SUBMITTED BY: SUNDBERG, KURT 1268 (AR16-19543) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO-WIT: APPROXIMATELY 3.81 GRAMS OF METHAMPHETAMINE DIVIDED INTO SEVEN DIFFERENT BAGGIES AND APPROXIMATELY 0.63 GRAMS OF CRACK COCAINE IN A CLEAR PLASTIC BAGGIE, WITH THE INTENT TO SELL THE SAID SUBSTANCE TO ANOTHER PERSON, IN VIOLATION OF FLORIDA STATUTE 893.13(1)(A)(1). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: ONE DIGITAL SCALE AND ONE USED HYPODERMIC NEEDLE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 052116, I RESPONDED TO DEPUTY LABORDA'S TRAFFIC STOP LOCATED AT TURKEY OAK DRIVE AND NORTHEAST 5TH AVENUE, IN CRYSTAL RIVER. UPON ARRIVAL, I OBSERVED DEPUTY LABORDA TO HAVE A 2004, SILVER IN COLOR, CHEVROLET PICKUP TRUCK, BEARING NEW JERSEY LICENSE PLATE H64ARV, PULLED OVER. UPON MAKING CONTACT WITH DEPUTY LABORDA, HE ADVISED ME HE STOPPED SAID VEHICLE FOR A STOP BAR INFRACTION IN THE AREA OF HIGHWAY 19 AND TURKEY OAK DRIVE. DEPUTY LABORDA THEN ADVISED ME THAT HE WAS GOING TO WALK HIS K-9 PARTNER, K-9 GUNNY, AROUND THE EXTERIOR OF THE VEHICLE. AFTER DOING SO, DEPUTY LABORDA ADVISED ME THAT HIS K-9 PARTNER ALERTED TO THE VEHICLE. THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR ROBERT CAROMANO, WAS ASKED TO STEP OUT OF THE VEHICLE, TO WHICH HE DID. CONTACT WAS THEN MADE WITH THE FRONT SEAT PASSENGER, MS TIFFANY VARNES. MS VARNES WAS ALSO ASKED TO STEP OUT OF THE VEHICLE, TO WHICH SHE DID. DEPUTY LABORDA THEN CONDUCTED A HAND SEARCH OF THE INTERIOR OF THE VEHICLE. DEPUTY LABORDA ADVISED ME THAT HE LOCATED A BLACK IN COLOR ZIPPER CONTAINER UNDERNEATH THE CENTER CONSOLE OF THE VEHICLE. DEPUTY LABORDA ADVISED ME THAT INSIDE THE CONTAINER WAS SEVEN BAGGIES OF METHAMPHETAMINE, ONE BAGGIE OF CRACK COCAINE, A DIGITAL SCALE, AND A HYPODERMIC NEEDLE. CONTACT WAS THEN MADE WITH THE DEFENDANT, WHERE HE WAS READ HIS MIRANDA RIGHTS VIA AN AGENCY ISSUED PREPRINTED MIRANDA CARD. UPON READING THE DEFENDANT MIRANDA, I ASKED IF HE UNDERSTOOD HIS RIGHTS, TO WHICH HE STATED YES AND ADVISED HE would SPEAK WITH ME. I THEN ASKED THE DEFENDANT IF HE KNEW WHAT WE HAD LOCATED INSIDE THE VEHICLE THAT HE WAS DRIVING, TO WHICH HE STATED YES. I ASKED THE DEFENDANT WHAT IT WAS AND HE ADVISED IT WAS METHAMPHETAMINE. I ASKED THE DEFENDANT IF HE WAS CURRENTLY USING METHAMPHETAMINE, TO WHICH HE ADVISED NO. I ASKED THE DEFENDANT WHY HE HAD THE METHAMPHETAMINE, TO WHICH HE STATED THAT HE WAS HAVING A HARD TIME WITH MONEY AT THIS TIME, HE HAD GOTTEN THE METHAMPHETAMINE FROM A FRIEND, AND HE WAS GOING TO SELL IT FOR THE FRIEND. I ASKED THE DEFENDANT HOW MUCH HE WAS CHARGING PER BAGGIE OF METHAMPHETAMINE, TO WHICH HE STATED $20.00 PER BAGGIE. I ASKED THE DEFENDANT WHO DECIDED THE PRICE, TO WHICH HE ADVISED HIS FRIEND DID. THE DEFENDANT WAS THEN ADVISED THAT HE WAS BEING PLACED UNDER ARREST. EACH OF THE SEVEN BAGGIES WAS WEIGHED, WITH A TOTAL WEIGHT OF 3.81 GRAMS. THE CRACK COCAINE WAS WEIGHED, WITH AN APPROXIMATE WEIGHT OF 0.63 GRAMS. THE METHAMPHETAMINE WAS TESTED BY DEPUTY LABORDA USING A PRESUMPTIVE FIELD TEST KIT, WHICH YIELDED A POSITIVE RESULT FOR METHAMPHETAMINE. THE CRACK COCAINE WAS ALSO TESTED USING A PRESUMPTIVE FIELD TEST KIT, WHICH YIELDED A POSITIVE RESULT FOR COCAINE. DEPUTY LABORDA COLLECTED THE CONTRABAND WHICH WAS LATER TURNED IN TO EVIDENCE. THE DEFENDANT WAS ISSUED WRITTEN WARNING, WARNING NUMBER 406356B, FOR THE STOP BAR INFRACTION. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $5,000.00 FOR POSSESSION OF A CONTROLLED SUBSTANCE WITH THE INTENT TO SELL AND $1,000.00 FOR POSSESSION OF DRUG PARAPHERNALIA. THE DEFENDANT 'S TOTAL BOND WAS SET AT $6,000.00 PER THE BOND SCHEDULE. |
