Probable cause affidavit: | SUBMITTED BY: SCHAFFER, HEATH 0652 (AR14-12765) (14-154562) ON 111114 AT APPROXIMATELY 1830 HOURS, WHILE CONDUCTING TRAFFIC ENFORCEMENT IN THE AREA OF BEVERLY HILLS BOULEVARD AND SOUTH WASHINGTON STREET, I OBSERVED A WHITE MALE, LATER IDENTIFIED AS the DEFENDANT, MR THOMAS BRANTLEY, RIDING HIS BICYCLE NORTHBOUND ON SOUTH WASHINGTON STREET AND FAILED TO COME TO A COMPLETE STOP AT the STOP SIGN AT the INTERSECTION OF BEVERLY HILLS BOULEVARD AND SOUTH WASHINGTON STREET. the DEFENDANT THEN BEGAN TO RIDE SOUTHEAST TOWARDS MY POSITION, BEING STATIONARY, IN the MEDIAN OF BEVERLY HILLS BOULEVARD BETWEEN SOUTH WASHINGTON STREET AND SOUTH WADSWORTH STREET. AS THE DEFENDANT PASSED, I OBSERVED THAT THE BICYCLE HE WAS RIDING DID NOT HAVE ITS REAR LIGHT ACTIVATED. I THEN PULLED BEHIND the DEFENDANT AND ACTIVATED MY OVERHEAD LIGHTS AND SIREN AND STOPPED THE DEFENDANT AT the INTERSECTION OF BEVERLY HILLS BOULEVARD AND NORTH BARBOUR STREET. AS THE DEFENDANT WAS DROPPING HIS BICYCLE HE BEGAN TO REACH AROUND the COLLAR AREA OF HIS SWEATSHIRT HE WAS WEARING. I THEN APPROACHED THE DEFENDANT AND ADVISED HIM OF THE REASON FOR the STOP. THE DEFENDANT WAS THEN REQUESTED TO PARK HIS BICYCLE AND COME AND SPEAK WITH ME. I THEN ASKED THE DEFENDANT IF HE HAD ANYTHING ILLEGAL ON HIM, AT WHICH TIME HE STATED YES. the DEFENDANT THEN ADVISED THAT HE JUST HAD SOME PARAPHERNALIA IN HIS POCKET. THE DEFENDANT THEN REACHED INSIDE HIS POCKET AND RETRIEVED A ROLLED UP PIECE OF TOILET PAPER, WHICH CONTAINED A GLASS SMOKING PIPE. THE PIPE WAS CLEAR IN COLOR AND HAD A PIECE OF METAL MESH IN ONE END and IT WAS CHARRED FROM BEING BURNED. BASED ON MY TRAINING AND EXPERIENCE THESE PIPES ARE COMMONLY REFERRED TO AS "STEMS" AND ARE USED TO SMOKE CRACK COCAINE. THE DEFENDANT WAS THEN SEARCHED and nothing ELSE WAS FOUND. THE DEFENDANT WAS GIVEN A VERBAL WARNING FOR HIS TRAFFIC VIOLATION AND WAS ISSUED A NOTICE TO APPEAR, CITATION NUMBER 19086, WITH A MANDATORY COURT DATE OF 121814 AT 1300 HOURS. the DEFENDANT WAS GIVEN HIS COPY OF THE CITATION AND THEN RELEASED FROM the SCENE. THE EVIDENCE WAS COLLECTED and TURNED IN. |
