SUBMITTED BY: HESSE, BRYAN 0755 (AR14-12982) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A GLASS METHAMPHETAMINE SMOKING PIPE, SYRINGES, AND SMALL PLASTIC BAGS WITH METHAMPHETAMINE RESIDUE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). IT IS UNLAWFUL FOR A PERSON WHO HAS BEEN ARRESTED OR LAWFULLY DETAINED BY A LAW ENFORCEMENT OFFICER TO GIVE A FALSE NAME, OR OTHERWISE FALSELY IDENTIFY HIMSELF OR HERSELF IN ANY WAY, TO THE LAW ENFORCEMENT OFFICER OR ANY COUNTY JAIL PERSONNEL, TO WIT: THE DEFENDANT GAVE THE NAME AND DATE OF BIRTH OF HER SISTER, MS RACHEL LYNN MOON, IN VIOLATION OF FLORIDA STATE STATUTE 901.36(1). ON 112914 AT APPROXIMATELY 2200 HOURS, I RESPONDED TO THE ST BENEDICTS CHURCH, IN CRYSTAL RIVER, AS A BACK UP UNIT TO K-9 DEPUTY DEARDEN, WHO WAS ON A TRAFFIC STOP. UPON ARRIVAL, DEPUTY DEARDEN HAD ALREADY MADE CONTACT WITH THE OCCUPANTS OF THE VEHICLE, AT WHICH TIME HE DEPLOYED K-9 TYSON FOR AN EXTERIOR VEHICLE SNIFF. SEE K-9 DEPUTY DEARDENâS SUPPLEMENT FOR FURTHER INFORMATION. K-9 DEPUTY DEARDEN ADVISED ME THAT K-9 TYSON ALERTED TO NARCOTICS INSIDE THE VEHICLE, AT WHICH TIME ALL THREE OCCUPANTS EXITED THE VEHICLE AND WERE PATTED DOWN FOR WEAPONS AND/OR CONTRABAND. I MADE CONTACT WITH A FEMALE THAT WAS IN THE REAR PASSENGER SEAT, AT WHICH TIME SHE STATED THAT HER NAME WAS MS RACHEL LYNN MOON, WITH A DATE OF BIRTH OF 072784. I CONDUCTED A PERSONS CHECK THROUGH TELETYPE FOR THAT NAME AND DATE OF BIRTH TO CHECK FOR WARRANTS AND VERIFY HER IDENTITY, AT WHICH TIME THE RESULTS CAME BACK NEGATIVE FOR A WARRANT. WHILE CONDUCTING A PAT DOWN OF MS MOON, SHE WAS VERY ANXIOUS AND APPEARED TO BE NERVOUS. AFTER PATTING HER DOWN, SHE CONTINUED TO ACT SUSPICIOUS, CONSTANTLY MOVING, AND NOT FOLLOWING DIRECTIONS. MS MOON THEN TOOK HER SWEATSHIRT OFF AND ATTEMPTED TO THROW IT ON THE GROUND, AT WHICH TIME I TOOK IT FROM HER AND OBSERVED A SMALL, PINK IN COLOR, MAKEUP BAG, WHICH HAD BEEN HIDDEN UNDERNEATH HER SWEATSHIRT. IN THE MAKEUP BAG, I LOCATED SEVERAL SMALL PLASTIC BAGGIES, WHICH CONTAINED WHITE POWDER RESIDUE, WHICH LATER TESTED POSITIVE FOR METHAMPHETAMINE UTILIZING AN AGENCY ISSUED PRESUMPTIVE FIELD TEST KIT. ALSO LOCATED IN THE BAG WERE SYRINGES AND A GLASS PIPE COMMONLY USED FOR SMOKING METHAMPHETAMINE. AT THAT TIME, MS MOON WAS HANDCUFFED, (DOUBLE LOCKED) BEHIND HER BACK, AND PLACED IN THE REAR SEAT OF DEPUTY JOHNSONâS PATROL VEHICLE. WHILE TRYING TO VERIFY MS MOONâS IDENTIFICATION USING DRIVER AND VEHICLE INFORMATION DATABASE, I LEARNED THAT THE FEMALE IN THE BACK SEAT WAS NOT MS RACHEL LYNN MOON, BASED ON THE PHOTOGRAPH. AT THAT TIME, THE FEMALE WHO SAID SHE WAS MS MOON, STATED THAT HER REAL NAME WAS MS STEPHANIE JANELLE EDGE, DATE OF BIRTH 121188, AND THAT SHE GAVE HER SISTERâS NAME BECAUSE SHE THOUGHT SHE MIGHT HAVE A WARRANT. AT THAT TIME, DEPUTY JOHNSON TRANSPORTED MS EDGE TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANTâS BOND WAS SET AT $1,000.00 FOR POSSESSION OF DRUG PARAPHERNALIA AND $500.00 FOR PROVIDING FALSE IDENTIFICATION TO A LAW ENFORCEMENT OFFICER. THE DEFENDANTâS TOTAL BOND WAS SET AT $1,500.00, PER THE BOND SCHEDULE. |
