Probable cause affidavit: SUBMITTED BY: HINDERHOFER, EDWARD 0667 (AR14-12060) (CASE 14-129973) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: A METAL SHED AND A 120 GALLON GAS TANK FOR A TRACTOR TRAILER, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: ACTUAL VALUE BEING $1,150.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)C(1) did unlawfully traffic in or endeavor to traffic in property that HE knew or should have known was stolen, to-wit: A SHED AND A GAS TANK, the property of THE VICTIMS, in violation of Florida Statute 812.019(1); ON 092014 I RESPONDED TO 9 NORTH JACKSON STREET IN BEVERLY HILLS IN REFERENCE TO A THEFT THAT HAD ALREADY OCCURRED. UPON ARRIVAL I MADE CONTACT WITH VICTIM ONE, MS HAZEL PAGAN. MS PAGAN ADVISED SHE OWNS THE RESIDENCE; HOWEVER, HER SON, VICTIM TWO, MR JOEY SANCHEZ, RESIDES THERE. SHE ADVISED THAT ON TODAY'S DATE, WHILE VISITING THE HOME, SHE NOTICED THAT THE 7 FOOT BY 7 FOOT BY 7 FOOT ALUMINUM SHED WHICH IS NORMALLY LOCATED ON THE NORTH SIDE OF THE RESIDENCE, WAS MISSING. SHE ADVISED THAT MOST OF THE CONTENTS WERE LEFT BEHIND; HOWEVER, ALSO MISSING WAS A 120 GALLON ALUMINUM GAS FUEL TANK FOR A TRACTOR TRAILER. SHE ADVISED THAT THE SHED WAS WORTH APPROXIMATELY $350.00 and the fuel tank was worth approximately $800.00. ms pagan advised that her son had no idea that the items were missing. she advised she then spoke to her neighbor, ms darlene weisgarber, who advised she knew who the suspects were. i made contact with ms weisgarber and she advised she spoke to her friend, suspect one mr shaun stehlik and he advised her that his friend, suspect two, mr walter fiore, had permission to remove the shed next door for scrap. ms weisgarber provided me with phone numbers for these subjects. i then made contact with two other neighbors; witness ms kalli mckinney and witness mr jordan lilley, who both reside at 10 north jackson street. ms mckinney and mr lilley advised that on 091814, they witnessed two white males tearing down the metal shed attached to the house at 9 north jackson street. they advised that the suspects appeared to be approximately 25 to 30 years of age and were driving a white pickup truck. THEY ADVISED WHILE WALKING PAST THE RESIDENCE WITNESS LILLEY ASKED THE SUSPECTS JOKINGLY IF THEY WERE HAVING FUN YET, TO WHICH THE SUSPECTS REPLIED THEY HAD BEEN WANTING TO DO THIS FOREVER. i then attempted to make contact with the suspects via telephone, at which time mr stehlik did return my phone call and agreed to meet with me at the dollar general in holder. upon arrival there i observed mr stehlik and mr fiore sitting in mr fiore's white dodge pickup truck in the parking lot. mr stehlik advised that he was staying with the witness darlene at 7 north jackson street for a few days, and during that time darlene told him repeatedly that the neighbor joey wanted his shed scrapped, due to it falling apart. he advised he was already going to scrap several other items and told his friend, suspect fiore, about the shed at which time mr fiore told shaun that joey had also mentioned to him a few months ago that he had wanted to scrap the shed. mr stehlik advised that he never had any criminal intentions And thought he was just doing the victim a favor. i asked mr stehlik what he had done with the shed material, at which time he advised he and mr fiore scrapped the shed at inter county recycling in lecanto. i asked him if he had also scrapped the aluminum gas tank That was in the shed, and he advised that he did. i then made contact with mr fiore who corroborated mr stehlik's statement. mr fiore advised that mr stehlik told him that the neighbor next to 7 north jackson street wanted his shed taken down and off the property. mr fiore advised he used to live on north jackson street and at one time did some yard work for the victim, at which time the victim did mention wanting to have his shed removed. however, he did not speak to him again about it. mr fiore advised when shaun mentioned the shed, he did not think anything of it due to the victim mentioning it prior. mr fiore advised that they did take the items to inter county recycling where they were scrapped under mr fiore's name. mr fiore advised he is a frequent customer of inter county recycling and scraps items there regularly. mr fiore advised he was just helping mr stehlik out and is not responsible if the items were stolen. i then again made contact with victim, mr joey sanchez and victim ms hazel pagan. they were adamant that at no time did they give anyone permission to remove their shed or fuel tank from their property. mr sanchez advised no one has ever come to his residence asking if they could remove the shed, nor did he ever discuss it with anyone. i again made contact with ms weisgarber and asked her if she told mr stehlik that the neighbor wanted his shed removed, and she advised she did not tell him anything like that. the two defendants, two victims, and three witnesses, all completed sworn written statements, which were later turned over to records. deputy byrd, id: 0737, responded to inter county recycling in lecanto where he did obtain the florida secondary metals recycler purchase transaction form and receipts. the form shows mr fiore's florida driver's license and thumb print and electronic signature, where he signed that he is the rightful owner or was entitled to sell the regulated metals/property being sold. also on the receipts are pictures of the items that were scrapped. the pictures show mr fiore, as well as mr stehlik, as being present while scrapping the items, as well as mr fiore's white dodge pickup truck. the receipt number for the transaction is 0238111. the employee entering the receipt is mr justin lawrence and the transaction date and time 091814 at 1537 hours, and the total amount paid in cash to mr fiore was 143.99. the form and receipt was later turned over to records. at that time the defendants were placed under arrest, handcuffed double locked behind their person, and secured in the rear seat of my patrol vehicle, WHERE THEY WERE THEN transported to the citrus county detention facility for booking and processing. mr stehlik was charged with one count of grand theft and one count of dealing in stolen property with a total bond of $7,000.00. mr fiore was charged with one count of grand theft, one count of dealing in stolen property, and one count of false verification of ownership to a metal recycler, with a total bond of $9,000.00. the victim was provided with a victim's rights pamphlet and was advised the items had already been destroyed and processed by inter county recycling.
