SUBMITTED BY: GREATREX, ROBERT 0287 (14-14091) (AR14-9039) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN STRUCTURE OR CURTILAGE THEREOF, TO-WIT: THE VICTIMâS RESIDENCE, LOCATED AT 131 WEST LIBERTY STREET, IN HERNANDO, IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIM, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: GRAND THEFT, IN VIOLATION OF FLORIDA STATUTE 810.02(3)(B). DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: JEWELRY AND CASH OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(C)(1). DID UNLAWFULLY TRAFFIC IN OR ENDEAVOR TO TRAFFIC IN PROPERTY THAT THE DEFENDANT KNEW OR SHOULD HAVE KNOWN WAS STOLEN, TO-WIT: JEWELRY AND CASH, THE PROPERTY OF THE VICTIM, IN VIOLATION OF FLORIDA STATUTE 812.019(1). ON THE DATES OF 012914 THROUGH 021014 SEVERAL BURGLARIES WHERE REPORT TO THE CITRUS COUNTY SHERIFFâS OFFICE BY SEVERAL VICTIMS THAT LIVE IN THE CITRUS HILLS SUB-DIVISION. ON 012914, DEPUTY ELDRIDGE RESPOND TO 131 WEST LIBERTY STREET, IN HERNANDO, IN REFERENCE TO A BURGLARY THAT OCCURRED BETWEEN 1100 AND 1430 HOURS. THE COMPLAINANT, MS LESA WENNER, SAID THAT AFTER RETURNING HOME FROM A DOCTORâS APPOINTMENT WITH THE VICTIM, SHE LEARNED THAT THE VICTIMâS HOME WAS ENTERED THROUGH THE REAR DOOR. THE VICTIM, MS DOROTHY SMITH, REPORTED THAT SHE IS MISSING A LARGE AMOUNT OF JEWELRY ALONG WITH $5,000.00 IN CASH THAT WAS TO BE USED FOR A FAMILY MEMBERâS SURGERY. UPON DEPUTY ELDRIDGE COMPLETING HIS REPORT, THIS DETECTIVE BEGAN TO INVESTIGATE THIS CASE ALONG WITH SEVERAL OTHERS IN THE CITRUS HILLS AREA. IT WAS DISCOVERED THAT SUSPECT, MR SEAN FUGERE, HAD PAWNED A LARGE AMOUNT OF JEWELRY THROUGHOUT SEVERAL PAWN SHOPS IN CITRUS COUNTY. THIS DETECTIVE THEN MADE CONTACT WITH THE COMPLAINANT AND RESPONDED TO GEORGE OLMSTEADâS COIN AND JEWELRY IN INVERNESS WHERE THE COMPLAINANT DID IDENTIFY SEVERAL PIECES OF THE VICTIMâS JEWELRY. AFTER VICTIM SMITHâS JEWELRY WAS IDENTIFIED, PROBABLE CAUSE WAS ESTABLISHED FOR SUSPECT FUGEREâS ARREST. SEVERAL SHERIFF OFFICE EMPLOYEES WERE AT THAT TIME CONDUCTING SURVEILLANCE ON SUSPECT FUGERE. A TRAFFIC STOP WAS LATER CONDUCTED ON THE SUSPECTâS VEHICLE BY SERGEANT VINCENT AND HE WAS PLACED UNDER ARREST. THE MIRANDA WARNING WAS READ TO THE DEFENDANT AND HIS PASSENGER WHO WAS ALSO A SUSPECT, MR JOSHUA BRISCOE. AT THAT TIME DEFENDANT FUGERE ADMITTED TO THE BURGLARY TO THE VICTIMâS RESIDENCE AND WAS ADVISED THAT HE WOULD BE CHARGED WITH ONE COUNT OF BURGLARY WITH A BOND OF $5,000.00, ONE COUNT OF GRAND THEFT WITH A BOND OF $2,000.00 AND ONE COUNT OF DEALING IN STOLEN PROPERTY WITH A BOND OF $5,000.00. SUSPECT FUGERE ADMITTED TO THE BURGLARY OF VICTIM SMITHâS RESIDENCE AND PAWNING HER JEWELRY TO SUPPORT HIS DRUG PROBLEM. IT SHOULD BE NOTED THAT THE VICTIM HAS BEEN IN THE HOSPITAL SINCE THE BURGLARY TO HER RESIDENCE. |
