SUBMITTED BY: COX, ANDY 0543 (AR07005119) did unlawfully and knowingly attach to a motor vehicle or mobile home, to-wit: 1997 TOYOTA CAMRY, a license plate or validation sticker to the plate not issued and assigned or lawfully transferred to such vehicle, in violation of Florida Statute 320.261 AND DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: HEROIN SAID OBJECT BEING A HYPODERMIC SYRINGE NEEDLE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147 AND DID KNOWINGLY AND UNLAWFULLY OPERATE A MOTOR VEHICLE WHILE HER DRIVER'S WAS EXPIRED FOR MORE THAN FOUR MONTHS IN VIOLATION OF FLORIDA STATE STATUTE 322.03. ON 091507 AT APPROXIMATELY 0800 HOURS, I OBSERVED A PEWTER COLORED FOUR DOOR TOYOTA CAMRY DISPLAYING FLORIDA TAG F16HEZ, PULLING IN TO RICK'S GAS AT 8350 SOUTH FLORIDA AVENUE, NEXT TO THE PAY TELEPHONE. I OBSERVED THE TAG HAD EXPIRED ON 0806. I MADE CONTACT WITH THE DRIVER/DEFENDANT, MS TERRI NIDA, AS SHE EXITED THE VEHICLE AND ASKED FOR HER DRIVER'S LICENSE, REGISTRATION AND PROOF OF INSURANCE. SHE PROVIDED THIS DEPUTY WITH A FLORIDA IDENTIFICATION CARD AND EXPLAINED THAT SHE ONLY DROVE THE VEHICLE A FEW BLOCKS AND WAS ATTEMPTING TO SELL THE VEHICLE. I ASKED AGAIN FOR THE PROOF OF REGISTRATION AND PROOF OF INSURANCE AND SHE STATED SHE DID NOT HAVE EITHER. I ASKED WHO THE VEHICLE BELONGED TO AND SHE STATED HER BOYFRIEND'S EX-WIFE, WHO SHE ONLY KNEW BY THE NAME OF DEBORAH AND DID NOT HAVE A TITLE OR ANY OTHER PAPERWORK FOR THE VEHICLE. I ASKED HER IF SHE HAD ANYTHING IN THE VEHICLE NEEDED TO KNOW ABOUT, TO WHICH SHE STATED NO. I ASKED THE DEFENDANT IF SHE WOULD MIND ME SEARCHING HER VEHICLE AND HER PURSE, TO WHICH SHE ADVISED YES, I COULD SEARCH THE VEHICLE AND HER PURSE. THERE WAS A WHITE FEMALE PASSENGER SITTING IN THE PASSENGER SEAT. I ASKED THE FEMALE PASSENGER TO STEP OUT OF THE VEHICLE. AS I SEARCHED THE VEHICLE, I LOCATED A NEEDLE AND SYRINGE IN BETWEEN THE DRIVER'S SEAT AND THE CENTER CONSOLE. I LOCATED NO OTHER DRUG PARAPHERNALIA OR CONTRABAND IN THE VEHICLE OR HER PURSE. THE DEFENDANT HAD SEVERAL RECENT TRACK MARKS ON HER ARMS AND LEGS. I READ THE DEFENDANT MIRANDA FROM THE PRE PRINTED AGENCY CARD AND ADVISED HER SHE WAS UNDER ARREST FOR DRIVING WITHOUT A FLORIDA DRIVER'S LICENSE, EXPIRED BY MORE THAN FOUR MONTHS, ATTACHING A TAG NOT ASSIGNED AND POSSESSION OF DRUG PARAPHERNALIA. THE DEFENDANT ADVISED SHE UNDERSTOOD HER RIGHTS AND WOULD SPEAK WITH THIS DEPUTY. I ASKED HER ABOUT THE NEEDLE AND SYRINGE IN THE VEHICLE AND SHE ADVISED SHE DID NOT KNOW IT WAS THERE. I ASKED HER ABOUT ALL THE TRACK MARKS ON HER ARMS AND LEGS, TO WHICH SHE STATED SHE WAS IN THE HOSPITAL A YEAR AGO AND THAT WAS WHAT THE TRACK MARKS WERE FROM. THE SEVERAL DIFFERENT TRACK MARKS WERE IN VARIOUS STAGES OF HEALING, SOME STILL OOZING, OTHERS SCABBED OVER. I ASKED HER WHY SHE HAD AN IMPROPER TAG ON THE VEHICLE, TO WHICH SHE STATED SHE WAS TRYING TO SELL THE VEHICLE DID NOT HAVE A TAG FOR IT, AND FIGURED SHE WOULD JUST PUT THIS TAG ON THE VEHICLE. I ASKED HER IF SHE KNEW SHE DID NOT HAVE A FLORIDA DRIVER'S LICENSE AND SHE STATED YES, IT HAD BEEN EXPIRED FOR MORE THAN TWO YEARS. TELETYPE AND THIS DEPUTY ATTEMPTED TO CONTACT THE OWNER OF THE VEHICLE WITH NEGATIVE RESULTS. THE VEHICLE WAS TOWED BY SCALLY'S TOWING TO SAFE GUARD FOR THE OWNER. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY, WHERE SHE WAS BOOKED, PROCESSED AND HELD ON $1,500.00 BOND PER THE BOND SCHEDULE. *NOT-EXEMPT* |
