SUBMITTED BY: LYNN, KURT 0349 (AR08105438) ON 092808, I WAS PATROLLING ON FOOT IN THE PARKING LOT AREA OF ROC'S 491 AND FERRARA'S DELI, DUE TO SEVERAL FIGHTS THAT BROKE OUT IN the ROC'S PARKING LOT AREA. UPON DOING SO, I OBSERVED A BLOND FEMALE, WHO WAS LATER IDENTIFIED AS the DEFENDANT, MS TAHISHA JONES, WALKING THROUGH THE PARKING LOT WITH A CUP CONTAINING LIQUID and A STRAW. THE DEFENDANT WAS STUMBLING AND FALLING, AND TALKING LOUDLY WITH SLURRED SPEECH TO ANYONE WHO WAS LISTENING. SHE STUMBLED SEVERAL TIMES IN FRONT OF FERRARA'S DELI AND THEN CONTINUED TO A DARK COLORED FORD TAURUS. THE DEFENDANT THEN ENTERED the DRIVER'S SEAT, PLACED THE CUP IN the CENTER CONSOLE and TURNED ON the IGNITION OF THE VEHICLE. AFTER OBSERVING THE DEFENDANT WALKING THROUGH THE PARKING LOT, AND DETERMINING THAT SHE WAS POSSIBLY INTOXICATED, I WALKED OVER TO THE VEHICLE and ASKED her TO SHUT OFF THE VEHICLE. I THEN ASKED THE DEFENDANT IF the DRINK IN the CENTER CONSOLE WAS ALCOHOLIC, TO WHICH SHE REPLIED WITH LOUD HAPPINESS "IT'S A LONG ISLAND ICE TEA." DURING this TIME SHE SPOKE WITH SLURRED CONFUSED SPEECH and THE ODOR OF ALCOHOL COMING FROM her AS SHE SPOKE WAS EXTRA HEAVY. I AGAIN ADVISED THE DEFENDANT TO TURN OFF THE VEHICLE, TO WHICH SHE STATED, "I LIVE ON OSCEOLA, I CAN MAKE IT HOME." I THEN ASKED HER TO STEP OUT OF THE VEHICLE AND PROMPTLY BEGAN FIELD SOBRIETY TASKS. FIRST TASK, HORIZONTAL GAZE NYSTAGMUS. THE DEFENDANT DISPLAYED ONSET AND DISTINCT NYSTAGMUS IN BOTH EYES AND THE LACK OF ABILITY OF SMOOTH PURSUIT IN BOTH EYES. SHE DISPLACED VERY POOR BALANCE and WAS UNABLE TO STAND UP STRAIGHT. SECOND TASK WAS THE, ONE LEG STAND. this TASK WAS DEMONSTRATED TO HER, PRIOR TO HER BEING ASKED TO PERFORM THE TASK. DURING THE TASK THE DEFENDANT LOST BALANCE, TRIED TO BEGIN BEFORE THE INSTRUCTIONS WERE FINISHED, FELL OVER ONTO THE TRUNK OF HER VEHICLE, and SET HER FOOT DOWN NUMEROUS TIMES. THE DEFENDANT ALSO HAD DIFFICULTY PRONOUNCING THE WORDS, ONE, ONE THOUSAND, TWO, TWO ONE THOUSAND, and THREE ETCETERA. THIRD TASK WAS THE FINGER TO NOSE. DURING this TASK, THE DEFENDANT DID NOT KEEP HER EYES CLOSED. SHE FAILED TO POINT FORWARD PRIOR TO TOUCHING her NOSE, FAILED TO RETURN HER ARMS TO HER SIDE, and INSTEAD OF TOUCHING her NOSE WITH HER INDEX FINGER, SHE TOUCHED HER UPPER LIP AND RIGHT CHEEK. THE DEFENDANT ALSO WOULD NOT STOP TALKING DURING this TASK. The DEFENDANT WAS THEN INFORMED THAT SHE WAS BEING PLACED UNDER ARREST FOR DRIVING UNDER THE INFLUENCE (DUI), and WAS PLACED IN HAND RESTRAINTS BEHIND her back (DOUBLE-LOCKED). HER VEHICLE WAS THEN SEARCHED INCIDENT TO ARREST. IN THE DEFENDANT'S PURSE, A CLEAR UNLABELED PRESCRIPTION BOTTLE WAS FOUND CONTAINING FOUR DIFFERENT TYPES OF PILLS. TWO OF THE PILLS WERE WHITE AND RECTANGULAR TWO MILLIGRAM XANAX, WHICH IS A CONTROLLED SUBSTANCE. THE other THREE TYPES WERE PRESCRIPTION PILLS THAT ARE NOT CONSIDERED CONTROLLED SUBSTANCES BUT ARE AVAILABLE ONLY BY PRESCRIPTION, AND CAN ONLY BE POSSESSED WITH A VALID PRESCRIPTION. PRIOR TO LEAVING the SCENE, THE DEFENDANT'S VEHICLE WAS TURNED OVER TO HER MOTHER, PER HER REQUEST. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY, WHERE she WAS OFFERED AN INTOXILYZER TEST BY CERTIFIED OPERATOR WHICH SHE REFUSED. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION NUMBER 8851-RHU, FOR POSSESSION OF OPEN CONTAINER BY DRIVER. CITATION NUMBER 83192ELU, FOR POSSESSION OF TWO VALID DRIVER'S LICENSES FROM TWO STATES AT the SAME TIME, AND 8235-XBD FOR DUI. THE DEFENDANT WAS EXTREMELY ARGUMENTATIVE AND DISRESPECTFUL TO CCA STAFF AND THIS DEPUTY. THE DEFENDANT ALSO REFUSED TO SIGN ANY OF THE CITATIONS THAT WERE PRESENTED TO HER, EVEN AFTER BEING EXPLAINED THEY WERE JUST SIGNATURES STATING THAT SHE HAD RECEIVED A COPY OF THE SUMMONS.
