| Probable cause affidavit: | SUBMITTED BY: FLORIDA HIGHWAY PATROL VAUGHN, CURTIS (AR16-18707) On the 18th of March 2016, the defendant did operate a motor vehicle on the roadways of this state in violation of Florida Statute 322.34 (2)(c), 3rd or subsequent driving while license suspended/canceled or revoked with knowledge. On 18 March 2016 at approximately 03:58 PM, I arrived on scene of a motor vehicle collision on south bound CR 491 in the outside right turn/through lane at the intersection with SR 44. The collision had occurred at the entrance to the Shell gas station at that location. On scene, I made contact with a Citrus County Sheriff's Office Public Service officer who provided me with the license, registration and insurance for the vehicles and parties involved. I made contact with the occupants of the victim vehicle and identified both by their Florida drivers licenses. The driver of the victim vehicle was able to identify the defendant as the driver of the at fault vehicle at the time of the incident. The vehicle that the defendant had been operating was a 2002 Buick passenger car, beige/tan in color bearing Florida License plate X313NY and registered to the passenger of the vehicle, a Sue Gottschalk Shappell of New Port Richey Florida. The information provided to me for the defendant was a Florida ID card only identifying the defendant as Russell Lewis Shappell also of New Port Richey Florida. Upon a further check of the defendants license/ ID information it was discovered and verified by TBRCC that the defendants drivers license was in a revoked status with at least 4 prior DWLSR convictions, 2 of which were within the previous 6 year period. One on 27 May 2010 and the most recent on 19 March 2015. On completion of the crash investigation at approximately 04:57 PM, I informed the defendant that I had completed my crash investigation and was placing him under arrest for the above offense. I then handcuffed the defendant behind his back double locked and placed him in the right side rear passenger seat of my patrol vehicle for transport to the Citrus County detention facility. On arrival at the detention facility and at approximately 05:07 PM, I read the defendant his Miranda Warnings from my pre printed agency Miranda card to which the defendant stated that he understood but would not speak with me.
