Date of birth: Dec 30, 1967
Probable cause affidavit: SUBMITTED BY: BARR, JOSHUA 1338 (AR15-15741) (15-92400) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF PUBLIX, TO WIT: TWO TUBES OF OINTMENT, BOTTLE OF CONDITIONER AND ANOTHER MISCELLANEOUS ITEM, BY CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $100.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(A). ON 071415, I WAS DISPATCHED TO PUBLIX, LOCATED AT 6760 WEST GULF TO LAKE HIGHWAY IN CRYSTAL RIVER, IN REFERENCE TO A THEFT IN PROGRESS. AS I WAS APPROACHING THE PUBLIX PARKING LOT, I WAS INFORMED BY DISPATCH THAT THE DEFENDANT, DESCRIBED AS A HEAVY SET WHITE FEMALE WITH A BLUE T-SHIRT, WAS LEAVING THE SCENE IN A SILVER PICKUP TRUCK WITH AN AMERICAN FLAG STICKER ON THE TAILGATE. AT THAT TIME, I OBSERVED A VEHICLE MATCHING THAT DESCRIPTION BEING DRIVEN A FEMALE MATCHING THE DEFENDANT'S DESCRIPTION, PULLING OUT OF THE PUBLIX PARKING LOT AND HEADING WEST ON HIGHWAY 44. I PULLED BEHIND THE VEHICLE AND INITIATED A TRAFFIC STOP. THE DEFENDANT'S VEHICLE PULLED OVER INTO A PARKING LOT NEAR THE INTERSECTION OF HIGHWAY 44 AND NORVELL BRYANT HIGHWAY. DEPUTY T TAYLOR (0700) ARRIVED ON SCENE AS BACK-UP. AT THAT TIME, I MADE CONTACT WITH THE DRIVER, WHO WAS LATER DETERMINED TO BE THE DEFENDANT, MS STACY BUCKLEY. I OBSERVED A PUBLIX GROCERY BAG SITTING ON THE PASSENGER SIDE SEAT OF THE DEFENDANT'S VEHICLE. I ASKED THE DEFENDANT IF SHE HAD JUST BEEN INSIDE PUBLIX, TO WHICH SHE STATED ''YES AND I KNOW WHY YOU'RE HERE. I DIDN'T PAY FOR EVERYTHING I TOOK.'' AT THAT TIME, I ASKED THE DEFENDANT TO STEP OUT OF HER VEHICLE, TO WHICH SHE COMPLIED. I READ THE DEFENDANT HER MIRANDA WARNINGS FROM MY AGENCY ISSUED MIRANDA CARD. THE DEFENDANT STATED SHE UNDERSTOOD HER RIGHTS AND WISHED TO ANSWER ANY QUESTIONS THAT I HAD. I ASKED THE DEFENDANT WHAT SHE HAD TAKEN THAT WAS NOT PAID FOR. SHE INFORMED ME SHE HAD STOLEN TWO TUBES OF OINTMENT AND A BOTTLE OF CONDITIONER. DEPUTY T TAYLOR TOOK ALL OF THE ITEMS SHE HAD TAKEN FROM PUBLIX BACK TO PUBLIX WHERE HE MET WITH THE COMPLAINANT, MS CHRISTY WIGGINS, IN ORDER TO DETERMINE WHAT EXACTLY HAD BEEN STOLEN AND THEIR VALUE. SEE HIS SUPPLEMENT REPORT FOR FURTHER. DEPUTY T TAYLOR RETURNED WITH A PRINTOUT OF FOUR STOLEN ITEMS, TO INCLUDE A PUBLIX BRAND TRIPLE OINTMENT, VALUED AT $5.99; NEOSPORIN, VALUED AT $8.79; BH MATTE PASTE, VALUED AT $19.99; AND A BOTTLE OF COLOR LAST CONDITIONER, VALUED AT $19.99, FOR A TOTAL OF $57.16. AFTER HAVING BEEN READ HER MIRANDA RIGHTS, THE DEFENDANT AGREED TO PROVIDE A WRITTEN STATEMENT, WHICH WAS LATER TURNED INTO RECORDS. THE COMPLAINANT ALSO PROVIDED A WRITTEN STATEMENT, WHICH WAS ALSO LATER TURNED INTO RECORDS. ALL STOLEN MERCHANDISE WAS RETURNED TO PUBLIX UNDAMAGED. AT THAT TIME, I INFORMED THE DEFENDANT SHE WAS BEING PLACED UNDER ARREST FOR RETAIL PETIT THEFT. SHE WAS HANDCUFFED BEHIND HER BACK (DOUBLE LOCKED) AND SECURED IN THE REAR OF MY PATROL VEHICLE. SHE WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. THE DEFENDANT'S VEHICLE WAS SECURED AND LEFT IN THE PARKING LOT.
