| Probable cause affidavit: | SUBMITTED BY: MARSHALL, AIDAN 0453 (AR09110002) UNLAWFULLY AND WILLFULLY ENTER OR REMAIN IN A STRUCTURE OR CONVEYANCE, TO WIT: THE DENNY'S RESTAURANT IN CRYSTAL RIVER, THE PROPERTY MANAGED BY THE COMPLAINANT, WITHOUT BEING AUTHORIZED, LICENSED, OR INVITED TO DO SO BY THE OWNER, LESSEE, OR THEIR AGENT, AND AFTER HAVING BEEN WARNED, IN VIOLATION OF FLORIDA STATE STATUTES 810.08(1) AND 810.09(2)(B). ON 071409 AT APPROXIMATELY 0252 HOURS, I WAS DISPATCHED TO DENNY'S RESTAURANT LOCATED AT 2380 NORTHWEST HIGHWAY 19 IN CRYSTAL RIVER IN REFERENCE TO THE MANAGER/COMPLAINANT REQUESTING AN INDIVIDUAL BE TRESPASSED. UPON ARRIVAl, i made contact with the complainant who was standing outside. THE COMPLAINANT indicated he wanted the INDIVIDUAL WHO Was sitting on the bench outside of the restaurant to be removed from the property. i made contact with the individual sitting on the bench, laTER IDENTIFIED AS THE DEFENDANT, MR THOMAS PRYzBYLKO, iii, WHO APPEARED to be EXTREMELY INTOXICATED. BOTH DEPUTY LABELLE AND I ANNOUNCED OUr PRESENCE AND ADVISED THE DEFENDANT HE WAS TRESPAssed from the property. the defendant was given numerous opportunities to advise us of his address; however, he only stated he lived in florida. the defendant was offered a ride numerous times. each time, the defendant became belligerent and used profanity. the defendant stood up from the bench and was advised if he did not leave the premises he would be arrested, to which he stated "i don't care, go ahead and arrest me." the defendant was given one last opportunity to leave, to which he again refused. the defendant was subsequently placed under arrest. he was handcuffed (double locked) behind his back, secured in the rear seat of my patrol vehicle aND TRANSPORTED TO THE citrus county detention facility for booking and processing. upon arrival, the defendant was ENTERED IN THE TRESPASS LOG, PER THE REQUEST OF the COMPLAINANT. the DEFENDANT'S BOND was set at $500.00, PER THE BOND SCHEDULE. *NOT-EXEMPT* |
