AND THAT HE DID NOT WANT TO COME BACK TO THE SCENE TO GIVE A STATEMENT. HE SAID HE WAS ON HIS WAY BACK HOME TO HERNANDO AND IF I WANTED TO TALK TO HIM, I KNEW WHERE HE LIVED AND THEN HUNG UP. I MADE CONTACT WITH A NEIGHBOR OF THE VICTIM WHO WANTED TO REMAIN ANONYMOUS. SHE SAID SHE WAS IN HER RESIDENCE AND HEARD A LOUD BANGING NOISE COMING FROM OUTSIDE AND A MALE VOICE YELLING "STAY THE FUCK OUT OF MY LIFE," THEN SHE HEARD A VEHICLE DRIVING OFF AT A HIGH RATE OF SPEED. THE VICTIM'S HAIR WHICH WAS PULLED OUT OF HER HEAD. THERE WAS ALSO A BROKEN PIECE OF THE SILVER IN COLOR CHAIN THE VICTIM WAS WEARING WHICH WAS COLLECTED AND TURNED IN TO EVIDENCE ALONG WITH THE CLUMP OF HAIR. ON 021211 AT APPROXIMATELY 1746 HOURS, I MADE CONTACT WITH THE DEFENDANT AT HIS RESIDENCE IN HERNANDO. THE DEFENDANT STATED HE HAD LEANED INTO THE DRIVER SIDE OF THE VICTIM'S VEHICLE TO GIVE THE VICTIM A KISS GOODBYE. HE SAID THE VICTIM DID NOT WANT TO KISS HIM AND STARTED TO PUNCH AND CLAW AT HIS FACE. HE SAID HE BECAME VERY ANGRY, WALKED AWAY, PUNCHED THE REAR WINDOW OF THE VICTIM'S VEHICLE, THEN GOT INTO HIS VEHICLE AND DROVE AWAY. HE SAID HE NEVER ONCE HIT OR TOUCHED THE VICTIM IN ANY WAY TO HURT HER. THE DEFENDANT'S STATEMENT DID NOT MATCH THE VICTIM'S STATEMENT OR HER INJURIES. THE DEFENDANT DID HAVE A SCRATCH ON HIS FOREHEAD AND NOSE AREA WHICH WERE CONSISTENT WITH THE VICTIM'S STATEMENT. THE DEFENDANT COMPLETED A WRITTEN STATEMENT WHICH WAS LATER TURNED IN TO RECORDS. HE WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. UPON ARRIVAL, THE DEFENDANT WAS BOOKED, PROCESSED AND HELD ON A $500.00 BOND, IN ACCORDANCE WITH THE BOND SCHEDULE.
