Probable cause affidavit: SUBMITTED BY: MARSHALL, AIDAN 0453 (AR08101973) DID OPERATE A VEHICLE IN THE STATE OF FLORIDA AND, HAVING KNOWLEDGE THAT HE HAD BEEN DIRECTED TO STOP SUCH VEHICLE BY A DULY AUTHORIZED LAW ENFORCEMENT OFFICER, DID WILLFULLY REFUSE OR FAIL TO STOP SUCH VEHICLE IN COMPLIANCE WITH SUCH DIRECTIVE, IN VIOLATION OF FLORIDA STATE STATUTE 316.1935(2). DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY MARSHALL, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: BY FLEEING FROM THE VEHICLE ON FOOT NECESSITATING HIS APPREHENSION BY DEPUTY TABB, DEPUTY ROWAND, AND CANINE TUCK, WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: APPROXIMATELY ONE TO TWO GRAMS OF POWDER COCAINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: COCAINE, SAID OBJECT BEING A DOLLAR BILL WITH COCAINE RESIDUE PRESENT AND A MULTICOLORED GLASS PIPE WITH CANNABIS RESIDUE PRESENT , IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B). ON 082908 AT APPROXIMATELY 2010 HOURS, I WAS CONDUCTING TRAFFIC ENFORCEMENT ON WEST HOMOSASSA TRAIL NEAR THE INTERSECTION OF SOUTH MICHIGAN BOULEVARD. WHILE SITTING IN MY VEHICLE ON THE RIGHT OF WAY, I OBSERVED A RED FOUR DOOR CHEVY CORSICA WITH AN INOPERABLE TAG LIGHT PASS ME HEADING WEST ON WEST HOMOSASSA TRAIL. AFTER CATCHING UP TO THE VEHICLE, I ACTIVATED MY EMERGENCY OVERHEAD LIGHTS AND CONDUCTED A TRAFFIC STOP ON THE RED CORSICA BEARING FLORIDA TAG I903WE. THE RED CORSICA CAME TO A STOP NEAR THE INTERSECTION OF WEST HOMOSASSA TRAIL AND SOUTH ILLINOIS TERRACE. AFTER NOTIFYING DISPATCH OF MY TRAFFIC STOP, I EXITED MY VEHICLE AND BEGAN TO APPROACH THE RED CORSICA. WHILE STILL NEAR MY DRIVER'S SIDE DOOR, I OBSERVED THE DRIVER OF THE CORSICA SHIFT THE VEHICLE INTO DRIVE AND BEGIN TO PROCEED FORWARD. I RE-ENTERED MY PATROL VEHICLE, ACTIVATED MY SIREN, AND OBSERVED THE RED CORSICA TO DRIVE OVER THE CURB AND OUT INTO THE ROADWAY NEARLY STRIKING A VEHICLE HEADED WEST ON WEST HOMOSASSA TRAIL. I CONTINUED BEHIND THE VEHICLE WITH BOTH LIGHTS AND SIREN ENGAGED AND ADVISED DISPATCH THE VEHICLE HAD FLED MY TRAFFIC STOP AND I WAS CURRENTLY PURSUING THE RED CORSICA. THE DRIVER CONTINUED WESTBOUND ON WEST HOMOSASSA TRAIL AND ACCELERATED THE VEHICLE TO APPROXIMATELY 45 MILES PER HOUR IN A 30 MILE PER HOUR ZONE. I CONTINUED TO PURSUE THE VEHICLE WHICH TURNED NORTHBOUND ON HIGHWAY 19 AND BEGAN ACCELERATING. AT THIS TIME, I ADVISED SERGEANT GLAZE THAT MY PURSUIT WAS FOR A TRAFFIC OFFENSE AND ASKED IF HE WANTED ME TO DISCONTINUE THE PURSUIT. SERGEANT GLAZE AGREED I SHOULD DISCONTINUE AND I IMMEDIATELY DISENGAGED MY EMERGENCE EQUIPMENT, U-TURNED MY PATROL VEHICLE AND HEADED SOUTH ON HIGHWAY 19. ON 082908 AT APPROXIMATELY 2048 HOURS, I WAS EASTBOUND ON WEST GROVER CLEVELAND BOULEVARD APPROACHING THE INTERSECTION OF SOUTH COLONY TERRACE WHEN I OBSERVED A RED FOUR DOOR CORSICA PASS ME HEADED WEST ON WEST GROVER CLEVELAND BOULEVARD. I TURNED MY PATROL VEHICLE AROUND AND UPON CATCHING UP TO THE VEHICLE OBSERVED THE TAG TO BE I903WE MATCHING THE TAG AND VEHICLE FROM MY EARLIER PURSUIT. AT THIS TIME, I ADVISED SERGEANT GLAZE THAT I WAS BEHIND THE VEHICLE AND CURRENTLY DRIVING THE SPEED LIMIT WESTBOUND ON WEST GROVER CLEVELAND BOULEVARD. I CONTINUED TO FOLLOW THE VEHICLE WHILE BACK-UP WAS DISPATCHED TO MY GENERAL LOCATION. THE RED CORSICA MADE A RIGHT TURN ON SOUTH OHIO AVENUE AND THEN TURNED RIGHT ON WEST HOMOSASSA TRAIL HEADING EASTBOUND. AT THIS TIME, I NOTIFIED SERGEANT GLAZE THAT THE VEHICLE HAD INCREASED HIS SPEED TO APPROXIMATELY 65 MILES PER HOUR IN A 45 MILE PER HOUR ZONE AND PASSED A VEHICLE ON THE LEFT SIDE ALMOST COLLIDING WITH ON-COMING TRAFFIC. DUE TO THE RED CORSICA PUTTING THE LIVES OF THE GENERAL PUBLIC AT RISK, I INITIATED MY EMERGENCY LIGHTS AND SIREN AND ATTEMPTED TO CONDUCT A TRAFFIC STOP. THE RED CORSICA INCREASED ITS SPEED AND I BEGAN TO AGAIN PURSUE THE VEHICLE. I CONTINUED TO PURSUE THE VEHICLE AT VARIABLE SPEEDS ABOVE THE SPEED LIMIT BUT NOT REACHING MORE THAT 75 TO 80 MILES PER HOUR. THE RED CORSICA CONTINUED EASTBOUND ON HOMOSASSA TRAIL AND TURNED NORTH ON SOUTH ROCK CRUSHER ROAD. NEAR THE INTERSECTION OF SOUTH ROCK CRUSHER ROAD AND WEST ORANGE LANE, CORPORAL BONURA DEPLOYED HIS AGENCY ISSUED STOP STICKS TIRE DEFLATION DEVICE. THE STOP STICKS EFFECTIVELY PUNCTURED THE FRONT PASSENGER TIRE AND THE VEHICLE CONTINUED TO THE INTERSECTION OF HIGHWAY 44 AND SOUTH ROCK CRUSHER ROAD WHERE IT TURNED WEST ON HIGHWAY 44. THE RED CORSICA CONTINUED ON HIGHWAY 44 WHILE LOSING ITS COMPLETE FRONT PASSENGER TIRE AND WAS RIDING ON THE RIM. AT THE INTERSECTION OF HIGHWAY 44 AND HIGHWAY 19, THE VEHICLE TURNED NORTHBOUND ON HIGHWAY 19. AS THE RED CORSICA APPROACHED THE CRYSTAL RIVER MALL, IT BEGAN SMOKING HEAVILY AND MADE A RIGHT HAND TURN OVER THE SIDEWALK AND INTO THE PARKING LOT OF THE MALL. THE MALE DRIVER, LATER IDENTIFIED AS THE DEFENDANT MR STEVEN M MANGO, BAILED OUT OF THE VEHICLE ON FOOT AND BEGAN RUNNING THROUGH THE PARKING LOT TOWARDS THE MALL. AT THIS TIME, THE DEFENDANT MR STEVEN MANGO WAS APPREHENDED SIMULTANEOUSLY BY DEPUTY TABB, CANINE DEPUTY ROWAND, AND CANINE TUCK. I SECURED THE DEFENDANT MR MANGO IN HANDCUFFS (DOUBLE-LOCKED) BEHIND HIS BACK. A PAT DOWN SEARCH YIELDED A PLASTIC BAGGIE CONTAINING APPROXIMATELY 10 GRAMS OF CANNABIS AND A MULTICOLORED GLASS PIPE WHICH CONTAINED CANNABIS RESIDUE. THE CANNABIS WAS FIELD TESTED WITH A POSITIVE RESULT FOR CANNABIS. A SEARCH OF THE DEFENDANT'S VEHICLE BY DEPUTY B LAMBERT (SEE DEPUTY LAMBERT'S SUPPLEMENT) WAS CONDUCTED AND YIELDED APPROXIMATELY 1-2 GRAMS OF POWDER COCAINE WHICH HAD SPILLED OUT OF A PLASTIC BAGGIE. ALSO LOCATED IN THE VEHICLE WAS A ROLLED UP DOLLAR BILL CONTAINING COCAINE RESIDUE COMMONLY USED TO SNORT COCAINE. THE DEFENDANT RECEIVED A SCRATCH ON HIS RIGHT ARM FROM CANINE TUCK WHICH DID NOT BREAK THE SKIN AND MR MANGO REFUSED ALL MEDICAL TREATMENT. THE DEFENDANT WAS NEXT PLACED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT WAS READ MIRANDA VIA PREPRINTED CARD AND ADVISED HE UNDERSTOOD AND WISHED TO SPEAK TO THIS DEPUTY. THE DEFENDANT STATED TO ME THAT HE WAS DRIVING AROUND "MESSED UP" ON COCAINE AND MARIJUANA AND THAT HE WAS SCARED TO STOP FOR THIS DEPUTY. MR MANGO ADMITTED TO DRIVING THE RED CORSICA THE FIRST TIME I INITIALLY PURSUED HIM AT 2010 HOURS. DEPUTY B LAMBERT PHOTOGRAPHED AND PROCESSED THE SCENE AND LATER TURNED THE COCAINE AND PARAPHERNALIA INTO THE CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE DIVISION. I LATER TURNED IN THE CANNABIS, PIPE, AND "DVD" RECORDING OF THE PURSUIT INTO THE CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE DIVISION. THE DEFENDANT WAS ISSUED TWO UNIFORM TRAFFIC CITATIONS FOR FLEEING AND ELUDING, ONE CITATION EACH FOR CARELESS DRIVING, FAILURE TO OBEY A TRAFFIC CONTROL DEVICE, AND NO TAG LIGHT. THE DEFENDANT'S BOND WAS SET AT $14,000 BOND PER THE BOND SCHEDULE. *NOT-EXEMPT*
