SUBMITTED BY: CALLAHAN, CRAIG 0643 (AR13-7578) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: ALPRAZOLAM ONE MILLIGRAM, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 100813 AT APPROXIMATELY 1716 HOURS, I WAS TRAVELLING EASTBOUND ON EAST GOBBLER DRIVE APPROACHING SLEEPY HOLLOW BAR. UPON DOING SO, I OBSERVED A RED SUBARU PICKUP TRUCK, WHICH WAS TRAVELLING WESTBOUND ON EAST GOBBLER DRIVE. UPON OBSERVING THE VEHICLE, I NOTICED THAT THE DRIVER LATER IDENTIFIED AS THE DEFENDANT, MS SAMANTHA SUE TAYLOR, ALONG WITH HER FRONT SEAT PASSENGER MR LOUIS PISEGNA, WERE CLEARLY NOT WEARING THEIR SAFETY BELTS. AT THAT TIME, I TURNED MY PATROL VEHICLE AROUND ACTIVATED MY EMERGENCY EQUIPMENT AND CONDUCTED A TRAFFIC STOP IN AREA OF EAST GOBBLER DRIVE AND SOUTH BASS TERRACE. UPON MAKING CONTACT WITH THE DEFENDANT I ADVISED HER OF THE REASON FOR BEING STOPPED, AT which TIME, SHE ADMITTED to the VIOLATION. THE DEFENDANT WAS ALSO ASKED FOR HER DRIVER'S LICENSE AND REGISTRATION, BOTH OF WHICH SHE WAS ABLE TO PROVIDE. WHILE SPEAKING TO THE DEFENDANT IT WAS OBVIOUS SHE WAS EXTREMELY NERVOUS AND FAILED TO MAKE DIRECT EYE CONTACT WITH ME. UPON RETURNING TO MY PATROL VEHICLE THE DEFENDANTâS DRIVER'S LICENSE WAS RUN THROUGH FCIC/NCIC, WHERE IT WAS DETERMINED THAT HER DRIVER'S LICENSE HAD BEEN SUSPENDED FOR FAILING TO PAY HER INSURANCE. WHILE SITTING IN MY PATROL VEHICLE, I COULD CLEARLY SEE THE DEFENDANT MOVING AROUND IN THE VEHICLE, WHERE IT APPEARED THAT SHE WAS REACHING BEHIND THE PASSENGER SIDE FRONT SEAT. UPON OBSERVING THIS, I AGAIN MADE CONTACT WITH THE DEFENDANT WHERE I RETURNED HER DRIVER'S LICENSE AND REGISTRATION AND ADVISED HER I WOULD BE ISSUING HER A WARNING FOR THE INFRACTION. PRIOR TO LEAVING THE SCENE, I ASKED THE DEFENDANT AND HER PASSENGER IF THEY MINDED IF I SEARCHED THE INTERIOR OF THE VEHICLE, TO WHICH THEY BOTH ADVISED THAT I COULD. UPON SEARCHING THE VEHICLE, I LOCATED A SMALL BLACK WOMANâS WALLET BEHIND THE PASSENGER SEAT. UPON OPENING THE WALLET I OBSERVED AN UNMARKED ORANGE PRESCRIPTION BOTTLE, WHICH CONTAINED TWO separate SMALL ZIPLOC BAGGIES, WHICH BOTH CONTAINED NUMEROUS UNIDENTIFIED PILLS. ONE BAGGIE CONTAINED TWO AND A HALF GREEN OVAL PILLS AND TWO BLUE CIRCULAR PILLS, THE OTHER BAGGIE CONTAINED ONE CIRCULAR BLUE PILL, WITH A TOTAL OF FIVE AND A HALF PILLS. THE WALLET ALSO CONTAINED SEVERAL EMPTY PLASTIC BAGGIES, WHICH WERE THE SAME TYPE AS THE ONES THAT CONTAINED THE PILLS. THERE WAS ALSO A PURPLE PLASTIC CUT STRAW AND A SMALL METAL SPOON, BOTH OF WHICH ARE CONSISTENT OF THAT OF DRUG PARAPHERNALIA, WHICH IS COMMONLY USED TO INGEST ILLEGAL NARCOTICS. UPON MAKING CONTACT WITH THE DEFENDANT, I READ HER MIRANDA WARNING VIA PREPRINTED AGENCY CARD, WHICH SHE ADVISED THAT SHE UNDERSTOOD AND WOULD SPEAK with ME. UPON SPEAKING TO HER IN REFERENCE to the PILLS I LOCATED, SHE ADMITTED THAT THEY BELONGED SOLELY TO HER AND WERE XANAX, WHICH SHE HAD JUST PURCHASED FOR $2.50 EACH. THE PILLS WERE LATER DETERMINED TO BE ALPRAZOLAM ONE MILLIGRAM WHICH IS THE GENERIC FOR XANAX. I THEN AGAIN MADE CONTACT WITH THE DEFENDANT WHERE I ASKED HER IF SHE HAD A VALID PRESCRIPTION FOR THE NARCOTICS TO INCLUDE ALPRAZOLAM OR XANAX TO WHICH SHE ADVISED SHE DID NOT AND THAT SHE HAD NEVER HAD ONE. AT THAT TIME, I ADVISED THE DEFENDANT SHE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF CONTROLLED SUBSTANCE. SHE WAS THEN HANDCUFFED IN THE REAR (DOUBLE LOCKED) AND TRANSPORTED TO CITRUS COUNTY DETENTION FACILITY. PRIOR TO LEAVING SCENE CONTACT WAS MADE WITH THE PASSENGER MR LOUIS PISEGNA, UPON SPEAKING TO HIM HE ADVISED ME THAT HE HAD NO KNOWLEDGE OF THE PRESCRIPTION PILLS, NOR DID THEY BELONG TO HIM. UPON ARRIVAL AT THE CITRUS COUNTY DETENTION FACILITY THE DEFENDANT'S BOND WAS SET AT $5,000.00, PER THE BOND SCHEDULE. ALL NARCOTICS WERE LATER PACKAGED AND TURNED OVER TO CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE. |
