Probable cause affidavit: | SUBMITTED BY: HUGHES, JAMES 0500 (AR2012-1691) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: COCAINE (APPROXIMATELY .5 GRAMS), IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 062212, AT APPROXIMATELY 1900 HOURS, WHILE ON PATROL in the AREA OF HOMOSASSA, I OBSERVED A SILVER FOUR DOOR VEHICLE EXIT THE RACE TRAC GAS STATION PARKING LOT AND HEAD NORTHBOUND ON SOUTH SUNCOAST BOULEVARD. UPON THAT VEHICLE EXITING THE RACE TRAC PARKING LOT IT FAILED TO STOP FOR THE STOP SIGN. AT THAT TIME I GOT BEHIND THE VEHICLE AND ACTIVATED MY EMERGENCY LIGHTS AT THE INTERSECTION OF SOUTH SUNCOAST BOULEVARD AND WEST JUMP COURT. UPON MAKING CONTACT WITH THE DRIVER, LATER IDENTIFIED AS MS TAMARA JUDGE, I ADVISED HER I HAD STOPPED HER FOR NOT STOPPING AT THE STOP SIGN, AND SHE ADVISED SHE UNDERSTOOD AND SHE DID NOT STOP BECAUSE THERE WAS NO TRAFFIC COMING. AT THAT TIME I REQUESTED HER LICENSE, REGISTRATION, AND PROOF OF INSURANCE, WHICH SHE PROVIDED TO ME. I ALSO OBSERVED A WHITE FEMALE PASSENGER LATER IDENTIFIED AS MS MERRY FLAHERTY, WHICH I ALSO ASKED IF SHE HAD HER DRIVERâS LICENSE ON HER, AT THAT TIME SHE ADVISED SHE DID AND PROVIDED IT TO THIS DEPUTY. AT THAT TIME CANINE DEPUTY HRYC ARRIVED ON SCENE. I WENT BACK TO MY PATROL VEHICLE AND RAN BOTH TAMARA AND MERRYâS INFORMATION IN FCIC/NCIC WHICH MET WITH NEGATIVE RESULTS. CANINE DEPUTY HRYC PERFORMED AN EXTERIOR SNIFF OF THE VEHICLE WHERE HE ADVISED HIS CANINE HAD ALERTED ON THE VEHICLE. AT THAT TIME BOTH TAMARA AND MERRY WERE ASKED TO EXIT THE VEHICLE WHERE I CONTINUED TALKING WITH THEM IN FRONT OF MY PATROL VEHICLE, WHILE DEPUTY HRYC PERFORMED A SEARCH OF THE INTERIOR OF THE VEHICLE. WHILE ON THE PASSENGER SIDE OF THE VEHICLE DEPUTY HRYC HAD LOCATED A BLACK PURSE WHICH HE ASKED MERRY IF IT WAS HER PURSE AND IF HE COULD LOOK INSIDE OF IT. SHE ADVISED IT WAS HER PURSE AND YES, HE COULD LOOK INSIDE IT. LOCATED IN THE PURSE, DEPUTY HRYC FOUND A CLEAR BAGGIE WITH A WHITE SUBSTANCE WHICH APPEARED TO BE CONSISTENT WITH COCAINE. AT THAT TIME MERRY WAS DETAINED AND PLACED IN THE REAR SEAT OF MY PATROL VEHICLE. AS DEPUTY HRYC PROCEEDED TO THE DRIVERâS SIDE OF THE VEHICLE HE LOCATED A YELLOW BAG, WHICH HE ASKED TAMARA IF IT WAS HERS, AND SHE ADVISED IT WAS. HE ASKED IF HE COULD LOOK IN IT AND SHE ADVISED HE COULD. LOCATED IN THE SIDE ZIPPER POCKET WAS A CLEAR PLASTIC BAGGIE with a WHITE POWDERY SUBSTANCE, CONSISTENT WITH COCAINE. AT THAT TIME MS TAMARA JUDGE WAS DETAINED AND PLACED IN THE REAR SEAT OF MY PATROL VEHICLE. BOTH BAGGIES FIELD TESTED POSITIVE FOR COCAINE. MS JUDGEâS BAGGIE WEIGHED IN AT APPROXIMATELY .5 GRAMS AND MS FLAHERTYâS BAGGIE WEIGHED IN AT APPROXIMATELY 5.5 GRAMS. BOTH BAGGIES WERE COLLECTED AND WILL BE TURNED OVER FOR EVIDENCE. AT THAT TIME MS JUDGE AND MS FLAHERTY WERE ADVISED THEY WERE BEING PLACED UNDER ARREST FOR POSSESSION OF COCAINE. THE VEHICLE WAS TOWED BY ADAMS TOWING. MS JUDGE WAS ISSUED A TRAFFIC WARNING NUMBER 326870-B FOR RUNNING A STOP SIGN. MS JUDGEâS BOND SET AT $5,000.00 PER THE BOND SCHEDULE. MS FLAHERTYâS BOND SET AT $5,000.00 PER THE BOND SCHEDULE. |
