| Probable cause affidavit: | Obtain or use and elderly personâs funds, with the intent to deprive the elderly person of said funds, without the consent of said elderly person; Utter and publish as true a false, forged, altered or counterfeit note, or any bank bill, check, draft, or promissory note, payable to the bearer thereof or to the order of any person, issues as aforesaid, knowing the same to be false, altered, forged or counterfeited, with the intent to injure or defraud any person; to wit: On 07/26/13, the victim reported to the Citrus County Sheriffâs Office that the suspect had stolen seven checks and cashed them. The victim has hidden his checks and he never divulged their location to the defendant. The victim provided documents showing the checks were made out to the suspect; as follows: check 1004 on 07/08/13 for $250; check 1006 on 07/12/13 for $50; check 1007 on 07/15/13 for $150; check 1009 on 07/19/13 for $50; check 1027 on 07/19/13 for $250; check 1028 on 07/22/13 for $300 and check 07/22/13 for $1000. The defendant recently had moved into the house, as the victim felt bad that he was sleeping in his car. On 07/29/13, contact was made with the defendant at the Citrus County Jail where he was being held on unrelated charges. After Miranda, the defendant gave a sworn taped statement admitting that he cashed these checks and that he knew some, if not all, were not legitimate. On 07/30/13, the defendant was contacted at the Citrus County Jail, where he was charged with seven counts of uttering a forged bank bill and exploitation of the elderly and held in lieu of $19,000 bond. |
