SUBMITTED BY: BEETOW, CHARLES 0295 (AR13-5137) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: BY GRABBING THE VICTIMâS SHIRT AND STRIKING HIM IN THE FACE, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 040913 AT APPROXIMATELY 1200 HOURS, I WAS DISPATCHED TO MAIN STREET CITGO, LOCATED AT 415 WEST MAIN STREET, INVERNESS, IN REFERENCE TO A PHYSICAL ALTERCATION. UPON MY ARRIVAL, I MADE CONTACT WITH THE BUSINESS OWNER/VICTIM, MR SAMIR MESHIL. THE VICTIM ADVISED THAT A WHITE MALE CAME IN THE STORE AND WAS COMPLAINING ABOUT THE AIR PUMP NOT WORKING CORRECTLY. THE VICTIM EXPLAINED TO THE SUSPECT, LATER IDENTIFIED AS MR SCOTT MCKENZIE THAT THE AIR PUMP MACHINE DID NOT BELONG TO HIM AND IF HE WANTED A REFUND HE NEEDED TO CONTACT THE VENDOR. THE VICTIM FURTHER ADVISED THAT THE SUSPECT BECAME IRATE AND DEMANDED HIS $1.50 BACK. WHEN THE SUSPECT WAS REFUSED THE MONEY, HE REACHED OVER THE COUNTER, GRABBED THE VICTIM BY HIS SHIRT, STRUCK THE VICTIM IN THE FACE AND STARTED PULLING HIM OVER THE COUNTER. AT THIS TIME, THE VICTIM STARTED TO DEFEND HIMSELF BY PUNCHING AT THE SUSPECT TRYING TO GET THE SUSPECT TO RELEASE HIS GRASP. THE VICTIMâS SON MR SIMON MESHIL, WHO WAS A WITNESS RAN UP AND PULLED THE SUSPECT FROM THE VICTIM. THE SUSPECT BEGAN PUSHING AT SIMON ATTEMPTING TO FIGHT WITH HIM. AT THAT TIME, THE VICTIM CAME AROUND THE COUNTER AND WAS ABLE TO PUSH AND KICK THE SUSPECT AWAY FROM HIS SON, WHO THE SUSPECT WAS GOING AFTER. WHEN THE ALTERCATION WAS BROKEN UP, THIS AGENCY WAS NOTIFIED. CONTACT WAS MADE WITH NUMEROUS WITNESSES WHO ALL STATED EXACTLY THE SAME STATEMENT AS THAT OF THE VICTIM. CONTACT WAS THEN MADE WITH THE SUSPECT, WHO WAS STILL INSIDE OF THE STORE. HE ADVISED THAT THE AIR MACHINE WAS NOT WORKING, BECAUSE IT WAS NOT BLOWING ENOUGH AIR IN THE TIRES. WHEN HE CAME IN TO GET HIS MONEY BACK, HE ADVISED THAT WORDS WERE EXCHANGED BETWEEN HIM AND THE VICTIM. AT ONE POINT, EITHER HIS VOICE OR THE VICTIMâS VOICE ESCALATED. THE SUSPECT ADVISED THAT HE DID REACH OVER AND GRAB THE VICTIM, HOWEVER HE DID NOT REALIZE THAT HE HAD STARTED TO PULL THE VICTIM OVER THE COUNTER. THE SUSPECT DID REMEMBER THAT ANOTHER SUBJECT THAT WAS IN THE STORE HAD GRABBED HIM TO ATTEMPT TO BREAK UP THE FIGHT. THE SUSPECT WAS APOLOGETIC AND STATED THAT HE DID OVERREACT. THE SUSPECT WAS THEN PLACED UNDER ARREST FOR BATTERY. THE DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. THE VICTIM REFUSED ANY MEDICAL TREATMENT. I DID OBSERVE A SWOLLEN AREA ON HIS RIGHT CHEEK AND REDNESS ON THE RIGHT EYEBALL AND LOWER EYELID. PHOTOGRAPHS WERE TAKEN OF THE VICTIMâS INJURIES, SEE CRIME SCENE TECHNICIAN REPORT. A SWORN WRITTEN STATEMENT WAS COMPLETED BY THE VICTIM AND LATER TURNED OVER TO CITRUS COUNTY SHERIFF'S OFFICE RECORDS. |
