SUBMITTED BY: AGUILERA, EMANUEL 1238 (AR16-19165) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WALMART, TO WIT: 53 MISCELLANEOUS ITEMS CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF MORE THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 812.015(8). ON 042216 AT APPROXIMATELY 1322 HOURS, I WAS DISPATCHED TO WALMART, LOCATED AT 1936 NORTH LECANTO HIGHWAY, IN REFERENCE TO A THEFT THAT HAD ALREADY OCCURRED WITH THE SUSPECT IN CUSTODY. UPON ARRIVAL, I MADE CONTACT WITH LOSS PREVENTION OFFICER MR ROBERT GROSS (WITNESS), WHO ADVISED ME THAT ON 042216, HE OBSERVED AN UNIDENTIFIED FEMALE, LATER IDENTIFIED AS THE DEFENDANT, MS STEPHANIE BOCKIUS, DISPLAYING SUSPICIOUS BEHAVIOR ON THE SALES FLOOR. HE FIRST OBSERVED HER IN THE JEWELRY SECTION WITH A CART LOADED WITH MERCHANDISE. SHE SELECTED SEVERAL PURSES AND PROCEEDED TO THE APPAREL, WHERE HE THEN OBSERVED HER SELECT SEVERAL OTHER ITEMS. HE ADVISED HE THEN OBSERVED HER "DITCH" HER SHOPPING CART AND PROCEED INTO THE LADIES LINGERIE, WHERE SHE REMOVED A LARGE SHOPPING BAG FROM HER PURSE AND FILLED IT WITH MERCHANDISE. HE ADVISED SHE THEN PROCEEDED TO THE EXIT, PASSING ALL POINTS OF SALE WITHOUT MAKING ANY ATTEMPT TO PAY FOR THE MERCHANDISE THAT SHE HAD CONCEALED. MR GROSS ADVISED THAT HE THEN STOPPED HER AND TOLD HER THAT HE WAS A LOSS PREVENTION OFFICER AND ESCORTED HER TO THE LOSS PREVENTION OFFICE AND NOTIFIED THE CITRUS COUNTY SHERIFF'S OFFICE. THE DEFENDANT WAS ALSO SITTING IN THE LOSS PREVENTION OFFICE, WHERE I ATTEMPTED TO READ HER MIRANDA RIGHTS VIA A PREPRINTED CARD, WHERE SHE ADVISED SHE UNDERSTOOD THEM AND DID NOT NEED THEM READ. SHE ADVISED THAT SHE DID STEAL THE ITEMS AND THAT SHE WAS A SINGLE MOTHER AND MADE A MISTAKE TODAY. I ADVISED HER THAT DUE TO THE MERCHANDISE BEING A TOTAL VALUE OF $329.28 THAT IT WAS A FELONY AND THAT I WOULD BE PLACING HER UNDER ARREST FOR RETAIL THEFT. SHE WAS THEN HANDCUFFED (DOUBLE LOCKED), SEARCHED, AND PLACED IN THE REAR OF MY PATROL VEHICLE. SHE WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY AND TURNED OVER TO STAFF FOR BOOKING AND PROCESSING. THE WITNESS AND THE DEFENDANT BOTH PROVIDED ME WITH SWORN WRITTEN STATEMENTS THAT WERE TURNED IN TO RECORDS ALONG WITH THE WALMART RECEIPT OF THE STOLEN/RECOVERED MERCHANDISE. THE VIDEO OF THE DEFENDANT INSIDE THE STORE WAS SUBMITTED TO EVIDENCE ALONG WITH PICTURES OF THE STOLEN MERCHANDISE. THE MERCHANDISE WAS TURNED BACK OVER TO WALMART. THE DEFENDANT'S BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE. NO FURTHER ACTION BY THIS DEPUTY. |
