SUBMITTED BY: AGUILERA, EMANUEL 1238 (AR15-14674) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 0.17 GRAMS OF CRYSTAL METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 042115, AT APPROXIMATELY 1750 HOURS, I WAS TRAVELING NORTHBOUND ON NORTH SUNCOAST BOULEVARD IN THE AREA OF WEST VENABLE STREET, IN CRYSTAL RIVER, WHEN I OBSERVED A SILVER HONDA FOUR DOOR VEHICLE TRAVELING NORTHBOUND DIRECTLY IN FRONT OF MY PATROL VEHICLE. I OBSERVED THE PASSENGER OF THE VEHICLE THROUGH THE WINDOWS, WHICH WERE NOT TINTED, TO NOT BE WEARING HIS SEAT BELT. AT THAT TIME, I ACTIVATED MY OVERHEAD EMERGENCY EQUIPMENT AND CONDUCTED A TRAFFIC STOP ON THE SILVER HONDA VEHICLE, BEARING FLORIDA LICENSE PLATE CKEJ66, IN THE AREA OF 971 NORTH SUNCOAST BOULEVARD. UPON MAKING CONTACT WITH THE DRIVER, LATER IDENTIFIED AS MS SARAH POTTS, I ADVISED HER OF THE REASON FOR MY STOP AND REQUESTED HER DRIVER'S LICENSE, VEHICLE REGISTRATION, AND PROOF OF INSURANCE. THE PASSENGER, IDENTIFIED AS MR JEFFREY ACKROYD, WHO WAS NOT WEARING HIS SEAT BELT, THEN APOLOGIZED FOR NOT WEARING HIS SEAT BELT AND ADVISED THAT THEY HAD JUST LEFT THEIR RESIDENCE. WHILE SPEAKING WITH MS POTTS, I OBSERVED HER TO BE NERVOUS AND FIDGETY. I ASKED HER IF THERE WAS ANYTHING ILLEGAL IN THE VEHICLE, TO WHICH SHE ADVISED THEY DID NOT HAVE ANYTHING ILLEGAL AND SHE CONSENTED TO A SEARCH OF THE VEHICLE. WHILE SPEAKING WITH MR ACKROYD, HE ADVISED ME THAT THERE WAS A DIGITAL SCALE IN THE PASSENGER SIDE DOOR THAT HE HAD BOUGHT FROM A FRIEND, WHICH HE USED TO WEIGH HIS MARIJUANA. I THEN REQUESTED BACKUP DEPUTY NORTON AND K-9 DEPUTY HRYC TO RESPOND TO MY LOCATION. I ASKED MS POTTS AND MR ACKROYD TO STEP OUT OF THE VEHICLE AND TO STAND IN FRONT OF MY PATROL VEHICLE. I SECURED THE DIGITAL SCALE FROM THE PASSENGER SIDE DOOR AND PLACED IT ON THE HOOD OF MY PATROL VEHICLE. K-9 DEPUTY HRYC AND DEPUTY NORTON THEN CONDUCTED A HAND SEARCH OF THE VEHICLE, WHICH MET WITH NEGATIVE RESULTS. I SPOKE WITH MS POTTS AT THE HOOD OF HER VEHICLE, WHILE DEPUTY NORTON STOOD BY WITH MR ACKROYD. DURING MY INTERVIEW WITH MS POTTS, SHE ADVISED ME THAT SHE HAD A BAGGIE OF CRYSTAL METHAMPHETAMINE IN THE TOP OF HER BRA AND SHE WAS SORRY AND DID NOT WANT TO GET IN TROUBLE. I REQUESTED THAT SHE RETRIEVE THE METHAMPHETAMINE WITHOUT EXPOSING HERSELF. AT THAT TIME, MS POTTS REACHED IN FROM THE TOP OF HER SHIRT AND RETRIEVED THE PLASTIC BAGGIE WITHOUT EXPOSING HERSELF AND THEN HANDED IT TO ME. THE PLASTIC BAGGIE CONTAINED A CRYSTAL SUBSTANCE, WHICH THROUGH MY TRAINING AND EXPERIENCE I BELIEVED TO BE CRYSTAL METHAMPHETAMINE. I THEN READ MS POTTS HER MIRANDA RIGHTS, VIA AN AGENCY ISSUED PREPRINTED CARD, TO WHICH SHE ADVISED SHE WISHED TO SPEAK TO ME. I ASKED MS POTTS HOW MUCH SHE PAID FOR THE CRYSTAL METHAMPHETAMINE AND SHE ADVISED THAT SHE DID NOT PAY ANYTHING FOR IT, BUT SOMEONE HAD LEFT IT AT HER RESIDENCE. I ASKED MS POTTS HOW LONG SHE HAD BEEN DOING METHAMPHETAMINE, TO WHICH SHE ADVISED SHE HAD ONLY TRIED IT A COUPLE TIMES. DEPUTY HRYC FIELD TESTED THE CRYSTAL METHAMPHETAMINE WHICH YIELDED A POSITIVE TEST FOR METHAMPHETAMINE. K-9 DEPUTY HRYC THEN WEIGHED THE METHAMPHETAMINE, WHICH WEIGHED 0.17 GRAMS. THE METHAMPHETAMINE WAS TURNED IN TO EVIDENCE BY K-9 DEPUTY HRYC. AT THAT TIME, MS POTTS WAS ADVISED SHE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF A CONTROLLED SUBSTANCE. THE DEFENDANT WAS SEARCHED, PLACED IN THE REAR OF MY PATROL VEHICLE, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANTâS BOND WAS SET AT $2,000.00, PER THE BOND SCHEDULE. THE DEFENDANTâS VEHICLE WAS LEFT ON SCENE PER HER REQUEST. |
