SUBMITTED BY: COOK, JASON 1333 (AR17-23518) \t\t LECOMPTE, PHILLIP 1457\t DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WALMART, TO WIT: A FOOD PROCESSOR AND BAGS (VALUED AT $203.00), CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF MORE THAN $100.00 BUT LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(2(E). ON 042017 AT APPROXIMATELY 1720 HOURS, I WAS DISPATCHED TO WAL-MART LOCATED AT 2461 EAST GULF TO LAKE HIGHWAY, IN INVERNESS, IN REFERENCE TO A RETAIL THEFT. UPON MY ARRIVAL, I MADE CONTACT WITH THE LOSS PREVENTION OFFICER/COMPLAINANT, MR JOSEPH COMPOSTELLA, WHO STATED THAT AN UNKNOWN MALE IN PLAID SHORTS AND A GRAY SHIRT, LATER IDENTIFIED AS THE DEFENDANT, MR TERRENCE SLACK, ENTERED THE STORE ACTING SUSPICIOUS. THE COMPLAINANT STATED HE OBSERVED THE DEFENDANT PLACE A FOOD SAVER FOOD PROCESSING MACHINE, WITH A BOX OF FOOD PROCESSOR BAGS (VALUED AT APPROXIMATELY $203.00), IN A SHOPPING CART AND PROCEED TO THE FRONT OF THE STORE. THE COMPLAINANT STATED THE DEFENDANT THEN EXITED THE STORE, PASSING ALL POINTS OF SALE WITHOUT ATTEMPTING TO PAY FOR THE MERCHANDISE. THE COMPLAINANT THEN IDENTIFIED HIMSELF TO THE DEFENDANT AS BEING A WAL-MART LOSS PREVENTION OFFICER AND EXPLAINED WHY HE HAD STOPPED HIM. AT THAT TIME, THE DEFENDANT FLED THE STORE LEAVING THE MERCHANDISE BEHIND. THE COMPLAINANT STATED THAT THE DEFENDANT LEFT IN A LINCOLN TOWN CAR, WITH A WHITE TOP AND CHROME RIMS, BEARING FLORIDA LICENSE PLATE ECZC65. I REVIEWED THE SECURITY CAMERA FOOTAGE WITH THE COMPLAINANT AND OBSERVED THE DEFENDANT PUT THE MERCHANDISE IN HIS SHOPPING CART. THE DEFENDANT THEN GOT A BAG FROM A REGISTER AND PLACED THE MERCHANDISE INSIDE THE BAG. THE DEFENDANT THEN WENT TO A REGISTER AND BOUGHT A PACK OF CIGARETTES WITHOUT PAYING FOR THE FOOD SAVER ITEM. THE DEFENDANT THEN ATTEMPTED TO LEAVE THE STORE WITHOUT PAYING FOR THE MERCHANDISE THAT WAS IN THE BAG, PASSING ALL POINTS OF SALE, AT WHICH TIME THE COMPLAINANT MADE CONTACT WITH THE DEFENDANT. AT THAT TIME, THE DEFENDANT FLED THE STORE WITHOUT THE MERCHANDISE. DEPUTY SHERIFF TRAINEE (DST) MISSION (1458) OBSERVED THE SUSPECT VEHICLE TRAVELING WEST ON HIGHWAY 44 AND CONDUCTED A TRAFFIC STOP. UPON MAKING CONTACT, DST MISSION OBSERVED THAT THE PASSENGER MET THE DESCRIPTION OF THE DEFENDANT. AT THAT TIME, THE DEFENDANT WAS DETAINED FOR FURTHER INVESTIGATION; SEE SUPPLEMENT FOR FURTHER. I MADE CONTACT WITH THE DEFENDANT AT THE INTERSECTION OF WEST GULF TO LAKE HIGHWAY AND SOUTH LECANTO HIGHWAY WHERE DST MISSION HAD CONDUCTED THE TRAFFIC STOP. THE DEFENDANT PROVIDED A WRITTEN STATEMENT, WHICH STATED THAT HE WAS AT WAL-MART AND PUT A FOOD SAVER AND BOX OF BAGS IN HIS SHOPPING CART. THE DEFENDANT STATED THAT WHEN HE GOT TO THE REGISTER TO PAY FOR IT HE REALIZED THAT HE DID NOT HAVE ENOUGH MONEY ON A GIFT CARD TO PAY FOR THE MERCHANDISE; THEREFORE, HE PUSHED THE SHOPPING CART TOWARDS THE ENTRANCE OF THE STORE. THE DEFENDANT STATED HE WAS CONFRONTED BY TWO INDIVIDUALS THAT HE DID NOT KNOW AND HE TOLD THEM ââCALL THE COPSââ AND THEN WALKED BACK INTO THE STORE. THE DEFENDANT STATED THAT HE FELT THREATENED, LEFT THE ITEMS IN THE CART, AND EXITED THE STORE. AT THAT TIME, I INFORMED THE DEFENDANT THAT HE WAS UNDER ARREST. THE DEFENDANT WAS PLACED IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK, SECURED IN THE REAR OF MY PATROL VEHICLE, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANTâS BOND WAS SET AT $1,000.00 PER THE BOND SCHEDULE. |
