SUBMITTED BY: LAUGHLIN, JEREMY 0617 (AR10117975) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: METHADONE (ONE TABLET), DIAZEPAM (4 TABLETS), IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A SMALL PLASTIC PIPE AND A PIECE OF BURNT TIN FOIL WITH PILL RESIDUE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 111810 AT APPROXIMATELY 0930 HOURS, I WAS CONDUCTING TRAFFIC ENFORCEMENT IN A KNOWN DRUG AREA, AT WHICH TIME I OBSERVED A RED CHEVROLET PICKUP TRUCK BEARING FLORIDA TAG 858NIV, WHICH THIS DEPUTY WAS FAMILIAR WITH. UPON RUNNING THE VEHICLE'S TAG IT REVEALED THAT THE REGISTRATION WAS EXPIRED, AND A TRAFFIC STOP WAS CONDUCTED IN THE AREA OF SUBURBAN AND RURAL. UPON MAKING CONTACT WITH THE DRIVER HIS LICENSE, REGISTRATION AND INSURANCE WAS REQUESTED, WHICH HE PROVIDED. IN SPEAKING WITH THE DRIVER HE WAS ASKED IF THERE WAS ANY ILLEGAL DRUGS OR WEAPONS IN HIS VEHICLE, TO WHICH HE ADVISED THERE WAS NOT. IN SPEAKING WITH THE DRIVER, HE WAS QUESTIONED IN REGARDS TO THE REASON FOR BEING IN THE AREA, TO WHICH HE ADVISED HE WAS GOING TO DROP OFF THE DEFENDANT WHO IS IDENTIFIED AS MS SARAH LEE JUSTIN, AT A FRIEND'S RESIDENCE. AFTER COMPLETING THE WARNING FOR THE DRIVER, I AGAIN MADE CONTACT WITH THE DRIVER AND THE PASSENGER, MS SARA JUSTIN. I ASKED IF THEY HAD ANY ILLEGAL ITEMS IN THE VEHICLE OR ON THEIR PERSON. AT THAT TIME BOTH PARTIES ADVISED THEY DID NOT. THE DRIVER ADVISED THAT THIS DEPUTY COULD SEARCH HIS VEHICLE DUE TO THE FACT HE HAD NO ILLEGAL ITEMS. I THEN ASKED THE PASSENGER, MS SARAH JUSTIN, IF SHE COULD REMOVE HER PURSE WHICH WAS LOCATED BETWEEN HER FEET. MS JUSTIN ADVISED THIS DEPUTY COULD LOOK THROUGH HER PURSE. UPON LOOKING THROUGH THE PURSE, MS JUSTIN PLACED A PURPLE IN COLOR LADIES WALLET ON THE FLOORBOARD, WHICH HAD PREVIOUSLY BEEN INSIDE OF HER PURSE. AS I CONTINUED TO SPEAK WITH MS JUSTIN, SHE EMPTIED THE CONTENTS FROM HER PURSE, AT WHICH TIME I SAW A BLUE METAL PILL CONTAINER AND, UPON OPENING THE PILL CONTAINER, I OBSERVED A WHITE RECTANGULAR PILL WITH THE IMPRESSION OF AN "M" AND, THROUGH MY TRAINING AND EXPERIENCE, RECOGNIZED THE PILL TO BE METHADONE; A CONTROLLED SUBSTANCE (IDENTIFIED BY POISON CONTROL OPERATOR DEBBIE AS A SCHEDULE 2 NARCOTIC). MS JUSTIN ADVISED SHE DID NOT HAVE A PRESCRIPTION FOR METHADONE, HOWEVER; UPON LOOKING THROUGH THE REMAINDER OF HER PURSE, IT REVEALED NO OTHER CONTRABAND. THIS DEPUTY THEN PICKED UP THE PURPLE LADY'S WALLET WHICH HAD PREVIOUSLY BEEN IN MS JUSTIN'S PURSE, AND UPON DOING SO THE WALLET WAS PARTIALLY OPEN AND REVEALED A SMALL PIECE OF TIN FOIL AND A SMALL WHITE PIPE COMMONLY USED TO SMOKE NARCOTICS. THIS DEPUTY THEN ASKED MS JUSTIN IF THE WALLET WAS HERS, DUE TO THE FACT THAT HER FLORIDA FISHING LICENSE AND MULTIPLE OTHER IDENTIFICATION WERE INSIDE THE WALLET. MS JUSTIN DID NOT ANSWER AND THIS DEPUTY DISCOVERED FOUR ROUND PILLS WHICH WERE IDENTIFIED BY POISON CONTROL AS DIAZEPAM 10 MG (SCHEDULE 4 CONTROLLED SUBSTANCE). AT THAT TIME THE DEFENDANT, MS SARAH JUSTIN, WAS PLACED UNDER ARREST AND PLACED IN THE REAR SEAT OF MY PATROL VEHICLE. THE NARCOTICS WERE COLLECTED AND WILL BE TURNED OVER TO EVIDENCE. THE DRIVER WAS ISSUED WARNING NUMBER 299798-B AND WARNING 299799B AND RELEASED AT THE SCENE. MS JUSTIN WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING AND HER BOND WAS SET AT $1,500.00 PER THE BOND SCHEDULE.
