SUBMITTED BY: SEFFERN, JONATHAN 0623 (AR08102896) DID UNLAWFULLY TRAFFIC IN OR ENDEAVOR TO TRAFFIC IN PROPERTY THAT SHE KNEW OR SHOULD HAVE KNOWN WAS STOLEN, TO-WIT: VARIOUS METAL OBJECTS, THE PROPERTY OF THE VICTIM, IN VIOLATION OF FLORIDA STATUTE 812.019(1) AND DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE, THE PROPERTY OF THE, TO-WIT: VARIOUS METAL OBJECTS, SAID PROPERTY BEING OF A VALUE OF LESS THAN $100.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTE AND 812.014(3). ON 042508 AT APPROXIMATELY 1246 HOURS, THIS DEPUTY WAS DISPATCHED TO A RESIDENCE ON WEST WINTERSUN LANE IN HOMOSASSA IN REFERENCE TO A THEFT THAT JUST OCCURRED. UPON ARRIVAL, THIS DEPUTY MADE CONTACT WITH THE COMPLAINANT WHO ADVISED THAT AT APPROXIMATELY 1230 HOURS WHILE WORKING IN HIS YARD, A RED IN COLOR BLAZER PULLING A TRAILER DROVE PAST HIS RESIDENCE LOCATED ON WEST WINTERSUN LANE AND CAME TO A STOP ON WEST WINTERSUN LANE WHICH THE COMPLAINANT ADVISED THAT THIS RESIDENCE WAS ABANDONED. THE COMPLAINANT ADVISED THAT AT THAT TIME, A WHITE MALE SUBJECT EXITED THE VEHICLE AND PROCEEDED TOWARD THE RESIDENCE. THE COMPLAINANT ADVISED THAT TWO FEMALE SUBJECTS WHO WERE IN THE DRIVER AND PASSENGER SEATS LEFT THE RESIDENCE IN THIS VEHICLE AND HEADED EASTBOUND ON WEST WINTERSUN LANE. THE COMPLAINANT ADVISED THAT AS THE VEHICLE DROVE IN FRONT OF HIS RESIDENCE, NOTICING THE COMPLAINANT WORKING IN HIS YARD, THE FEMALE DRIVER STOPPED AND ASKED THE COMPLAINANT IF HE HAD ANY JUNK TO HAUL AWAY. THE COMPLAINANT ADVISED THE FEMALE SUBJECT THAT HE DID NOT, TO WHICH SHE THEN ASKED THE COMPLAINANT IF HE KNEW WHERE THE NEW PEOPLE KNOWN AS THE "WILLIAMS" LIVED ON THIS STREET. THE COMPLAINANT ADVISED THE FEMALE SUBJECT THAT HE DID NOT AND THAT THERE WERE NOT ANY NEW PEOPLE ON THIS STREET. THE COMPLAINANT ADVISED AT THAT TIME THAT THE FEMALE SUBJECT CONTINUED EASTBOUND ON WEST WINTERSUN LANE. A FEW MINUTES LATER THE COMPLAINANT ADVISED THE FEMALE SUBJECT DROVE BY HIS HOUSE AGAIN, AT WHICH TIME HE STOPPED THE VEHICLE TO ASK IF THEY LOCATED THE PEOPLE THEY WERE LOOKING FOR, TO WHICH THEY ADVISED YES AND THAT THEY LIVED IN THE YELLOW HOUSE EAST OF HIS RESIDENCE. THE COMPLAINANT ADVISED THIS INFORMATION THEY PROVIDED HIM WAS NOT ACCURATE DUE TO HIM KNOWING WHO RESIDES AT THE RESIDENCE DESCRIBED TO HIM. THE COMPLAINANT FURTHER ADVISED THAT THE PEOPLE WHO RESIDE AT THAT ADDRESS WERE NOT THE WILLIAMS' AND WERE NOT HOME WHILE THESE FEMALE SUBJECTS ATTEMPTED TO LOCATE THE WILLIAMS' RESIDENCE. THE COMPLAINANT ADVISED AT THAT TIME, THE FEMALE SUBJECTS CONTINUED TO DRIVE WESTBOUND STOPPING AT ANOTHER RESIDENCE ON WEST WINTERSUN LANE. THE COMPLAINANT ADVISED THE TWO FEMALE SUBJECTS EXITED THE VEHICLE AS THOUGH TO PROCEED TOWARD THE RESIDENCE. THE COMPLAINANT ALSO ADVISED THAT THE MALE SUBJECT WAS OBSERVED COMING OUT OF THE TREES ON THE LISTED PROPERTY AND BEGAN LOADING METAL OBJECTS INTO THE TRAILER. THE COMPLAINANT ADVISED THE FEMALE SUBJECTS ALSO BEGAN LOADING METAL OBJECTS INTO THE TRAILER. THE COMPLAINANT ADVISED THAT ALL SUBJECTS GOT BACK INTO THE VEHICLE AND PROCEEDED WESTBOUND TOWARD THE END OF THE ROAD AND MAKE A LEFT HAND TURN. AT THAT TIME, THE COMPLAINANT ADVISED THAT HE GOT INTO HIS VEHICLE AND FOLLOWED THE VEHICLE TO CONFRONT THEM IN REGARD TO THE SITUATION. THE COMPLAINANT ADVISED THAT HE OBSERVED THE VEHICLE PARKED DOWN THE ROAD, AT WHICH TIME HE AGAIN MADE CONTACT WITH THE FEMALE DRIVER. THE FEMALE DRIVER STATED THAT SHE STOPPED IN FRONT OF THAT ADDRESS ONLY TO USE THE BATHROOM. THE COMPLAINANT ADVISED THE FEMALE DRIVER THAT HE OBSERVED THEM LOADING METAL OBJECTS INTO THE TRAILER AND THAT HE WAS GOING TO CONTACT THE SHERIFF'S OFFICE IN REGARD TO THE SITUATION. AT THAT TIME, THE COMPLAINANT OBTAINED THE LICENSE PLATE NUMBER ON THE VEHICLE AND CONTACTED THIS AGENCY. IT SHOULD BE NOTED THE COMPLAINANT PROVIDED THIS DEPUTY WITH A SWORN WRITTEN STATEMENT WHICH WAS LATER TURNED INTO RECORDS. THE INFORMATION REGARDING THE VEHICLE WAS PROVIDED TO ALL RESPONDING DEPUTIES. SERGEANT GRANT RESPONDED TO THE REGISTERED DRIVER'S ADDRESS WHICH WAS OBTAINED FROM THE LICENSE PLATE NUMBER ON THE SUSPECT VEHICLE. SERGEANT GRANT MADE CONTACT WITH A SUBJECT WHO ADVISED THAT SUBJECTS DID RESIDE AT THAT ADDRESS WHO DROVE A RED CHEVROLET BLAZER WHICH MATCHED THE SUSPECT VEHICLE'S DESCRIPTION. THIS SUBJECT FURTHER ADVISED THE RESIDENTS WERE NOT HOME AND THAT THEY WERE OUT DOING A SCRAP METAL CLEAN UP JOB. THE SUBJECT FURTHER ADVISED THAT THE SUBJECTS OFTEN USED THE RECYCLING BUSINESS LOCATED ON STATE ROAD 44 NEAR THE LANDFILL. AT THAT TIME, SERGEANT GRANT ADVISED DISPATCH TO SEND AN EAST SIDE DEPUTY TO INTERCOUNTY RECYCLING TO ATTEMPT TO LOCATE THESE SUBJECTS. DEPUTY BEETOW RESPONDED AND MADE CONTACT WITH THESE SUBJECTS, AT WHICH TIME DETECTIVE WILLIS WAS CONTACTED IN REFERENCE TO THIS CASE. DETECTIVE WILLIS RESPONDED TO INTERCOUNTY RECYCLING AND MADE CONTACT WITH DEPUTY BEETOW AND CORPORAL SCHANEL WHO WERE ON SCENE WITH FOUR SUSPECTS. DETECTIVE WILLIS MADE CONTACT WITH THE SUSPECTS AND INDIVIDUALLY INTERVIEWED THEM. ALL FOUR SUSPECTS DID CONFESS TO DETECTIVE WILLIS TO GOING INTO YARDS OF UNOCCUPIED RESIDENCES IN THE AREA OF SOUTH GRAND CIRCLE TERRACE AND WEST WINTERSUN LANE AND REMOVING METAL ITEMS TO BE SOLD AT INTERCOUNTY RECYCLING. ALL FOUR STATED THAT THEY DID NOT HAVE THE PERMISSION OF THE PROPERTY OWNERS WHERE THE METAL ITEMS WERE TAKEN FROM. ALL FOUR DEFENDANTS WHO WERE INTERVIEWED BY DETECTIVE WILLIS AND WHO HAD CONFESSED TO THE CRIMES LISTED WERE HANDCUFFED BEHIND THEIR BACKS (DOUBLE LOCKED,) SECURED IN THE REAR SEATS OF MULTIPLE PATROL VEHICLES AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL BOND FOR EACH DEFENDANT WAS SET AT A TOTAL OF $5,500.00, PER THE BOND SCHEDULE. *NOT-EXEMPT* |
