Probable cause affidavit: | SUBMITTED BY: SUNDBERG, KURT 1268\t(16-127721) NTA AR16-21009\t1383 ON 091616, AT APPROXIMATELY 2105 HOURS, I OBSERVED A 2004 RED IN COLOR 4 DOOR SATURN VEHICLE BEARING FLORIDA TAG NUMBER GYCT95 DRIVING WESTBOUND ON WEST OST-WEST STREET COME TO THE INTERSECTION OF WEST OST-WEST AND SOUTH LEWDINGAR DRIVE. I THEN OBSERVED THE VEHICLE MAKE A RIGHT-HAND TURN ON SOUTH LEWDINGAR DRIVE FAIL TO COME TO A COMPLETE STOP BEFORE ENTERING THE ROADWAY. AT THAT TIME, I THEN CONDUCTED A TRAFFIC STOP ON SAID VEHICLE IN THE AREA OF WEST HANS COURT AND SOUTH BOB WHITE DRIVE IN HOMOSASSA. I THEN MADE CONTACT WITH THE DRIVER OF THE VEHICLE, MR MICHAEL MORTON. MR MORTON WAS ADVISED OF THE REASON FOR THE STOP. I THEN ASKED MR MORTON FOR HIS DRIVERâS LICENSE, TO WHICH HE PROVIDED ME. ALSO INSIDE THE VEHICLE WAS A FRONT SEAT PASSENGER, MS VONDA LEIGHTY, AND SEATED IN THE LEFT, REAR SEAT OF THE VEHICLE WAS A WHITE FEMALE LATER IDENTIFIED AS THE DEFENDANT, MS SARAH ALLEN. I ASKED ALL OCCUPANTS IF THERE WAS ANYTHING ILLEGAL INSIDE THE VEHICLE, TO WHICH THEY ALL STATED NO. I THEN ASKED MR MORTON FOR CONSENT TO SEARCH THE VEHICLE, TO WHICH MR MORTON ADVISED ME THAT I COULD AND NO ONE INSIDE THE VEHICLE OBJECTED TO ME SEARCHING. AT THAT TIME, DEPUTY INDORATO ARRIVED ON SCENE AND ALL OCCUPANTS WERE ASKED TO STEP OUT OF THE VEHICLE, TO WHICH THEY COMPLIED. DEPUTY INDORATO THEN CONDUCTED A HAND SEARCH OF THE INTERIOR OF THE VEHICLE. A SHORT TIME LATER HE ADVISED HE HAD LOCATED A HYPODERMIC NEEDLE INSIDE OF THE DEFENDANTâS BAG. THE DEFENDANT WAS THEN READ MIRANDA RIGHTS VIA PREPRINTED AGENCY ISSUED CARD. THE DEFENDANT ADVISED SHE UNDERSTOOD HER RIGHTS AND AGREED TO SPEAK WITH ME. I QUESTIONED THE DEFENDANT. IN REFERENCE TO THE HYPODERMIC NEEDLE. THE DEFENDANT ADVISED THAT IT WAS HER NEEDLE AND THAT SHE HAD USED IT TO SHOOT UP METHAMPHETAMINE EARLIER TODAY. THE HYPODERMIC NEEDLE WAS THEN TESTED USING A FIELD PRESUMPTIVE TEST KIT, WHICH YIELDED POSITIVE TEST FOR METHAMPHETAMINE CONTACT WAS THEN MADE WITH THE DEFENDANT. SHE WAS ADVISED SHE WAS BEING PLACED UNDER ARREST AND GIVEN A NOTICE TO APPEAR CITATION. SHE WAS ISSUED CITATION NUMBER 21230 WITH A MANDATORY COURT DATE OF OCTOBER 06, 2016 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE. THE DRIVER OF THE VEHICLE, MR MORTON, WAS ISSUED WRITTEN WARNING NUMBER 406296B, FOR THE TRAFFIC INFRACTION. THE HYPODERMIC NEEDLE WAS COLLECTED BY DEPUTY INDORATO AND LATER TURNED IN TO EVIDENCE. SEE HIS SUPPLEMENT FOR FURTHER DETAILS. NO FURTHER ACTION WAS TAKEN BY THIS DEPUTY. |
