SUBMITTED BY: SCHAFFER, HEATH 0652 (AR16-20346) DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A GLASS SMOKING PIPE WITH RESIDUE IN IT; A USED SYRINGE; TWO BAGGIES WITH RESIDUE IN THEM; A RAZORBLADE; Q-TIPS; A CUT DRINKING STRAW WITH RESIDUE; WHICH FIELD TESTED POSITIVE FOR METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 072216 AT 1315 HOURS, WHILE DRIVING THROUGH THE PARKING LOT OF THE INVERNESS WALMART, LOCATED AT 2461 EAST GULF TO LAKE HIGHWAY, I OBSERVED A BLACK DODGE PICKUP AT THE STOP SIGN AT THE SOUTHWEST CORNER OF THE PARKING LOT. I THEN SAW A WHITE MALE DRIVER, WHO I WAS FAMILIAR WITH, AND WAS THAT OF MR PETER SALOZZO. I KNEW MR SALOZZO TO NOT HAVE A VALID DRIVER'S LICENSE, AT WHICH TIME, I TURNED IN BEHIND THE VEHICLE. THE VEHICLE THEN TURNED IN TO THE MURPHY USA GAS STATION, AT WHICH TIME, I CONDUCTED A TRAFFIC STOP ON THAT VEHICLE. WHILE WALKING UP TO THE VEHICLE, I STATED "MR SALOZZO, WHAT ARE YOU DOING DRIVING?" HE THEN STATED, "I DON'T KNOW, I WAS JUST GIVING MY FRIEND A RIDE TO WALMART" (REFERRING TO THE DEFENDANT, MS SAMANTHA LONG). THE DEFENDANT WAS SEATED IN THE REAR PASSENGER SIDE SEAT OF THE EXTENDED CAB. I THEN ASKED MR SALOZZO TO STEP OUT OF THE VEHICLE TO SPEAK WITH ME, WHICH HE DID. HE THEN APOLOGIZED FOR DRIVING WHEN HE KNEW HE WAS NOT SUPPOSED TO, DUE TO HIS LICENSE BEING SUSPENDED. I THEN ASKED MR SALOZZO IF WE COULD SEARCH HIS VEHICLE. HE THEN GAVE CONSENT, AT WHICH TIME, DEPUTY SEFFERN JR (0623) BEGAN SEARCHING THE VEHICLE. DEPUTY SEFFERN, SOON AFTER, ADVISED ME THAT HE HAD LOCATED AN ORANGE PURSE IN THE BACK SEAT WHERE THE DEFENDANT WAS SITTING. INSIDE OF THIS PURSE HE LOCATED A BLACK ZIPPER POUCH AND ENCLOSED IN THAT POUCH WERE SEVERAL ITEMS OF DRUG PARAPHERNALIA, INCLUDING: A GLASS SMOKING PIPE WITH RESIDUE IN IT; A USED SYRINGE; TWO BAGGIES WITH RESIDUE IN THEM; A RAZORBLADE; Q-TIPS; A CUT DRINKING STRAW WITH RESIDUE; AND A CLEAR CONTAINER CONTAINING WHAT APPEARED TO BE SPICE, INCENSE, OR SYNTHETIC MARIJUANA. THESE ITEMS WERE COLLECTED AND THE ITEMS WITH RESIDUE WERE LATER FIELD TESTED AND WERE POSITIVE FOR METHAMPHETAMINE. THE DEFENDANT WAS SECURED IN HANDCUFFS (DOUBLE LOCKED) BEHIND HER BACK AND PLACED IN THE REAR OF MY PATROL VEHICLE. THE REMAINDER OF THE VEHICLE WAS SEARCHED AND NO OTHER CONTRABAND WAS LOCATED. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY AND WHILE EN ROUTE, SHE WAS READ HER MIRANDA RIGHTS VIA A PREPRINTED CARD. SHE ADVISED SHE UNDERSTOOD HER RIGHTS AND DID WISH TO SPEAK WITH ME ABOUT THIS INCIDENT. SHE THEN VERIFIED AND ADMITTED THAT THE ORANGE PURSE WAS HERS ALONG WITH THE PARAPHERNALIA THAT WAS FOUND. SHE ADVISED THAT SHE WANTED TO SEEK HELP FOR HER DRUG PROBLEM AND WANTED TO GO TO REHAB. ONCE AT THE DETENTION FACILITY, THE DEFENDANT'S BOND WAS SET AT $1,000.00 PER THE BOND SCHEDULE. THE ITEMS THAT WERE COLLECTED WERE LATER TURNED IN TO THE EVIDENCE DIVISION. |
