SUBMITTED BY: MORAN, GREG 1246 (15-2780) (AR15-13412 DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WALMART, TO WIT: MISCELLANEOUS MERCHANDISE, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(3)(A). ON 010715, I WAS DISPATCHED TO WALMART LOCATED AT 6885 SOUTH SUNCOAST BOULEVARD, IN HOMOSASSA, IN REFERENCE TO A SHOPLIFTER IN CUSTODY. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT/ASSET PROTECTION MANAGER, MS ARELYS LEON, WHO STATED THAT SHE HAD A WHITE MALE BY THE NAME OF MR SETH GURIAN, WHO WAS LATER IDENTIFIED AS THE DEFENDANT, DETAINED IN THE LOSS PREVENTION OFFICE. THE COMPLAINANT STATED THAT SHE OBSERVED THE DEFENDANT SELECT MISCELLANEOUS ITEMS AND THEN PROCEED TO AN EMPTY CHECKOUT REGISTER THAT WAS CLOSED. THE DEFENDANT PLACED THE MERCHANDISE IN THE GROCERY BAGS AND WALKED TOWARDS THE EXIT DOORS. THE DEFENDANT PASSED ALL POINTS OF SALE WITH NO ATTEMPTS TO PAY FOR THE MERCHANDISE. THE COMPLAINANT ALSO ADVISED THAT SHE HAD A WITNESS TO THE INCIDENT. THE COMPLAINANT CONTACTED THE CITRUS COUNTY SHERIFF'S OFFICE. THE COMPLAINANT SHOWED ME THE SURVEILLANCE VIDEO WHICH SHE ADVISED COULD BE COPIED LATER AND CONTACT WOULD BE MADE TO COLLECT IT. CONTACT WAS MADE WITH THE WITNESS WHO STATED THAT HE OBSERVED A WHITE MALE ENTER A CLOSED REGISTER LANE, PLACE SEVERAL ITEMS INTO A FEW WALMART GROCERY BAGS AND WALK TOWARDS THE FRONT OF THE STORE PASSING ALL POINTS OF SALE. THE WITNESS STATED HE NOTIFIED THE ASSET PROTECTION UNITS WHO ADVISED THAT HE HAD OBSERVED THE INCIDENT AND ADVISED THEY HAD CALLED LAW ENFORCEMENT. CONTACT WAS MADE WITH THE DEFENDANT, WHO WAS SECURED IN HANDCUFFS, BEHIND HIS BACK, (DOUBLE LOCKED). I READ THE DEFENDANT HIS MIRANDA WARNING VIA AGENCY PREPRINTED CARD. THE DEFENDANT ADVISED THAT HE UNDERSTOOD HIS RIGHTS AND STATED THAT HE WOULD SPEAK WITH ME AT THIS TIME. THE DEFENDANT STATED THAT HE CAME TO WALMART TO GET A FEW ITEMS ON HIS WAY TO HIS FRIENDâS HOUSE AND KNOWS THAT HE âFUCKEDâ UP AND SHOULD HAVE NOT DONE THAT. THE DEFENDANT WAS PLACED UNDER ARREST, SEARCHED, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANTâS BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. I PROVIDED THE COMPLAINANT WITH AN AGENCY ISSUED CASE CARD BEARING THIS CASE NUMBER AND MY IDENTIFICATION AND ADVISED THE COMPLAINANT TO CONTACT THIS AGENCY WITH ANY ADDITIONAL INFORMATION OR QUESTIONS REGARDING THIS CASE. |
