Probable cause affidavit: |
SUBMITTED BY: BERGEN, JOHN 0519 (AR14-12885) ROBBERY WITH FIREARM OR OTHER DANGEROUS WEAPON, IN VIOLATION OF FLORIDA STATE STATUTE, 812.13(2)(A). ON 111714 I WAS CALLED OUT TO THE CHEVRON GAS STATION LOCATED AT 4450 SOUTH SUNCOAST BOULEVARD IN HOMOSASSA, IN REFERENCE TO AN ARMED ROBBERY. I SPOKE WITH THE CLERK/VICTIM, MR JAYESH PATEL, WHO EXPLAINED THAT HE PRINTED HIS LOTTERY TOTALS OUT AT 2102 HOURS. HE STATED APPROXIMATELY ONE MINUTE LATER, HE OBSERVED A SHORT, SLENDER MALE ENTER HIS STORE. THE MALE WAS DRESSED IN A HAT, BANDANA AND A BLACK SHIRT WITH PICTURES ON THE FRONT AND WRITING ON THE BACK. THE SUSPECT WAS HOLDING A MEDIUM SIZED HANDGUN AND WEARING RED GLOVES. THE SUSPECT THEN WALKED TO THE COUNTER, POINTED THE GUN AT THE VICTIM AND TOLD HIM, ''GIVE ME ALL THE MONEY: THE VICTIM THEN OPENED THE CASH DRAWER AND GAVE THE SUSPECT THE MONEY. THE SUSPECT THEN ORDERED THE CLERK/VICTIM TO PICK UP THE CASH DRAWER SO HE COULD SEE UNDERNEATH. THE SUSPECT ALSO TOLD THE VICTIM TO OPEN A SECOND DRAWER LOCATED UNDER THE COUNTER. THE SUSPECT THEN GRABBED THE MONEY AND EXITED THE STORE ON FOOT. THE VICTIM STATED THAT HE DID NOT RECOGNIZE THE SUSPECT. THE VICTIM ADVISED THAT APPROXIMATELY $300.00 TO $400.00 WAS STOLEN. I THEN VIEWED THE VIDEO FROM THE STORE, ALONG WITH FORENSIC MEDIA SPECIALIST ALLEN, WHO HAD ALREADY BEEN CALLED TO THE SCENE. THE SUSPECT WAS DRESSED AS DESCRIBED BY THE VICTIM. I OBSERVED THE SUSPECT'S SHIRT TO BE VERY UNUSUAL, WHERE IT WAS ALL BLACK WITH A WHITE SILHOUETTE OF A MALE ON THE FRONT. DEPUTIES HAD RESPONDED AND A CANINE TRACK WAS CONDUCTED WITH NEGATIVE RESULTS. I CANVASSED THE AREA WHICH YIELDED NEGATIVE RESULTS IN ANY LEADS. I THEN RESPONDED TO THE WAL-MART IN HOMOSASSA, IN HOPES OF SEEING THE SUSPECT ON THEIR SURVEILLANCE CAMERAS. FORENSIC MEDIA SPECIALIST ALLEN CAME WITH ME TO ASSIST IN THE RECOVERY OF ANY FOOTAGE. AT APPROXIMATELY 2024 HOURS, THE SUSPECT ENTERED THE WAL-MART WEARING THE SAME CLOTHES HE WORE IN THE ROBBERY, TO INCLUDE THE VERY IDENTIFIABLE TEE- SHIRT. THE SUSPECT WALKED AROUND THE STORE UNTIL APPROXIMATELY 2053 HOURS, AT WHICH TIME HE LEFT OUT OF THE SAME DOOR HE CAME IN. THE SUSPECT WAS FOLLOWED ON CAMERA TO AN EARLY NINETIES MODEL WHITE PICKUP UP TRUCK WITH PAINT MISSING ON THE REAR FENDER AND THE BED RAILS. HE DROVE OUT OF THE PARKING LOT AND TURNED NORTHBOUND ONTO US HIGHWAY 19. THE PICTURES OF THE SUSPECT AND THE VEHICLE WERE PUT OUT TO THE PUBLIC FOR HELP IN IDENTIFYING HIM. ON 112014, A TIP CAME IN NAMING THE DEFENDANT, MR RUSTY BOASE, AS THE SUBJECT IN THE VIDEOS AND THE STILLS. I REQUESTED ASSISTANCE FROM THE TACTICAL IMPACT UNIT WHO CONDUCTED SURVEILLANCE AND CONFIRMED THE VEHICLE DID, IN FACT, APPEAR TO BE THE SAME ONE AS THE VEHICLE IN THE VIDEO. ON 112114, I LEARNED THAT DETECTIVE HUGHES HAD ARRESTED THE DEFENDANT IN THE PAST. DETECTIVE HUGHES AND I THEN RESPONDED TO THE DEFENDANT'S RESIDENCE FOR THE PURPOSE OF CONDUCTING AN INTERVIEW. UPON ARRIVAL AT THE RESIDENCE, I OBSERVED THE WHITE TRUCK IN THE DRIVEWAY TO BE THE SAME AS THE TRUCK THAT WAS VIEWED IN THE VIDEO SURVEILLANCE FOOTAGE. CONTACT WAS THEN MADE WITH THE DEFENDANT, WHO AFTER BEING READ HIS MIRANDA RIGHTS, AGREED TO SPEAK WITH US. I ASKED SEVERAL TIMES ABOUT WHERE HE WAS ON MONDAY NIGHT, AT WHICH TIME THE DEFENDANT DENIED BEING NEAR THE SCENE OF THE CRIME. I EXPLAINED TO THE DEFENDANT THAT I WOULD LIKE TO HEAR HIS SIDE OF THE STORY AND HAD EVIDENCE OF HIM DOING IT. THE DEFENDANT THEN SIGHED, DROPPED HIS HEAD, AND STATED, "IT WASNâT A REAL GUN". THE DEFENDANT THEN WENT ON TO CONFIRM THE CRIME AS FOLLOWS: ON MONDAY NIGHT, THE DEFENDANT DROVE TO THE WALMART STORE TO MAKE CONTACT WITH A FRIEND WHO OWED HIM MONEY. HE TOOK A TOY GUN HE HAD PURCHASED OVER THE WEEKEND TO SCARE HIS FRIEND BUT DECIDED AGAINST IT. HE THEN LEFT AND DROVE THE FIRST GAS STATION HE SAW, WHICH WAS THE CHEVRON. HE STATED THAT HE WAS WEARING A BANDANNA HE USES FOR WORK, AND PUT IT OVER HIS FACE WHEN HE ENTERED THE STORE. HE STATED HE POINTED THE GUN AT THE CLERK/VICTIM AND DEMANDED THE MONEY. THE DEFENDANT STATED HE GOT APPROXIMATELY $200.00. THE DEFENDANT THEN LEFT THE SCENE IN HIS TRUCK, DROVE TO A LOCATION TO PURCHASE SOME OXYCODONE PILLS AND RETURNED TO HIS RESIDENCE. THE DEFENDANT STATED THE FOLLOWING DAY HE THREW ALL THE CLOTHES HE WORE DURING THE ROBBERY OUT AT THE MCDONALDS LOCATED AT GULF TO LAKE AND CROFT. THE DEFENDANT EXPLAINED THAT HE HAS A BAD PILL PROBLEM, AND THAT IS WHY HE DID IT. HE STATED THAT HE NEEDS HELP FOR HIS ADDICTION AND CAN NO LONGER CONTROL IT. THE DEFENDANT DID ALLOW CONSENT TO SEARCH HIS TRUCK AND HIS RESIDENCE, WHICH MET WITH NEGATIVE RESULTS FOR ANY EVIDENCE. THE DEFENDANT WAS HANDCUFFED AND TRANSPORTED IN THE REAR SEAT OF DEPUTY HUGHES PATROL VEHICLE TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF ROBBERY WITH A FIREARM, WHERE HIS BOND WAS SET AT $50,000.00 PER THE BOND SCHEDULE. |
