| Probable cause affidavit: | SUBMITTED BY: CRANE, RYAN N223 FWC (AR14-10964) On 062614 At approximately 2030 HOURS, I, OfFICER Ryan Crane of the Florida Fish and Wildlife Conservation Commission (FWC) was on water patrol on the Homosassa River when I responded to a call for backup by OfFICER Thomas Reid (FWC) who was at Magic Manatee Marina. Once on scene, I observed OfFICER Reid conducting field sobriety tasks with a white male (MR Matthew Cooper, DOB 081492). LIEUTENANT Loyed warned me about one of the passengers on the vessel (MR Steven Charles Winburn, FLORIDA IDENTIFICATION W516-783-84-335-0) who was agitated and displaying signs of intoxication. MR Winburn repeatedly stated that he was going to take Cooperâs vessel back to the Chassahowitzka River. I stated to MR Winburn that the vessel was being towed and impounded and that we had arranged for a ride to come pick him up. MR Winburn continued to display agitated behavior and use profanity in close proximity to children who were at the Marina. MR Winburn repeatedly kept saying he was going to take the boat after being told the boat was being impounded. MR Cooper was escorted to a Citrus County Sheriffâs deputy patrol VEHICLE after being placed under arrest for boating under the influence. MR Winburn followed the deputy to the vehicle and kept telling MR Cooper he was going to take the boat home for him. I made contact with MR Winburn and again stated to him that the vessel was being towed and that he would not be able to operate the vessel due to the odor of alcohol on his person and the visible signs of intoxication he was showing. MR Winburn started to walk towards the vessel and I told him he was not to goING to the vessel and should head towards the road where his ride was going to pick him up. MR Winburn refused to do so. I stated clearly to MR Winburn he was under arrest for continuing to interfere with our investigation, in violation of State Statute 379.3311(3). |
