Probable cause affidavit: SUBMITTED BY: TROOPER VAUGHN (AR14-13064) On 120714, The defendant did operate on the streets of this state a 2015 Toyota pickup, white in color and bearing Florida license plate 5815PF registered to a Tommy Melvin Morgan and Thomas Jacob Odom of Spring Hill Florida, in violation of Florida Statute 316.193(1)(b) and 316.193 (a) (b) (c) (1). On 120714, I was dispatched to a single vehicle crash versus a fence on EAST Van Ness ROAD at THE intersection OF NORTH Arkansas Terrace. I arrived on scene at 21:49 hours and met with Citrus County Sheriff's Deputy Howard, who apprised me of the incident and of the available witnesses. My first observationS of the suspect vehicle were that it was stopped in the roadway on NORTH Arkansas Terrace in the middle of the roadway facing north, at the intersection with EAST VanNess ROAD. The defendant was still sitting in the vehicle with the driver’s side door open. The left, front and right side of the vehicle had damage consistent with a fence collision. There were multiple opened 12 oz aluminum Busch beer cans in the bed of the truck and one unopened can in the center console to the right of the driver. I then observed the damaged fence that was located off the north shoulder of EAST Van Ness ROAD, directly north of the intersection to be approximately 14 feet off the shoulder down a slight embankment with damaged brush/weeds an additional 6 feet further. I met with Deputy R Ramos, who informed me that he was the first deputy on scene and that he had observed the defendant still in the vehicle at its present location with the engine running. I then called my other witness, MR Timothy Lee Daugherty, who informed me that he observed the defendant in the vehicle as it was being pulled from the fence line. I then made contact with the DEFENDANT and noted that the smell of the impurities of an alcoholic beverage were being emitted from his person and that his eyes appeared slightly blood shot and watery. When I asked the defendant what had happened, he stated that he had stopped at the intersection to make a left turn onto EAST Van Ness Rd and as he proceeded, his power steering had froze. When asked why he didn’t used his brakes, he replied that he didn't think of it. Both statementS were later repeated post Miranda. I then asked the defendant to walk back to my patrol car parked a short distance away and observed his walk to be unsteady and slow. Once at my patrol car, at 22:45 hours, I advised the defendant that my crash investigation was complete and read him his Miranda warnings from my pre printed agency card, to which he advised he understood and agreed he would speak to me. I asked if he would perform some field sobriety exercises, to which he agreed. The first evaluation was the horizontal gaze nystagmus test. The defendant exhibited lack of smooth pursuit, onset of nystagmus prior to 45 degrees and nystagmus at maximum deviation. The next two tests were the walk and turn and the one leg STANDS. The defendant stated he understood the directions as I explained them and eventually performed poorly on both exercises. At 23:01 hours, I placed the defendant under arrest for suspicion of DUI, handcuffed and double locked him behind his back and placed him in the right rear seat of Deputy Ramos' Patrol vehicle for transport to the Citrus County Detention Facility. The defendant arrived at the detention facility and was booked in at 23:48 hours, but was not given the opportunity to perform a breath test until after my arrival at 00:37 hours on 120814. The defendant was offered and agreed to perform a test of his breath at 00:48 hours. The results of that test were .164, .143 and .154. THE DEFENDANT’S BOND FOR DUI WAS SET AT $250.00, AND THE BOND FOR DUI WITH PROPERTY DAMAGE WAS SET AT $250.00, FOR A TOTAL BOND AMOUNT OF $500.00. NOTE: OF the items inventoried in the defendants vehicle prior to being towed were 3 unloaded firearms that Citrus County Deputy Ramos took immediate possession of reference Citrus County Sheriffs Office case #2014-00167153. Additional charges: Violation of Florida statutes 316.1925(1) Careless driving and 316.066(1)(d) Failure to provide proof of insurance at crash.
