Probable cause affidavit: Unlawfully enter or remain in a certain dwelling with the intent to commit another crime, namely theft, therein and in the course of the burglary did batter a person within the dwelling; to wit: On 01/31/14, the victim reported to the Sheriff’s Office that someone had entered his home without his consent. When he confronted the person (later identified as the co-defendant), the co-defendant demanded money and drugs from him. He told the co-defendant he did not have either. He than armed himself with a guitar and demanded the co-defendant leave. He stated the co-defendant told him he had a gun and he told the co-defendant there was $150 on the dresser. After the co-defendant took the money, a physical altercation occurred. During the altercation, the glass in a picture frame broke and the victim sustained cuts on his leg from the glass. As multiple deputies responded to the area, Dep. Casalvieri observed two subjects walking in the area. As he approached them, the co-defendant ran into the woods and the defendant was caught. He provided the co-defendant’s name and that the co-defendant may go to the defendant’s house. The co-defendant was located there and both were detained until my arrival. The co-defendant was read Miranda and a digitally recorded interview was conducted. The co-defendant stated that he and the defendant discussed how he could get some money. The defendant told him of the victim and how he knew he would have money. They walked to the house and he entered the house, through an unlocked front door. He did not know anyone was home. He was confronted by the victim and he demanded some money. He observed approximately $60 on a dresser and an altercation took place. He denied ever taking the money. The defendant was read Miranda and a digitally recorded interview was conducted. The defendant stated that he and the co-defendant discussed where the co-defendant could get some money. He messaged the victim on Facebook to see if he had any marijuana for sale. When they did not get a reply, they walked to the house. They walked to the victim’s front door but left without knocking. After they walked away, the co-defendant walked back to the victim’s house while he waited for him. After the burglary occurred, they left the area and when the co-defendant gave him his gloves and other clothing he tried to hide it prior to Dep. Caslvieri making contact with him. He later gave consent for the deputies to enter his house and locate the co-defendant as well as the clothing the co-defendant was wearing at the time of the Burglary. The defendant was charged with one count of Burgalry with a Battery and held with no bond as he made statements that when his mother bails him out, he will leave the county and not appear in court.
