Probable cause affidavit: SUBMITTED BY: liotta, kathleen 0417 (ar11119990) (0120) KNOWINGLY AND UNLAWFULLY PROVIDE HARMFUL MATERIALS TO A MINOR TO WIT: PROVIDE AN ADULT PORNOGRAPHY MAGAZINE TO THE THIRTEEN YEAR OLD MALE VICTIM ON ONE OCCASION AND PROVIDE A DVD CONTAINING ADULT PORNOGRAPHY TO THE SAME VICTIM ON A SEPARATE OCCASION. THE DEFENDANT WAS 27 YEARS OF AGE AT THAT TIME, IN VIOLATION OF FLORIDA STATE STATUTE 847.0133. KNOWINGLY AND UNLAWFULLY COMMIT LEWD AND LASCIVIOUS ACTS WITH THE SAME THIRTEEN YEAR OLD MALE VICTIM TO WIT: SOLICITING THE VICTIM TO ALLOW HIM TO PERFORM ORAL SEX UPON HIM AND SOLICITING THE SAME VICTIM TO PERFORM ORAL SEX UPON THE DEFENDANT. THE DEFENDANT WAS 27 YEARS OF AGE AT THAT TIME, IN VIOLATION OF FLORIDA STATE STATUTE 800.04(6)(2). ON 032411, I BECAME INVOLVED IN AN INVESTIGATION REGARDING UNLAWFUL SEXUAL ACTIVITY WITH A MINOR. WHILE INTERVIEWING THE VICTIM INVOLVED IN THAT CASE, SHE AND THIS VICTIM (IN THIS INVESTIGATION) PROVIDED INFORMATION REGARDING THE DEFENDANT AND HIS LEWD AND LASCIVIOUS BEHAVIOR. THE VICTIM IN THIS INVESTIGATION DISCLOSED THAT THE DEFENDANT WAS CONSTANTLY PROPOSITIONING HIM TO HAVE SEX WITH HIM. THE DEFENDANT WAS 27 YEARS OF AGE AT THAT TIME AND THE VICTIM WAS THIRTEEN YEARS OF AGE. THIS VICTIM DISCLOSED THAT THE DEFENDANT PROVIDED HIM ADULT PORNOGRAPHY AS INDICATED ABOVE ON TWO SEPARATE OCCASIONS. THE VICTIM TOLD ME THAT THE DVD SHOWED ADULT MALES AND FEMALES HAVING SEXUAL INTERCOURSE. HE RECALLED THAT THE TITLE HAD THE WORD "PUSSY" IN IT. THE VICTIM DISCLOSED THAT WHENEVER HE AND THE DEFENDANT WERE ALONE TOGETHER, THE DEFENDANT WOULD SOLICIT HIM FOR ORAL SEX. THE DEFENDANT IS A KNOWN ACQUAINTANCE TO THIS VICTIM AND OFTEN HAD ACCESS TO THE VICTIM. THE VICTIM DESCRIBED HOW HE AND THE DEFENDANT WOULD TAKE RIDES TOGETHER IN THE DEFENDANT'S VEHICLE AND THIS WOULD BE WHEN THE DEFENDANT WOULD SOLICIT SEXUAL ACTIVITY FROM HIM. THE VICTIM DESCRIBED ONE INCIDENT IN PARTICULAR, WHERE HE WAS SITTING IN THE DEFENDANT'S VEHICLE AND THE DEFENDANT WAS ENCOURAGING HIM TO PERFORM SEX ACTS WITH HIM. THE VICTIM STATED THAT HE GOT OUT OF THE SEAT HE WAS IN AND MOVED AWAY FROM THE DEFENDANT. THE VICTIM RELAYED TO ME THAT IF HE HAD NOT STOPPED THE ACTS, THE DEFENDANT WOULD HAVE ACTUALLY PERFORMED ORAL SEX UPON HIM. THE VICTIM DISCLOSED THAT THE SOLICITATION AND THE DEFENDANT PROVIDING HIM HARMFUL MATERIAL OCCURRED IN THE CITY OF CRYSTAL RIVER WITHIN CITRUS COUNTY. HE RECALLS THAT THEY OCCURRED FROM SEPTEMBER OF 2010 THROUGH DECEMBER OF 2010. ON 032811, CONTACT WAS MADE WITH THE DEFENDANT AT HIS RESIDENCE IN CRYSTAL RIVER. HE WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED), AND HE WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION CENTER. ON SAME DATE, I MADE CONTACT WITH THIS DEFENDANT. POST MIRANDA, THE DEFENDANT ADMITTED THAT HE HAD SOLICITED THE VICTIM ON MULTIPLE OCCASIONS. HE ADVISED THAT HE HAD ASKED THE VICTIM TO PERFORM ORAL SEX ON HIM AND ALSO OFFERED TO PERFORM ORAL SEX ON THE VICTIM. HE ADMITTED TO HAVING PROVIDED THE CD AND THE MAGAZINE CONTAINING ADULT PORNOGRAPHY TO THE VICTIM AS WELL. IT BEGAN AROUND MAY OR JUNE OF 2010 (SOLICITATION) AND ENDED APPROXIMATELY TWO WEEKS AFTER THANKSGIVING OF 2010. THE DEFENDANT ADVISED THAT HE WAS A VICTIM OF SOLICITATION WHEN HE WAS A MINOR AND HE HAD REPEATED THE ACTIONS THAT HAD BEEN DONE TO HIM. THE DEFENDANT'S TOTAL BOND WAS SET AT $19,000.00.
