Probable cause affidavit: SUBMITTED BY: CUTLIP, JOSHUA 0721 (AR 14-11857) (14-122370) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, WAL-MART, TO WIT: THE DEFENDANT INTENTIONALLY REMOVED CLEARANCE ITEM STICKERS OFF OF PRODUCTS and PLACED THE STICKERS ON OTHER PRODUCTS ON MUCH HIGHER PRICE that SHE HAD ALREADY SELECTED AND WERE IN HER CART, SAID PROPERTY BEING OF A VALUE OF $51.66 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(1) and 812.014(3)(a). ON 090414 AT APPROXIMATELY 1904 HOURS, I WAS DISPATCHED TO 2461 EAST GULF TO LAKE HIGHWAY IN INVERNESS IN REFERENCE TO A RETAIL THEFT THAT HAD JUST occurred. UPON ARRIVAL, I MADE CONTACT WITH LOSS PREVENTION OFFICER, MR JAMES ROWE, WHO ADVISED HE HAD OBSERVED A SUSPICIOUS FEMALE ON THE SALES FLOOR AND CONDUCTED ON FLOOR SURVEILLANCE WHERE HE OBSERVED HER TAKE CLEARANCE STICKERS OFF OF PRODUCTS AND PLACE THE CLEARANCE STICKERS ON ITEMS SHE ALREADY HAD IN HER GROCERY CART. THE COMPLAINANT ADVISED THE WHITE FEMALE, LATER IDENTIFIED AS THE DEFENDANT, MS SHAWN GAGNE, HAD SELECTED MULTIPLE ITEMS IN HER CART and HAD ONLY PLACED THE CLEARANCE STICKERS ON COSMETIC PRODUCTS AND ONE ACRYLIC ENAMEL PAINT JAR. THE FIRST ITEM THAT THE DEFENDANT PLACED A CLEARANCE SICKER ON WAS AN EIGHT OUNCE CAN OF KRYLON COLOR MASTER ACRYLIC LATEX PAINT ORIGINALLY VALUED AT $3.64. SECOND ITEM WAS OIL OF OLAY AGE DEFYING WRINKLE CREAM VALUED AT $19.94. THE THIRD ITEM WAS OIL OF OLAY REGENERIST ANTI-AGING EYE SERUM VALUED AT $19.94. THE FOURTH WAS OIL OF OLAY REGENERIST ANTI-AGING WRINKLE VANISHER VALUED AT $12.27. THE FOUR ITEMS THE DEFENDANT HAD PLACED THE CLEARANCE STICKERS ON HAD A TOTAL VALUE OF $55.79; HOWEVER WITH PLACING THE CLEARANCE ITEM STICKERS ON THESE ITEMS ONLY PAID $4.13, LEAVING WAL-MART WITH A LOSS OF $51.66 BY ALTERING THE ORIGINAL STICKER PRICE. THE COMPLAINANT MAINTAINED VISUAL CONTACT WITH THE DEFENDANT WHERE SHE PROCEEDED TO THE SELF CHECKOUT COUNTER AND USED TERMINAL 43 WHERE TE DEFENDANT WAS SEEN PLACING THE ALTERED ITEMS IN A GROCERY BAG AFTER HAVING PAID THE $4.13 FOR THE ITEMS ORIGINALLY VALUED AT $55.79. THE DEFENDANT THEN PROCEEDED TO THE FRONT EXIT WHERE LOSS PREVENTION OFFICER ROWE MADE CONTACT WITH HER, ADVISING HER WHY SHE WAS BEING STOPPED AND REQUESTED HER TO RETURN TO THE LOSS PREVENTION OFFICE FOR FURTHER QUESTIONING AND FOR THE ARRIVAL OF LAW ENFORCEMENT. AT APPROXIMATELY 1935 HOURS, I MADE CONTACT with the DEFENDANT AT THE LOSS PREVENTION OFFICE WHERE I READ THE DEFENDANT HER MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD AND ASKED IF SHE UNDERSTOOD HER RIGHTS, TO WHICH SHE REPLIED THAT SHE DID. I THEN ASKED HER IF SHE WISHED TO SPEAK WITH ME AT THIS TIME, TO WHICH SHE ADVISED THAT SHE WOULD. THE DEFENDANT VERBALLY ADMITTED POST-MIRANDA TO INTENTIONALLY SWITCHING the STICKERS FOR A LESSER AMOUNT BECAUSE SHE DID NOT FEEL LIKE PAYING THE FULL VALUE PRICE OF THESE ITEMS. I ASKED THE DEFENDANT IF SHE HAS EVER BEEN ARRESTED FOR SHOPLIFTING TO WHICH SHE ADVISED SHE HAD. AN IN HOUSE RECORDS CHECK REVEALED THE SAME DEFENDANT WAS ARRESTED ON 050214 FOR RETAIL PETIT THEFT. THE DEFENDANT STATED SHE MADE A MISTAKE AND SHE WAS TAUGHT THIS TRICK OF CHANGING STICKER PRICES FROM AN ACQUAINTANCE OF HERS HOWEVER WOULD NOT DIVULGE THE NAME. WITH HAVING AN ADMISSION OF GUILD POST MIRANDA AND A SWORN WRITTEN STATEMENT BY THE COMPLAINANT I ADVISED THE DEFENDANT SHE WAS BEING PLACED UNDER ARREST FOR RETAIL PETIT THEFT. THE DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK. A PAT DOWN SEARCH WAS CONDUCTED WITH NEGATIVE RESULTS FOR WEAPONS OR CONTRABAND AND PLACED IN THE REAR OF MY PATROL VEHICLE FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. THE DEFENDANT WAS RELEASED ON HER OWN RECOGNIZANCE DUE TO HER BEING TERMINALLY ILL AND HAVING TO TAKE MEDICATION FOUR TIMES A DAY WITH THE NEXT DOSE OF MEDICATION BEING AT APPROXIMATELY 2100 HOURS. THIS DECISION WAS MADE BY THIS DEPUTY DUE TO THE DEFENDANT BEING EMOTIONAL AND ADAMANT THAT THIS MEDICATION WAS NECESSARY. THE DEFENDANT WAS TURNED OVER TO CITRUS COUNTY DETENTION FACILITY STAFF. NO FURTHER ACTION WAS TAKEN BY THIS DEPUTY.
