Probable cause affidavit: SUBMITTED BY: COLEMAN, BRIAN 0247 (AR08103463) Since December OF 2007, numerous burglaries had occurred within Citrus County involving the theft of copper wire from numerous business and residences. These include a residence located at 12979 WEST Checkerberry Drive (REFERENCE CASE NUMBER 07120081), business Central Maintenance Welding IncORPORATED, located at 11450 WEST Curtis Tool (REFERENCE case NUMBER 08020800), business Progress Energy, located at 11600 WEST Power Line Street (REFERENCE case 08040763), business Crystal River Quarries, located at 7040 NORTH Suncoast BOULEVARD and residence located at 11444 WEST Cornflower Drive (REFERENCE CASE NUMBER 08031097). Information had been obtained through investigative techniques showing that MR Wesley Foley (CO-DEFENDANT), MS Tabitha Crain (DEFENDANT) and other co-defendants had been involved in these burglaries and thefts. On 052908 at approximately 0845 hours, Officers of the CITRUS COUNTY SHERIFF'S OFFICE responded to the residence of MR Wesley Foley, at which time, contact was made. Contact was also made with MS Tabitha Crain at her residence at which time she agreed to come to the Crystal River Sub Station for an interview. MR Foley was interviewed at his residence by Deputies Coleman and S Smith, at which time he was read Miranda Via card AND agreed to SPEAK WITH US. At thAT time, MR Foley admitted to going to the Progress Energy location and entering a train locomotive, WHERE he stole the copper wire from within the train. While cutting the wire to the train, the damage incurred was in excess of $2,000.00. He also advised that MS Crain had driven him to the location and had also picked him up afterwards, hence assisting with the crime. MR Foley also admitted to cleaning up the wire by removing the coverings and then selling the stolen wire to different recycling business within the county. MR Foley also advised that he had entered the property of Crystal River Quarries at least 6 times and had stolen a large quantity of copper wire, which he had also stripped and later sold. MR Foley also advised that he had stripped wire from different machinery, including a crusher located within the NORTHEAST part of the mine contained within a fenced in area. This removing of the wire caused the machinery to become unusable, damage in excess of $2,000.00. MR Foley also advised that MS Crain had driven him to the Quarries at least once and that she was well aware of his intentions to steal the copper. MR Foley then admitted to entering the property of Central Maintenance Welding IncORPORATED by cutting a hole through the fence, entering the property and cutting some copper welding cables off the welding machines. He also took the casings off the wire and later sold it. MR Foley again advised that Crain had driven him and picked him up at the location and knew of his intent. MR Foley also admittED to entering two different residences located on Cornflower DRIVE and Checkerberry DRIVE, at which time he cut copper wire from the interior of the residence, removed the casings and later sold the copper to local recyclers. Damage caused by the theft was approximately $2,000.00 at Cornflower DRIVE and $10,000 at Checkerberry DRIVE. This copper wire was later stripped and sold. MR Foley again admitted that MS Crain had been involved in driving him to and from both locations. This interview was recorded. MR Foley then took both Deputies to a location off NORTH Dawn Flower POINt where he had advised he had removed the casings from the wire. Upon arriving, we could see numerous of wire casings which he had advised were from the burglaries listed above. Contact was also made with MS Tabitha Crain at which time Miranda was also read via card. MS Crain agreed to talk and advised the she drove MR Foley and co-defendants to the above five (5) locations at least one time and that she was well aware of MR Foley's intent to steal the copper wire. MS Crain further advised that after dropping off MR Foley, she would depart, drive around and await his TELEphone call before going back to pick him up. MS Crain also advised that she had sold some of the copper wire to the recyclers, knowing that it was stolen. This interview was also recorded. Prior to this date, numerous receipts were located for MR Foley at different recyclers within the county showing thousands of dollars of sold copper wire. THE DEFENDANTS WERE PLACED UNDER ARREST HANDCUFFED (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. MR FOLEY'S BOND WAS SET AT $2,000.00 FOR THE CHARGE OF BURGLARY TO A CONVEYANCE AND HE WAS RELEASED ON HIS OWN RECOGNIZANCE REFERENCE ALL OTHER CHARGES. MS CRAIN WAS RELEASED ON HER OWN RECOGNIZANCE. *NOT-EXEMPT*
