DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: STRUCK BOTH VICTIMS WITH A CLOSED FIST ON AND ABOUT THEIR FACE, and PULLING VICTIM TWO BY HER HAIR, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). UNLAWFULLY ENDANGER THE SAFETY OF ANOTHER OR THEIR PROPERTY WHILE INTOXICATED OR DID WHILE INTOXICATED OR DRINKING AN ALCOHOLIC BEVERAGE IN A PUBLIC PLACE CAUSE A PUBLIC DISTURBANCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 856.011. ON 042809 AT APPROXIMATELY 1730 HOURS, I WAS DISPATCHED TO 3 FOXGLOVE COURT, IN HOMOSASSA, IN REFERENCE TO A DISTURBANCE IN PROGRESS. DISPATCH ADVISED THAT DEPUTY DAVIS WAS ALREADY ON SCENE AND THAT THERE WERE SEVERAL DOGS INVOLVED IN THE ALTERCATION. UPON MY ARRIVAL ON CACTUS STREET, I MET with VICTIM ONE AND VICTIM TWO. THE VICTIMS ADVISED THAT THEY HAD BEEN WALKING THEIR HUSKY DOG DOWN FOXGLOVE COURT, APPROXIMATELY ONE AND A HALF HOURS PRIOR TO MY ARRIVAL, AND THE DEFENDANT CAME OUT OFF OF HER BACK PORCH AND BEGAN YELLING AT THEM AND ATTACKED THEM. I OBSERVED VICTIM ONE TO HAVE DRY BLOOD ON the BRIDGE OF HER NOSE. SHE ALSO APPEARED TO BE DISTRAUGHT, SHAKEN, AND UNSETTLED. VICTIM TWO ADVISED THAT WHILE WALKING THE DOG, the DEFENDANT CHARGED AT THEM AND GRABBED VICTIM TWO BY the HAIR and PUNCHED HER SEVERAL TIMES, AND ALSO PUNCHED VICTIM ONE ON THE FACE SEVERAL TIMES. AT THAT TIME, I HEARD A WOMAN YELLING ON FOX COURT WHERE DEPUTY DAVIS WAS, SO I RESPONDED TO HIS LOCATION. UPON MY ARRIVAL, I MET WITH THE DEFENDANT, MS SHARON PETERSON, WHO WAS OBVIOUSLY INTOXICATED. SHE WAS SCREAMING, CRYING, AND I WAS UNABLE TO UNDERSTAND WHAT SHE WAS SAYING AS SHE WAS NOT MAKING SENSE. THE DEFENDANT DID ADVISE THAT SHE HAD BEEN IN AN ALTERCATION with TWO WOMEN, AND DURING WHICH ALTERCATION SHE WAS SCRATCHED ON HER CHEST BY THEIR DOG. I OBSERVED THE STRONG ODOR OF ALCOHOL TO BE EMANATING FROM the DEFENDANT'S BREATH and PERSON. I OBSERVED THE DEFENDANT TO have SEVERAL SCRATCHES ON HER CHEST. EMERGENCY MEDICAL SERVICES (EMS) HAD BEEN DISPATCHED TO the SCENE AS WELL, HOWEVER ADVISED THAT THEY ONLY HAD ONE TRUCK THAT WOULD BE ABLE TO MAKE IT OUT. DEPUTY DAVIS THEN RESPONDED TO CACTUS STREET AND I ATTEMPTED TO OBTAIN A WRITTEN STATEMENT FROM THE DEFENDANT. THE DEFENDANT ADVISED THAT SHE HAD BEEN ON HER BACK PORCH WITH HER DOG, AND THAT SHE LEFT HER BACK PORCH WHEN SHE SAW VICTIM ONE AND VICTIM TWO WALKING IN the STREET WITH THEIR DOG. THE DEFENDANT ADVISED that SHE CAME OUT INTO THE STREET and AN ALTERCATION OCCURRED. THOUGH, SHE DID NOT ADVISE WHY SHE APPROACHED THE VICTIMS OR WHO STARTED THE ALTERCATION. the DEFENDANT'S HUSBAND THEN ARRIVED ON SCENE. IT should BE NOTED, THAT AS SOON AS THE DEFENDANT'S HUSBAND ARRIVED, THE DEFENDANT BEGAN SCREAMING, YELLING AT ME, AND CRYING. HER HUSBAND JUMPED OUT OF THE TRUCK AND BEGAN SCREAMING AT ME AND STATED that HE WAS GOING TO GO SHOOT THE DOG. HE THEN BEGAN ASKING WHY EMS HAD RESPONDED TO THE OTHER RESIDENCE FIRST. I EXPLAINED TO HIM THAT THEY ONLY HAD ONE TRUCK that WOULD BE ABLE TO MAKE IT OUT, AND that THEY HAD PASSED THEIR RESIDENCE FIRST. THE DEFENDANT'S HUSBAND GOT VERY AGITATED WITH ME AND BEGAN YELLING AT ME, AND STATED THAT HE WAS TAKING her TO THE HOSPITAL. HE THEN FORCIBLY GRABBED THE DEFENDANT and PUT HER IN the TRUCK. UPON THIS DEPUTY STANDING NEXT TO THE TRUCK AND SPEAKING TO the DEFENDANT'S HUSBAND, THE DEFENDANT THEN OPENED THE TRUCK DOOR AND SLAMMED IT INTO MY BACK TWICE. SHE THEN JUMPED out OF THE TRUCK AND BEGAN TO RUN AWAY. AT THAT TIME, I APPROACHED THE DEFENDANT AND INFORMED HER THAT SHE WAS NOT ABLE TO LEAVE YET. SHE THEN PUNCHED ME IN the FACE AND BEGAN HITTING ME ON MY RIGHT SHOULDER AND ABOUT MY NECK AREA SEVERAL TIMES BEFORE I WAS ABLE TO GAIN CONTROL OF HER HANDS. IT SHOULD BE NOTED, that the DEFENDANT'S CHILDREN WERE PRESENT AT THIS TIME AND WITNESSED the ENTIRE ALTERCATION. AT THAT TIME I WAS ABLE TO PLACE ONE HANDCUFF ON the DEFENDANT'S RIGHT ARM, AND THE DEFENDANT'S HUSBAND THEN GRABBED HER AND BEGAN PULLING HER AWAY FROM ME SO THAT I COULD NOT CUFF HER OTHER HAND. AT THIS TIME, I OBSERVED THE PARAMEDIC TO BE BESIDE ME AND HE ASSISTED ME IN GAINING CONTROL OF the DEFENDANT AWAY FROM HER HUSBAND. I THEN PLACED THE DEFENDANT IN HANDCUFFS AND SAT HER IN the REAR SEAT OF MY PATROL VEHICLE. I THEN ATTEMPTED TO SPEAK with THE DEFENDANT'S HUSBAND. I ASKED HIM SEVERAL TIMES TO PLEASE TAKE the CHILDREN SOMEWHERE SO THAT THEY DID NOT SEE WHAT WAS GOING ON, WHICH HE REFUSED TO DO. THE DEFENDANT THEN BEGAN KICKING THE WINDOW TO MY PATROL VEHICLE. DEPUTY DAVIS WAS BACK AT MY LOCATION AT THIS TIME, AS WAS DEPUTY HUGHES. DEPUTY DAVIS THEN OPENED THE PASSENGER SIDE DOOR OF MY PATROL VEHICLE AND the DEFENDANT TURNED AND ATTEMPTED TO SPIT ON DEPUTY DAVIS. I THEN OPENED THE DRIVER SIDE REAR DOOR AND the DEFENDANT ATTEMPTED TO KICK ME. I THEN REMOVED the DEFENDANT FROM THE REAR SEAT OF MY PATROL VEHICLE AND PLACED HER IN A PRONE POSITION IN the GRASS NEXT TO MY VEHICLE, AT WHICH TIME SHE KICKED DEPUTY DAVIS SEVERAL TIMES. I WAS FINALLY ABLE TO RESTRAIN HER LEGS with MY AGENCY ISSUED LEG RESTRAINTS. DEPUTY DAVIS AND I THEN PLACED HER BACK IN the REAR SEAT OF MY PATROL VEHICLE, AT WHICH TIME WHILE ATTEMPTING TO SECURE THE LEG RESTRAINTS TO HER HANDCUFFS, THE DEFENDANT TOOK HER FINGER NAILS AND GOUGED INTO MY WRISTS. the DEFENDANT WAS SPITTING THROUGHOUT MY VEHICLE SCREAMING PROFANITIES and MAKING EXTREMELY RUDE AND VULGAR COMMENTS. I THEN TRANSPORTED TO the DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. WHILE EN ROUTE, THE DEFENDANT CONTINUED TO SPIT, SCREAM, AND YELL PROFANITIES AT ME. THE DEFENDANT'S TOTAL BOND WAS SET AT $21,150.00, PER THE BOND SCHEDULE. BOTH VICTIMS COMPLETED SWORN STATEMENTS WHICH WILL BE TURNED IN TO RECORDS. *NOT-EXEMPT* |
