Probable cause affidavit: | SUBMITTED BY: RUSSO, CAROLYN N236 (AR13-5760) did drive or was in the actual physical control of a veSSEL while under the influence of alcoholic beverages, model glue or any substance controlled under Chapter 893 or Chapter 877.111 to the extent HIS normal faculties were impaired, in violation of Florida Statute 327.35(1)(C) ON 052513, INVESTIGATOR SHERMAN JAMES AND I, OFFICER CAROLYN RUSSO, OF THE FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION WERE ON WATER PATROL IN KINGS BAY (CRYSTAL RIVER) FLORIDA. AT APPROXIMATELY 1700 HOURS, WE OBSERVED A VESSEL WITH SIX PEOPLE ON BOARD HEADING TOWARDS PETEâS PIER COMING FROM THE SHALLOWS AREA. WE CONDUCTED A VESSEL INSPECTION ON THE VESSEL NEAR THE THREE SISTERS CANAL AND OBSERVED A WHITE MALE OPERATING THE VESSEL. THE OPERATOR WAS LATER IDENTIFIED AS MR RYAN STEPHEN CONLEY WITH A DATE OF BIRTH OF 080487. HE WAS WEARING BLUE SWIM SHORTS AND NO SHIRT. AS I WAS PULLING ALONGSIDE THE VESSEL MR CONLEY WOULD NOT MAKE EYE CONTACT WITH US AND HE KEPT STARING STRAIGHT AHEAD WHILE THE OTHER OCCUPANTS OF THE VESSEL WERE LOOKING AT US. AS WE PULLED ALONGSIDE THE VESSEL WE ADVISED MR CONLEY AND THE OCCUPANTS THAT WE WOULD BE CONDUCTING A VESSEL INSPECTION. ONCE WE WERE ALONGSIDE THE VESSEL I ASKED MR CONLEY TO SHOW ME THE REQUIRED VESSEL EQUIPMENT NEEDED FOR THE VESSEL HE WAS OPERATING. I ASKED HIM FOR LIFE JACKETS FOR EACH PERSON ON THE VESSEL AND THE VESSEL REGISTRATION. AS HE WENT TO RETRIEVE THE LIFE JACKETS FROM THE BOW OF THE VESSEL HE HELD ON TO THE SIDE AND THE MIDDLE OF THE VESSEL TO HELP STEADY HIMSELF. HE PULLED OUT THE REQUIRED AMOUNT OF LIFEJACKETS WHILE AVOIDING EYE CONTACT STILL. HE CAME BACK TO THE MIDDLE OF THE VESSEL AND I REMINDED HIM TO SHOW ME THE REGISTRATION. HE RETRIEVED THE REGISTRATION AND THEN I ASKED HIM TO SHOW ME THE THROWABLE DEVICE AND A FIRE EXTINGUISHER FOR THE VESSEL. THE OCCUPANTS OF THE VESSEL ADVISED THERE WAS NO THROWABLE DEVICE FOR THE BOAT. I COULD SEE THE WHISTLE ON THE CONSOLE OF THE BOAT. AFTER THE SAFETY INSPECTION WAS COMPLETE I ASKED MR CONLEY IF HE HAD BEEN DRINKING THAT DAY AND HE ADVISED ME THAT HE HAD âA FEW BEERS EARLIER.â I ASKED HIM TO TAKE OFF HIS SUNGLASSES AND I OBSERVED HIS EYES TO BE BLOODSHOT AND GLASSY. AS I WAS STANDING NEXT TO HIM I COULD SMELL A STRONG ODOR OF AN ALCOHOLIC BEVERAGE COMING FROM HIS PERSON. I ADVISED HIM THAT HE APPEARED TO BE IMPAIRED AND ASKED HIM IF HE WOULD CONSENT TO THE FIELD SOBRIETY TASKS. HE CONSENTED AND I HAD HIM COME ON MY PATROL VESSEL IN ORDER TO ADMINISTER THE TASKS. I TOLD MR CONLEY TO SIT AT THE BOW OF THE VESSEL ON THE PORT SIDE TO KEEP THE SUN OUT OF HIS EYES. I READ THE GENERAL INSTRUCTIONS TO HIM FROM THE SEATED BATTERY OF STANDARDIZED FIELD SOBRIETY TASKS. AS I READ THE INSTRUCTIONS TO MR CONLEY HE STOOD UP. I ADVISED HIM TO SIT BACK DOWN AND HE DID. I READ MR CONLEY THE PRE- TASK QUESTIONS AND HE STATED âNOâ TO EACH ONE EXCEPT THE FOURTH QUESTION. I ASKED âARE YOU UNDER THE CARE OF A DOCTOR OR DENTISTâ AND HE STATED HE HAD A DOCTOR AND HE HAD BEEN DIAGNOSED WITH CANCER. THE TASKS BEGAN. TASK ONE, HORIZONTAL GAZE NYSTAGMUS: HE STATED HE WAS NOT WEARING CONTACT LENSES. I READ THE INSTRUCTION AND HE STATED HE UNDERSTOOD. LACK OF SMOOTH PURSUIT, DISTINCT AND SUSTAINED NYSTAGMUS AT MAX DEVIATION, ONSET OF NYSTAGMUS PRIOR TO 45- DEGREES, AND VERTICAL NYSTAGMUS WERE ALL PRESENT IN BOTH OF MR CONLEYâS EYES. TASK TWO, FINGER TO NOSE: THE TASK INSTRUCTIONS WERE READ AND DEMONSTRATED. HE STATED HE UNDERSTOOD. HE OPENED HIS EYES DURING THE BEGINNING OF THE TASK WHEN I SAID THE FIRST LEFT. HE HESITATED THREE TIMES, SEARCHED ONCE, AND MISSED THE TIP OF HIS NOSE SIX TIMES. TASK THREE, PALM PAT: THE TASK INSTRUCTIONS WERE READ AND DEMONSTRATED. HE STATED HE UNDERSTOOD. DURING THE TASK HE DID NOT INCREASE HIS SPEED. TASK FOUR, HAND COORDINATION: THE TASK INSTRUCTIONS WERE READ AND DEMONSTRATED. HE STATED HE UNDERSTOOD. ON THE THIRD TASK/ RETURN STEPS HE DID NOT COUNT PROPERLY. HE STATED 4, 3, 2, 1 INSTEAD OF 5, 6, 7, 8. AFTER THE TASKS WERE PREFORMED I ADVISED MR. CONLEY THAT HE WAS UNDER ARREST FOR BOATING UNDER THE INFLUENCE. THE VESSEL WAS LEFT WITH ITS OWNER AND THE PREGNANT FEMALE ON BOARD WAS CLEARED TO OPERATE THE VESSEL. WE DROVE TO PETEâS PIER AND CITRUS COUNTY SHERIFFâS OFFICE WAS CONTACTED TO TRANSPORT. A CITRUS COUNTY OFFICER MET US AT PETEâS PIER AND TRANSPORTED MR CONLEY TO THE CITRUS COUNTY DETENTION FACILITY. WHILE HE WAS AT THE CITRUS COUNTY DETENTION FACILITY, THE BREATH TEST OPERATOR, ASHLEY A DADDARIO, READ THE IMPLIED CONSENT WARNING AND HE CONSENTED TO THE TEST. THE TEST RESULTS CAME BACK WITH A BLOOD ALCOHOL CONTENT OF 0.179G/210L AND 0.175G/210L. MR CONLEY WAS ISSUED ONE WARNING FOR NOT HAVING THE THROWABLE DEVICE ABOARD AND ONE MISDEMEANOR CITATION FOR BOATING UNDER THE INFLUENCE. HIS COURT DATE WAS SET FOR 070113 AT 0830 HOURS AT THE CITRUS COUNTY COURTHOUSE. HIS BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. |
