SUBMITTED BY: SETTLES, KATHERINE 0113 (AR13-7683) DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). ON 101613, I MADE CONTACT WITH MR KEN PATEL AT RV LOT NUMBER 4 IN THE BELL VILLA MOBILE HOME PARK. I OBSERVED A WHITE MALE SITTING ON THE FRONT STEP OF THE RV. MR PATEL ADVISED ME THAT THE DEFENDANT, WHO HE IDENTIFIED AS MR TERRY KLEIN, HAD BEEN EVICTED FROM RV NUMBER 4 THIS MORNING AND MR PATEL HAD THE KEY FOR THE RV. HE ADVISED THAT THE DEFENDANT WAS EVICTED FOR BEING LOUD AND ABUSIVE. THE DEFENDANT TOLD MR PATEL THAT HE WOULD BE GETTING A HOLD OF HIS MOTORCYCLE BUDDIES AND THEY WOULD BE COMING THROUGH THE PARK AND CLEARING EVERYTHING AWAY. MR PATEL ADVISED THAT ONCE THE DEFENDANT TURNED HIS KEY IN AFTER BEING EVICTED, HE INFORMED HIM THAT IF HE WAS ABLE TO GET A VEHICLE, HE WOULD BE ALLOWED TO COME BACK TO OBTAIN HIS PROPERTY OUT OF THE RV. MR PATEL ADVISED THAT THE DEFENDANT SHOWED UP THIS EVENING IN A CAB, WHICH HAD ALREADY LEFT, AND HE WANTED HIS PROPERTY. UPON SPEAKING WITH THE DEFENDANT, I OBSERVED THAT HE HAD A STRONG SMELL OF AN ALCOHOLIC BEVERAGE EMITTING FROM HIS PERSON, HIS FACE WAS VERY FLUSHED AND HE WAS VERY UNSTEADY ON HIS FEET. THE DEFENDANT PROVIDED ME WITH A PHONE NUMBER FOR HIS SISTER; HOWEVER NO ONE ANSWERED. I INFORMED HIM THAT MR PATEL AGREED THAT IF HE COULD MAKE ARRANGEMENTS TOMORROW FOR A VEHICLE, HE COULD COME OUT WHILE HE WAS SOBER AND OBTAIN HIS PROPERTY. HE THEN ASKED IF I WOULD GIVE HIM A RIDE TO STAY SOMEWHERE FOR THE NIGHT. I AGREED TO GIVE HIM A RIDE; HOWEVER I ADVISED HIM THAT I HAD TO DO A PAT DOWN FOR OFFICER SAFETY, WHICH HE AGREED TO. UPON CHECKING HIS FRONT RIGHT POCKET, I LOCATED A BLUE RAG AND A FOUR INCH FOLDING KNIFE. INSIDE THE BLUE RAG WAS A CLEAR BAG CONTAINING A DRIED BROWN LEAFY SUBSTANCE WHICH WAS CONSISTENT WITH MARIJUANA. THE LEAFY SUBSTANCE INSIDE THE BAGGIE HAD A STRONG ODOR ABOUT IT. UPON FINISHING THE PAT DOWN, ANOTHER FOUR INCH FOLDING KNIFE WAS REMOVED FROM HIS BACK POCKET, ALONG WITH A FOLD UP MULTI-TOOL. THE DEFENDANT WAS PLACED UNDER ARREST FOR POSSESSION OF MARIJUANA UNDER 20 GRAMS, HANDCUFFED, (DOUBLE LOCKED), BEHIND HIS BACK, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. WHILE EN ROUTE TO THE JAIL, I INQUIRED IF HE WAS AFFILIATED WITH ANY GANG MEMBERS BECAUSE HE WAS WEARING A âSUPPORT YOUR LOCAL BLACK PISTONSâ T-SHIRT, WHERE HE ADVISED NO, HE BOUGHT IT AT WALMART. UPON ARRIVAL AT THE JAIL, THE DEFENDANT'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE THE MARIJUANA WAS PACKAGED AND TURNED IN TO EVIDENCE. |
