Probable cause affidavit: SUBMITTED BY: CANFIELD, LAIRD 0544 (AR13-8143) (13-162734) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS/HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193. ON 112713 AT 0041 HOURS, I WAS CONDUCTING STATIONARY RADAR ON NORVELL BRYANT HIGHWAY JUST EAST OF LKQ IN A 45 MILES PER HOUR (MPH) ZONE. THE RADAR IN MY ASSIGNED PATROL VEHICLE WAS CHECKED AT THE START OF MY SHIFT AND WAS FOUND TO BE IN WORKING ORDER. THE WEATHER CONDITIONS WERE CLOUDY WITH NO RAIN AND LITTLE TO NO WIND. THE ROAD CONDITIONS WERE WET WITH NO OBVIOUS DEFECTS. I OBSERVED A VEHICLE APPROACHING TRAVELING WESTBOUND ON HIGHWAY 486. AS THE VEHICLE CAME CLOSER AND ONTO FLAT GROUND, I ESTIMATED THE SPEED AND ACTIVATED MY RADAR IN MY PATROL VEHICLE. I RECEIVED A CLEAR AUDIO TONE WITH A TARGET SPEED READING 64 MPH. AS THE VEHICLE PASSED MY POSITION, I TURNED ON MY HEADLIGHTS AND TURNED AROUND TO CATCH UP WITH THE VEHICLE. WHILE DOING THIS, DEPUTY CORBIN ADVISED ME ON THE RADIO HE CLOCKED THE VEHICLE NOW DOING 69 MPH. I CAUGHT UP WITH THE VEHICLE JUST WEST OF BETTY POINT AND ACTIVATED MY EMERGENCY WARNING LIGHTS. THE VEHICLE CONTINUED TO TRAVEL EASTBOUND IN THE INSIDE LANE BEFORE FINALLY PULLING OVER IN THE LEFT TURN LANE AT THE WAL-MART LIGHT. I APPROACHED THE VEHICLE AND MADE CONTACT WITH THE DRIVER/DEFENDANT, MS STEPHANIE L CROWSON. I ASKED MS CROWSON FOR HER DRIVER'S LICENSE, VEHICLE REGISTRATION AND PROOF OF INSURANCE. MS CROWSON WAS NOT ABLE TO PROVIDE ME WITH ANY OF THE DOCUMENTS I REQUESTED. WHILE ASKING FOR THESE DOCUMENTS I OBSERVED MS CROWSON’S EYES TO BE WATERY AND GLASSY. HER SPEECH WAS SLURRED AND SHE HAD A MODERATE ODOR OF AN ALCOHOL BEVERAGE ON OR ABOUT HER PERSON. I THEN ASKED MS CROWSON TO PROVIDE WITH HER NAME, DATE OF BIRTH AND SOCIAL SECURITY NUMBER, WHICH SHE DID. I THEN RETURNED TO MY PATROL VEHICLE TO CONDUCT A COMPUTER CHECK OF MS CROWSON AND HER VEHICLE. THE COMPUTER CHECK REVEALED MS CROWSON HAD A VALID FLORIDA DRIVER'S LICENSE AND THE VEHICLE REGISTRATION WAS ALSO VALID. I RE-APPROACHED MS CROWSON’S VEHICLE AND OBSERVED SHE HAD LOCATED A SMALL PACKET CONTAINING THE VEHICLE REGISTRATION AND PROOF OF INSURANCE. WHEN I ASKED MS CROWSON TO REMOVE THE DOCUMENTS, SHE FUMBLED WITH THEM AND PROVIDED THEM TO ME. I RETURNED TO MY PATROL VEHICLE TO ACTIVATE MY IN-CAR CAMERA AND THEN RETURNED TO MS CROWSON’S VEHICLE, TO ASK HER TO STEP OUT AND COME TO THE REAR OF HER VEHICLE. MS CROWSON COMPLIED AND I OBSERVED HER TO BE UNSTEADY IN HER MOVEMENTS. AT THAT TIME, I ASKED THE DEFENDANT IF SHE HAD ANY MENTAL OR PHYSICAL DISABILITIES THAT WOULD NOT ALLOW HER TO PERFORM ANY OF THE SOBRIETY TASKS, TO WHICH SHE STATED THAT SHE DID NOT. MS CROWSON FURTHER STATED SHE HAD ASTHMA AND THAT HER INHALER SMELLED LIKE ALCOHOL. TASK ONE, HORIZONTAL GAZE NYSTAGMUS. PRIOR TO PERFORMING THIS TASK, IT WAS DETERMINED THAT THE DEFENDANT HAD NO PROBLEMS WITH HER EYES. DURING THIS TASK, THERE WAS LACK OF SMOOTH PURSUIT IN BOTH THE LEFT AND RIGHT EYE. TASK TWO, WALK AND TURN FIRST ATTEMPT. THIS TASK WAS EXPLAINED AND DEMONSTRATED TO THE DEFENDANT. DURING THIS TASK, THE DEFENDANT LOST HER BALANCE DURING THE INSTRUCTIONS, USED HER ARMS OVER SIX INCHES TO BALANCE, TOOK NINE STEPS, STUMBLED AND STOPPED. WALK AND TURN ATTEMPT TWO. THIS TASK WAS EXPLAINED AND DEMONSTRATED TO THE DEFENDANT AGAIN. DURING THIS TASK, THE DEFENDANT TOOK TEN STEPS, STUMBLED AT THE TURN, STEPPED OFF THE LINE AT STEP TWO, FAILED TO TOUCH HEEL TO TOE AT STEP FOUR. TASK THREE, ONE LEG STAND, FIRST ATTEMPT. THIS TASK WAS EXPLAINED AND DEMONSTRATED TO THE DEFENDANT. DURING THIS TASK, THE DEFENDANT DID NOT START WHEN INSTRUCTED, THEN STARTED BEFORE INSTRUCTED, USED ARMS OVER SIX INCHES TO BALANCE, HOPS WHILE BALANCING, FAILED TO COUNT, PUT FOOT DOWN ONE LEG STAND ATTEMPT TWO. THIS TASK WAS EXPLAINED AND DEMONSTRATED TO THE DEFENDANT AGAIN. DURING THIS TASK, THE DEFENDANT STARTED BEFORE INSTRUCTED, USED ARMS OVER SIX INCHES TO BALANCE, HOPS WHILE BALANCING, PUT FOOT DOWN, CONTINUED TO ATTEMPT TO TAKE THE TASK AFTER INSTRUCTED TO STOP. TASK FOUR, FINGER TO NOSE. THIS TASK WAS EXPLAINED AND DEMONSTRATED TO THE DEFENDANT. DURING THIS TASK, THE DEFENDANT LEFT – UNDER NOSE, RIGHT – TIP, LEFT – TIP, RIGHT – TIP, RIGHT – TIP, LEFT – UNDER NOSE. AT THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST FOR DRIVING UNDER THE INFLUENCE. PRIOR TO LEAVING THE SCENE, A ROTATION WRECKER WAS REQUESTED AND THE DEFENDANT'S VEHICLE WAS TURNED OVER TO DEPUTY CORBIN. WHILE EN ROUTE TO THE CITRUS COUNTY DETENTION FACILITY, MS CROWSON BEGAN CRYING AND EXPLAINED SHE WAS DOING HER BEST TO RAISE HER THREE CHILDREN. WHEN I EXPLAINED TO MS CROWSON SHE CAN NOT DRINK AND DRIVE, SHE STATED “WHAT OTHER CHOICE DO I HAVE”. UPON ARRIVAL AT THE CITRUS COUNTY DETENTION FACILITY, MS CROWSON WAS TURNED OVER TO CORRECTIONAL OFFICER RHODES TO CONDUCT A TEST OF HER BREATH. CORRECTIONAL OFFICER RHODES PROVIDED ME THE RESULTS OF THE TEST, WHICH WERE .211 AND .223. MS CROWSON WAS ISSUED DUI CITATION NUMBER 7779XBL, FOR DRIVING UNDER THE INFLUENCE WHERE BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. SHE WAS ALSO ISSUED UNIFORM TRAFFIC CITATION NUMBER 7710WQB FOR SPEED, WARNING NUMBER 99038589 FOR FAILURE TO CARRY/EXHIBIT DRIVER'S LICENSE UPON DEMAND. A DVD COPY OF THIS INCIDENT WAS BURNED AND LATER TURNED INTO EVIDENCE, ALONG WITH A COMPLETED PROPERTY RECEIPT. NO FURTHER ACTION WAS TAKEN AT THIS TIME BY THIS DEPUTY.
